Ordinance 03-1670ORDINANCE NO. 03-'1670 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, FOR THE HIGHLAND HILLS DRAINAGE IMPROVEMENT PROJECT; WAIVING THE COMPETITIVE BID PROCEDURES; INCREASING THE PURCHASING AUTHORITY OF THE CITY ADMINISTRATOR: PROVIDING FOR CONFLICTS, SEVERABILITY, EFFECTIVE DATE AND SUNSETTING. WHEREAS, the City Commission has determined that there Is severe flooding problem in the Highland Hills antl The landings Subtlivisions; and a WHEREAS, the City Commission has determined that improvements to the drainage system in the Highland Hills Subdivision needs to be completetl in the most expeditious manner possible; and WHEREAS, the City Commission has tleclared that an emergency exists in the Highlantl Hills antl The Lantlings Subdivision relative to severe Flooding that could affect the life, health, property and/or peace of mind of the residents; and WHEREAS, the City Commission has determined that the torten! purchasing regulations hinders the City's ability to quickly correct the severe fiootling problem In the Highlantl Hills and The landings Subdivisions. NOW, THEREFORE, BE IT ORDAINED BV THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA: THAT, the Clry Commission has determinetl that a severe Flooding problem exists in the Highland Hills and The Lantlings Subtlivisions; antl THAT, needed improvements to the tlrainage system in the Highland Hills Subtlivision requires immediate action in order to protect the life, health, property. antl/or peace of mind of the residents: antl THAT, the curtenl purchasing regulations prohibit the Ciry hom making the sary improvements [o the drainage system in the Highland Hills Subdivision in the most expeditious manner possible; and THEREFORE, THE FOLLOWING ORDINANCE IS HEREBY ADOPTED AS FOLLOWS: SECTION i; BID PROCEDURES WAIVED. Article III of Chapter 16.5 of the Longwood City Cotle entitled Source Selection antl Contract Formation is hereby waivetl for the Highlantl Hills Drainage Improvement Protect. SECTION 2: INCREASE PURCHASING AUTHORITY. Article II, Section 16-5.9 all )(3) of Chapter i6.5 of the Longwood City Cotle entitletl Authority of the City Atlministrator is hereby waived. The City Atlministrator or his designee shall have the authority to approve contracts antl/or purchase orders for the Highlantls Hill Drainage Project up to $250,000.00 without Clty Commission approval. SECTION 3: CONFLICTS. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION d: SEVERABILITY. If any section, paragraph, sentence, clause. phrase o word of this ordinance is detenninetl to be i valid, unlawful o onstitutional, said determination shall not be held to invalitlate or impair the validity, torte or effect of any other section, paragraph, sentence, clause, phrase or wortl of this oNinance not otherwise tletermined to be invalitl, unlawful or unconstitutional. SECTION 5: EFFECTIVE DATE. This ordinance shall take effect immetliately upon adoption. SECTION 6: SUNSET. This Ordinance shall sunset upon the completion of all improvements to the Highland Hills Drainage System.
