Esl finger, an elected constitutional officer, whose address is sanford Airport-HUilding 310, 1745 East 28th Street, Sanford, Plorida 327]3; the FLORIDA HIGHWAY PATROL, whose address is 1551 East International Speedway Bou levazd, Deland, FL 32J2a; and s eMINOLE coDNTY, a poi itlcal subdivision of the state of Florida, whose address is seminole county services Building, ilol East Frrst Street, Sanford, Florida 32] , hereinafter referred to as WHERE , it is the intent of ihis Law Enforcement Agencies Sntezlocal Communication Agreement, hereinafter "Agreement," that trte existence of intensive and dangerous law enforcement situa- tions, especially trtose that cross jurisdictional lines, require the preparation of law enforcement resources adequate to respond to such activity, protect the public peace and safety,-and preserve the lives and property of the people; and WREAEAe, it is beneficial for the law enforcement agencies of the subscribed jurisdictions to participate in a County-wide Public Safety Radio Communication System which would include all fire/resc public safety, emergency medical servic dispatch services and law enforcement services; and WeEREAe, the participation of the law enforcement agencies o£ the subscribed jurisdictions 1n a county-wide Public safety Aadio communications System will provide law enforcement services with the capability of using inter-agency assistance to insure the quickest response time to emergency dispatches. The coordinated system will allow dispatches to be announced to all agencies simultaneously, which will prevent needless duplicity of response by agencies to emergency calls. The sharing of the County-wide 900 MHz System will help ensure essential radio communications regardless of agency affiliation and jurisdiction. This Agreement will promote inter-agency efficiency and enhanced service to the citizens of all participating jurisdictions; and WBEAEAE, the law enforcement agencies of the subscribed juriaaicti ons are autnorizea to enter into an agreement to chore an 800 MHz System pursuant to Chapter 163, Florida Statutes. NOW, THEREFORE, in consideration of the mutual covenants set forth herein, the law enforcement agencies o£ the subscribed jurisdictions agree as Follows: section 1. Purpose Ana Intent Of Agxaemeat. The law enforcement agencies participating in this Agreement (hereinafter refe[red to as "AGENCY" OR "AGENCIES") agree tc share the COUNTY'S 800 MHz radio system. TRe sfiaiing of this system will enhance the communrcations capabilities of all participating AGENCIES and will provide an efficient way of accomplishing inter-agency communica- tions and County-wide alert dispatching. Hy agreeing to share the COUNTY'S 800 191z radio system, AGENCIES agree that the COUNTY'S 800 MNZ radio system will be the only system used by the AGENCIES for communications and dispatch purposes. Each AGENCY shall have its own "Home Announcement Group" on the COUNTY'S B00 MHz radio system tG allow single agency communication. Dispatching will occur across tRe County-wide channel and all the "Home Announcement Group" channels sisultaneovsly. This system gives each AGENCY the capability for independent as well as inter-agency communications. Section 2. Distribution of Equipmebt. The COUNTY shall provide to AGENCIES the 800 MRZ radio equipment necessary for operating on the system, as described in the inventory and cost projection. Bee Exhibit "A". Mobile, portable, and dispatcR control stations will be distributed t0 AGENCIES as set forth in Exhibit "A". All eadims furnished by COUNTY under this Agreement will be purchased by COUNTY and will remain the property of coUNTY. eection 3. Compatibility of equipment. AGENCIES may purchase additional 800 MBx equipment far use on the 800 IAiz system, however, sucR equipment shall be approved by and purchased thrmugR the COUNTY'S Public safety Department, Telecommunications Division to ensure system compatibility. The cost of such equipment shall be [he responsibility of the AGENCY purchasing the additional equipment. section ~. Maintenance of Equipment. All equipment purchased by COUNTY and distributed to AGENCIES pursuant to this Agreement shall be maintained by the COUNTY'S Department of Public safety, Telecommunications Division. Maintenance costs on all equipment purchased Dy the COUNTY will be the responsibility of the COUNTY. Maintenance costs on additional equipment purchased by the AGENCIES subsequent t0 this Agreement will be the responsibility of that AGENCY. Upon request, the COUNTY'S Public Safety Department, Telecommunications Division may maintain the additional equipment purchased pursuant to this Agreement, utilizing a charge-back system, at cost, to be cmnaiatent witn inat in effect at roe time of the execution of this Agreement. See Exhibit "B. eection 5. LiaDili ties and RespoasiD111t1ea of Parties. (a) The parties Rereto, their eespective officers and employees, shall not be deemed to assume any liability for the acts, omissio , and neq llgence of the other party, and each party shall hold the other party Rarmless from and shall defend the other party and its officers and employees against any claim for damages resulting therefrom. (b) All of the privileges and immunities from liability, exemptions from laws, ordinances and rules, and all pensions and reli af, disability, orker's compensation, and other benefits which apply to the activity of officers or employees of either party when performing their respective functions within the territorial limits Por their respective agencies shall apply to the same degree and extent to the performance of such functions and duties extra- territorially pursuant to this Agreement. (c) Except as herein otherwise provided, all liability £or injury to personnel, and for loss or damage of equipment shall be borne by the party employing such personnel and owning such equipment, and all parties sM1all carry sufficient insurance to roomer all aaen liabilitims. section s. Termination of Agreement. Any party may terminate this Agreement as to said terminating party by giving at least sixty (60) days written notice to all other parties. All radio equipment issued by the COUNTY shall be returned to the COUNTY within thirty (30) days oP the date of termination as indicated in the sixty (s0) day notice.
