COUNTY;"
N I T N E 6 6 E T H:
NAEAEA6, at is the intent of this Law Enforcement Agencies
Interlocal Communication Agreement, hereinafter "Agreeme that
the existence of intensive and dangerous law enforcement situa-
tions, especially those that c[oss jurisdictional lines, require
t e preparation of law enforcement resources adequate to respond to
such activity, protect the public peace and safety, and preserve
the lives and property of the people; and
NAEREA&, it is beneficial for the law enforcement agencies of
the subscribed jurisdictions to participate in a county-wide Public
Safety Radio Communication System which would include all
fire/rescue, public safety, emergency medical service dispatch
the subscribed jurisdictions 1n a County-wide Public Safety Radio
Commun Stations System will provide Saw enforcement services with
the capability of using inter-agency assis<ance to insure the
quickest response <ime to emergency dispatches. The coordinated
system will allow dispatches to be announced to all agencies
simu ltaneovsly, which will prevent needless duplicity of response
by agencf es to emergency calls. The sharing of the County-wide 800
MHz System will help ensure essential radio communications
regardless of agency affiliation and jurisdiction. This Agreement
will promote inter-agency of flciency and enhanced service to the
citizens of all participating jurisdictions; and

NOA, THEREEOxE, zn consideration of the mutual covenants set
forth he rern, the law enforcement agencies of the subscribed
jurisdictions agree as follows:
section 3. Purpose And Intent Of Agreement. The law
enforcement agencies participating in thzs Agreement (hereinafter
iefer[ed to as AGENCY OR AGENCIES") agree to share the C'OUNTY's
BOO MHz radio system. The sharing of this system will enhance the
communications capabilities of all participating AGENCIES and will
provide an efficient way of accomplishing inter-agency communica-
tions and County-wide alert dispatching. Hy agreei ng to share the
COIINTY's 80o MHz radi system, AGENCIES agree that the COUNTY'S 800
MHz radio system will be the pelmary system used by the AGENCIES
for communications and dispatch puzposes. Each AGENCY shall have
its own Home Announcement Group" on the COUNTY'S BOO MHz radio
system to allow single agency communication. Dispatching will
occur aczoss the County-wide channel and all the "Nome Announcement
Group" channels simultaneously. This system gives each AGENCY the
capability for independent as wa 11 as inter-agency communications.
Section 2. Drstribution of Equipment. The COUNTY shall
provide to AG F.NCIES the 800 MHz zadio equipment necessary for
operating on the system, s described in the inventory and cast
projection. See Exhibit "A". Mobile, portable, and dispatch
control stations will be distributed to AGENCIES as set forth in

Bec tvon J. Compatibility of Equipment. AGENCIES may purchase
additional eo0 MHz equipment directly from Motorola for use on the
SOO MHz system, however, such equipment shall be approved by
COllNTY s Public Safety Department, Telecommunications Division to
ensure system compatibility. The cost of such equipment shall be
the responsibility of the AGENCY pucchasi ng the additional
equipment.
Section 4. Haintenance o£ Equipment. A11 equipment purchased
by COUNTY and distributed to AGENCIES pursuant to this Agreement
shall be ma intainetl by the COUNTY'S Department of Public Safety,
Telec ommunica Yions Division. Maintenance costs on all equipment
puecnasea by the COUNTY will be the responsibility of tRe COUNTY.
Maintenance costs on additional egu ipment purchased by the AGENCIES
subsequent to tRis Agreement will be the responsibility of that
AGENCY. Maintenance and repairs should be coordinated with the
MOTOROLA Services Center. MOTOROLA shall be tRe sole provider of
serve maintenance and repair of COUNTY'S S00 MHz Teuncked Radio
System. Upon [eques t, the COUNTY'S Public Safety Department,
Telecommunications Division may coordinate the maintenance of the

Liabiliti as and Responsibilities of earties
employees, hall not be deemed to assume any liability for the
acts, omission and negligence of the other party, and each party
shall hold the other party harmless from and shall defend the other
party and its ofYicers and employees against any claim for damages
resulting therefrom.
(b) All of the privileges and immunities f[om liability,
exemptions from laws, ordinances and rules, and all pensions and
relief, disability, worker's compensation, and other benefits which
apply to the activity of offices or employees of either party when
performing their respective functions within the territorial limits
for their respective agencies shall apply to the same degree and
extent to the performance of such functions and duties extra-
tereitorially puesuant to this Agreement.
(c) except as herein otherwise provided, all liability for
injury to personnel, and for loss or damage of equipment shall be
borne by the party employing such personnel and owning such
equipment, and all parties shall carry sufficient insurance to
this Agreement as to said terminating party by giving at leasT
twelve (32) months written notice to all other parties. All radio
equipment i., sued by the COUNTY shall be returned to the COUNTY
within thiety (30) days of the date of termination as indicated in
the <welve (12) month notice. All equipment purchased by the
~' participant shall remain the property of the participant, however,
use of said equipment on the COUNTY'S 000 MHz system shall be
prohibited.
