WHEREAS, the subscribed law enforcement egenc~es are so located in relation to each
other that it is to the advantage of each to receive and extend Mutual Aid in the form
of law enforcement services and resources to edegnately respond to cont[n in g,
multi-juristlictiottal law enforcement problems, so as to protect the public peace and
r safety, end preserve the lives and property oP the people; end,
WHEREAS, the Altamonte Springs P¢tice Department, the Casselberry Police
Department, the Lake Mary Potice Department, the Longwood Pol(ce Department, the
Maitland P¢liee Department, the Oviedo Police Department, the Sanford Polico
Department, the Winter Springs Police Department, and the Seminole County
Sheriff's Office have the authority under Pert I of Chapter 23, Florida Statues
(138'!), the Florida M1lutual Aid Act, to enter into a Voluntary Cooperation Agreement
(ar assistance of e routine law enforcement nature that crosses jurisdictional lines
and requested operational assistance agreement far [he rendering of assistance in
connection with law enforcement intensive situations.
NOW, THEREFORE, THE PARTSES AGREE AS FOLLOWS:
SECTION] PROVISIONS FOR OPERATIONAL ASSISTANCE
THEREFORE, be it known that the aforesaid law enforcement agencies hereby approve and

parades, a capes from tletention facilities, and incidents requ Ting utilization of
specialized units.
SECTION II PROVISIONS FOR VOLUNTARY COOPERATION
THEREFORE, be it known that the flfoxesafd law enforcement agencies hereby approve end
enter into this Agreement wheeeby each of the agencies may rentler law enforcement
assistance to the other in dealing with any violations oP Florida Statutes to ~neluda, but
not necessarily be limited [o, investigating homicitles, sex offenses, robberies, assaults,
burglaries, larcenies, gambling, motot vehicle thefts, antl drug violations, pursuant to
Chapter 893, Florida Statutes, back-np services, inter-agency task forces, andlor joint
investigations including but not limited to, the City/County/State Toaffic Enforcement
Udt~ the City/COVnty Investigative Bureau, the City/County Getune Unit, the Special
capons antl Tactics Team, and the Bomb Disposal Unit.
~, SECTION III POLICY AND PROCEDUAE
a. In the event that a party to this Agreement is in need of assistance as
set forth above, tt shall notify the agency heed or his designee from -
who such assistance is required. The agency head designee whose
assistance is sought shall evaluate the s~tuatt n, and [he agency's
avaflable resoux Haul[ with his/her supervisors if necessary,
and will respond in a manner he/she deems appropriate. The agency
head's decision in this sagard shall be final.
b. The resources or facilities that are assigned by the assisting agency
shalt be under the immediate command of a supervising officer,
designated by the assisting agency head. 9uoh supervising officer
shat) be under [he direct supervision and command of [he agency heatl
or his designee of the agency requesting assistance.
~ c. Where investigative priorit(es anise duringalaw enforcement operation

wh(ch may require the orossing of jurisdiotional lines, each party
ageees that the agency administrator ox his designee on duly shall
~ notify the agency administrator of the jurisdiction entered, end
request enforcementaseistanee. The responding agenc-edministrator
or his designee shall evaluate the situate onsult •viN his
appropriate supervisor if necessary, end, if required, insure Nat
d. Should en aPffcer oP a participating agency ba in another ja eisdiction
for matters of a routine nature, or investigative nature, such as
travelling through the area on routine business, ettendinga meeting,
or going to or from work, and a criminal violation of Florida Statutes
occurs ~n the presence of said officer, and said violation is e felony or
othee offense constituting a breach oP the peace, the officer shalt be
empowered [o render enforcement assistance and act in accordance
with law. Prior io enforcement action being taken in the other
agency's jurisdiction, Ne offlaee shall notify that jurisdiction's
Communication Center of the situation. The Doty exception would be
the situation where immediate aotion is neoensary. In that event, the
Communications Center would be notified immediately thexeaftee.
e. Should additional violations oP the Florida Statutes ocour in tho
presence of said officer, r p ser. ing his or her respective agency in
furtherance of this Agreement, he lshe shall be empowered [o eentler
enforcement assistance and act in accordance with the law.
