WHEREAS, the City Commission ("COmmisalon") of the City of Longwood
Florida, ("City') established a Retirement Plan end Trust for the Fitefghters end Police
Officers of the City of Longwood (the "Plan") Duravant to ordinance numbu 95-828,
subsequently amended; and,
WHEREAS, the Plan was executed on December 4, 1995; and
WHEREAS, the Plan was restated and adopted on Onober I, I99], and
WHEREAS, Article 19 of the Plan Daaument authorizes the Employer to
amend the Plan in whole or in pan. either retroactively or prospectively, and
WHEREAS, the Commission, in its capacity as the Trustee of the Plan is the
appro0riate body [o amend the Plan on behalFof the City and the Plav Paticipants; and
WHEREAS, The City desires to amend the Plan and deems the amendments to
be in the bcrt interests of its participants and beneficiaries.

NOW, THEREFORE, BE 1T ORDAINED BY THE CITY COMMISSION OF
THE CRY OF LONGWOOD, FLORIDA AS FOLLOWS:
SECTION 1: The Commission in its capacity as the Trustee of the Plav hereby
amends the Plan as provided in Ana<hment A.
SECTION 2: Tha City hereby empowers the Commission with the authority to
such dovumavts and agreements as are required to eRectuato this amendment of
the Plan
SECTION 3: CONFLICTS. All ordinances or parts of ordinances in wnFliu
herewith are hereby repealed.
SECTION 4: SEVERABILITY. If any section paragraph, sentence, clause,
phras word of this ordina is determindto bei valiQ unlawful or nal,
said determination shall not be held to invalidate or impair the validity, force or e1Fea of
any other settion, paragraph se ,clause, Ohrase or ward of this ordinance nor
otherwise determined w be invalid `unlawful or unconstitutional.
SECTION 5: EFFECTIVE DATC This ordinance shall take affect immediately
upon adcpcion.

The Adoption Agreement and the Basic Defined Benefit Plan Document ar
Punnislrcd for the eo ~sidexation of tho Employer and its legal and &nandel
advisors. The 1lurida Municipal Pensimr Trust Fund advises tho sponsoring
Employer to consult with its o n attorney and fnancial advisors on the legal
and tan implications of the Defined Benefit Plan and the Adoption Agreement.
Nothing herein should be construed as constituting legal or tax advice.
We undoratand tlmt the Employer mny amend any election in this Adoption Agreement by
giving the 14nstea written notiflration of such Amendment ns adopted.
The Employer bemby agrees to operate under the provisions oL the Master Tcvst
Agreement creating the Floridn Municipal Pension Trust Fund, which is incorporated in
full into this Agreement end attached hereW as Exhibit A to the Basis Defined Benefit
Plan Document and the Adoption Agreement.
