WHEREAS, the City is granted the authority, under § 2(b), Art. VID of the
Florida Constitution, to any power for municipal purposes, except when
expressly Prohibited by IawxandR
WHEREAS, on September 1, 2004, Governor lab Hush declared a state of
emergency under Executive Order Number04192 due to }luricane Frances; and
WHEREAS, Hurticane Frances caused substantial and extensive damage in the
City of ].Dogwood including, but not limited to, downed trees, loss of electric power,
damaged property, and loss ofphone service; and
WHEREAS, given the substantial and extensive damage causes by Hurricane
Frances, the City of Longwood must take extraordinary measures to protect the public
health, safety, and welfare; and
WHEREAS, Ne City Commission of the City of Longwood, Florida, has
determined it to be in the best interest of the safety, health, and welfare of the citizeru of
the City ofLOngwood to adopt this Ordinance.
NOW, THEREFORE, THE CTPY COMMISSION OF TBE CITY OF
LONGWOOD HEREBY ORDAINS, AS FOLLOWS:

Section 3. Waiving CompMiBve Diddiv& 1n order to facilitate and
expedite disanm rewvary, competitive bidding is hereby waived for ell city pumhases
requved b clean-up debris, restore or repairirty uulhieq and make emergency repairs to
public property. The Chy Adminisvaior should, however, attempt to abmin the most
competitive pricing available given the cittvmstances.
Sario° 4. Temporary Leases of Rml Property. The City Adminimator is
hereby authorised to rater into any temporary lease agrmmem for rent property which is
necessary for creating and operafing a temporary wane reduction and staging area to
process and remove debris.
SsBoa 5. Sevenbility. ff any satioq subsecrioq sentence, clause, phase,
word or provision ofthis ordinance is for anY reason held invalid or wcoonimtional by
any court o£ competent jurisdiction, whether for mbmantivq proceduN, or anY oNer
eaWq such portion shall be deemed a separate, distinct and independent provision, and
such holding shall not aff the validity ofthe remNNng poriioru ofthis ordirmnce.
SecBOn fi. Efiec[ive Dete. This Ordinance shNl become effective
mmediately upon adoption by We City Commission of the City of Longwood, Floridq
and pursuant to City Charter, and shall expire sixty (60) days wen dm affective date
uNess sooner repeNed by the City Commission.
ADOPTED by the City Commission of the City of Longwood Florida, in a
spxiN meeting assembled on the 81° day of September, 2004.