SECTION IV POWERS PRIVILEGES, ItRr1UNITIES, AND COSTS
s. Alembees of the subscr(bed taw enforcement agencies, when actually
engaging in mutual cooperation end assistance outside of the
juxisdicitonal limits of their respective agenaies, under the teems of
/~ this Agreement, shall, pursuant to the provisions of Section 23.12v,
Florida Statutes, have the sa e powers, duties, righxs, privileges,
and immunities, as ff they were performing their tluties in [he political
subtlicision in which they are normally empioyetl.
Each parry ageees to fvenish veces ary equipment, resource ,end
facilities, and to render services [o each other party to the Agreement
as set Forth above, provided however, that no party shall be regvieed
aerviaea, to earnfamng anm mnmal a;a.
c. The agency furnishing attl, pursuant to this Agreement, shell bear the
loss or damages to such equipment, antl shall pay any expense
ivrurred in the ope[fl[fon and maintenance thereof.
d. The agency furnishing aid, pursuant to [his Agreement, shall
eomponsata iY appotn[ees/employeee dyeing the time such aid is
rendered, and shall defray the actual travel maintenance expenses of
such appointees/employees while they ere rendering such aitl,
inoludivg evy amounts paid or due for compensation due to personal
injury or death wh[te such apPOtntees(empioyees ere engaged in
rendering such aid.
e. All the privileges and immunities Pxom liability, exemption from laws,
ordinances and rules, and all pension, insurance, relief, disability,
worker's nompensation, satery, death end other benefits which apply
to the activity of such officers, agents, or employees of any such
agency when performing their respective functions within the
terr~toriai Itmits of theie respective public agencies, shall apply to
them to the same degree, manner, and extent while engaged in the
performance of any of theie funetions and duties extrateemtoeielly
under the provisions of this Mvxual Aid Agreement. The provisions
of this section shall apply with equal effect. to Pull ti e paid, part
hme,volunteers, and reserve members.
SECTION V INDEMNIFICATION
Each party engaging in any mutual cooperation antl assistance, pursuant to [his
Agreement, agrees w(th respect to enY suit or claim for damages resulting from any antl
all acts, omissions, ox contluct of such party's own appointeeslemployees occurring while
engaging in rendering such aid, pursuant to this Agreement, to hold harmless, defend,
and indemnify the other part{cipating party and his appointeeslemployees, subject to
provisions of Section '168.28, Florida Stah~[es, where applicable and [o the extene
permitted by law. Any party having a duty to indemnify and defend under this
Agreement shall have control of the defense of any suit or claim artsing under said duty.
Each party shall be responsible for [he acts, omissions, ox conduct of its own employees.
SECTION VI INSURANCE PROVISIONS
Each party shall provide satisfactory proof of liability insurance by one or more of the
means specified in Sectio¢ ~68.28(19J, Florida Statutes, in an amount which is, in the
judgment of the governing body of that party, at least adequate to cover the risk to which
that party may be exposetl. Should the insurance coverage, however provided, of any
party be canceled or undergo material change, that party shall notify all parties to this
Agreement of such change within ten (]0) days o£ receipt of notice or actual knowledge
of such change.
SECTION VII EFFF•.CTIVE DATE
This Agreement shall take effect upon execution end approval by the heeeinafter named
offiofals, and shall mntmne m full Porca and effant anal January 7, 1899, unless
terminated prim thereto by any or alt the parties herein.
SECTION VIII CANCELLATION
This Agreement maybe canceled by any party upon delivery of written notice to the other
parties. Cancellation will occur e[ the dirertion of any subscribing party.
