AN EMERGENCY ORDINANCE OF THE CPTY
COMMISSION OF THE CITY OF LONGW OOD, FLORIDA,
DECLARING AN EMERGENCY AND ADOPTING
EMERGENCY REGULATIONS TO ADDRESS THE
AFTERMATH OF HURRICANE CHARLEY;
AUTHORIZING THE CITY ADMINISTRATOR TO
EXECUTE CERTAIN DISASTER RECOVERY
AGREEMENTS BY PIGGY BACKING ON CONTRACTS
ENTERED INTO BY SEMINOLE COUNTY; WAIVING
COMEETI'ITVE BD)DING REQUll2EMENTS ON
CONTRACTS REQUIRED TO CLEAN-UP DEBRIS,
RESTORE UTILITINS, AND MAKE REPAHIS ON PDBLIC
PROPERTY; AUTHORIZING THE CITY ADMINISTRATOR
TO ENTER INTO TEMPORARY LEASE AGREEMENTS
WITH PROPERTY OWNERS FOR PURPOSES OF
CREATING TEMPORARY WASTE REDUCTION STCES
AND STAGING AREAS; PROVDIING FOR SEVERABH.TTY,
EFFECTIVE DATE, AND A SIXTY DAY EXPIRATION
DATE.
WHEREAS, the City is gamed the authority, under § 2(b~ Art. VIII of the
Florida Comtimtion, W ex any power for muNCipal purposes, except whey
expressly prohibited by law; endue
WHEREAS, the City Commission has the power and authority to declare a state
of emergency and pass an mmgency ordinance pursuant to Section 3.12 of the
Longwood City Charter and e
WHEREAS, on August 10, 2004, Governor Ieb Bush declared a Hate of
em«g¢vty uM« Executive Order Number 04182 due to Hurricane Charley; and
WHEREAS, on August 12, 2004, Seminole County slap declare! a state of local
em«gency; and
WHEREAg, Huricane Charley caused substantial end extensive damage in the
City of Longwood including, but not limited tq downed trees, loss of electric pow«,
damaged property, end Toss ofplrone service; end
WHEREAS, given the subsmntial end exmnsive damage ceus~ by Hurricane
Cbarley, the Ciry of Longwood must take ezVaordinary measures to protest the public
health, salary, and welfare; end

WHEREAS, the City Commission of the City of Longwood Floridn, has
delemdned that a state of emergency edsla end i[ to be in the best imerest ofthe safety,
health, and welf ofthe citizens ofthe City of Longwood to adopt this Ordinance.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF
LONGWOOD HEREBY ORDAINS, AS FOLLOWS:

Sution 2. Diaealer Recovery AgreemeaG The Oily Administrator is hereby
authorized to piggy beck on nny disaster recovery wn[nct approved by Seminole Connry
for puryoses of cleaning up any debris caused by, or resulting from, Humane Charley.
Section 3. Waiving Competitive Bidding. Iv order to facilitate and
expedite disaster rewvery, competitive bidding is hereby waived for ell city purchases
requ'ved to clean-up debris, restore or repair city uBlities, and make emergency report ro
public progeny. The City Administrator should however, mtempt m obtain Ne most
competitive pricing available given the c'namslances.
Bon 4. Temporary Leases of Real Property. The City Adminislrewr is
hereby authorized m enter into any temporary lease agreement for real property wMCh is
ecessary for creating end operating a temporary waste reduction end staging azee to
process end remove debris.

Section b. ERectivc Date. This Ordinance shell become effectve
mmedietely upon edoptlon by the Crty Commission ofthe City of Longwood Florida,
and pursuant to City Charter, and shall expire slaty (60) days from the effective date
unless sooner repealed by the City Commission.
