FROM DEVELOPERS TO OFFSET TRAFFIC IMPACT ON L.R. 427

BETWEEN S.R. 434 AND CHARLOTTE STREET.
WHEREAS, the Board of County Commissioners has adopted Planning
Guidelines for Transportation; and
WHEREAS, the Hoard of County Commissioners has enacted the Land
Development Code of Seminole County, Florida; and
WHEREAS, the Board of County Commissioners has adopted Resolution
No. 85-R- 80 , dated April 23 , n 85 ; and
WHEREAS, although the Planning Guidelines for Transportation and
the Land Development Code impose certain requirements on developers such as
donating additional road right-of-way, constructing W.Illary or turn lanes
and doing intersection improvements, it has been determined by the Board of
County Commissioners that these fall short If the demands created by develoP-
ment in the area, and
WHEREAS, L.R. 427 between S. R. 434 and Charlotte Street is located
within the City of Lon9wood and is currently classified as an urban minor arte-
rial road in the County -wide system led is operationally deficient under gen-
erally accepted engineering standards for urban minor arterial roads; and
WHEREAS, proposed and future development aloe, C.R. 427 between
S.R. 434 and Charlotte Street, and on adjacent properties, is expected to create
further traffic congestion, lengthy delays and safety hazards, especially at
the intersections of Marvin Avenue, Wildmere Avenue, Mafn Street and Blanche
Strect; and
WHEREAS, there presently are not funds available to purchase ad-
ditional right-of-way and install the necessary improvements to alleviate
operational deficiencies and provide necessary capacity for future needs; and
WHEREAS, the Longwood City Commission feels it Would be detrimental
to the public health, safety and welfare to rezone arty property to A higher
density, issue curb cuts, site plan approval or other permitting Which will
impact C.R. 427 between S.R. 434 and Charlotte Street, until such time as funds
have been made available for the installation of necessary improvements to off-
set the additional traffic impact or safety impact; and

WHEREAS, in order to provlde for needed roan improvements,
developers have volunteered to contribute money and right-of-way to offset
the traffic 'impact caused by their development; and
WHEREAS, the Board of County Lomnissi pners desires to establish
I uniform method for determi ni n9 each developer's share and procedures for
payment and conveyance,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF LONGNOOD,
FLORIDA that the following procedures will be utilized to collect fees and re-
ceive right-of-way from developers who have voluntarily elected to contribute
money and right -If -way t0 offset the traffic impact on C.R. 427 between S.R. 434
and Charlotte Street, created by their tleve 1ppment:
1. The City If Longwood concurs in the Cpunty's Resolution
No. 85-R- 80 adopted by the Board of County Commissioners on April 23 , 1985. 1
2. In order to cooperate with Seminole County in the administration
If Resolution No. 85-R--80 and tp assure that development within the City of
Longwood along C.R. 427 between S.R. 434 and Charlotte Street addresses in a un-
iform and consistent method traffic impacts resulting from 1-1, development, the
City will notify the County upon receipt by the City of any antl all applications
for building permits along L.R. 427 between S.R. 434 and Charlotte Streets.

3. The City will not issue any building permit along C.R. 427 ~
between S.R. 434 and Charlotte Street without receipt of evidence from the
County If compliance with County Resolution No. 85-R- DD
4. Developments in the area of L.R. 427 between S.R. 434 antl
Charlotte Street shall pay the entire computed growth fee and convey the appro-
priate right-,f-way prior to the issuance of the I!— building permit by either
the City of Lo n9wood or Seminole County.
