AN EMERGENCY ORDINANCE OF THE CITY OF
LONGWOOD, FLORIDA, FOR THE HIGHUIND
HILLS DRAINAGE IMPROVEMENT PROJECT;
WAIVING THE COMPETITIVE BID PROCEDURES;
INCREASING THE PURCHASING AUTHORITY OF
THE CITY ADMINISTRATOR; DECLARING THAT
AN EMERGENCY EXISTS AND DESCRIBING 1T IN
CLEAR AND SPECIFIC TERMS: PROVIDING FOR
CONFLICTS, SEVERABILITY, EFFECTIVE DATE
AND SUNSETTING.
WHEREAS, the City Commission has de[erminetl that there Is severe
flootling problem in the Highland Hills and The Lantlings Subtllvisions; antl a
WHEREAS, the City Commission has detennlnetl that improvements to the
tlrainage system in the Highland Hills Subtlivision needs to be completed in the most
expeditious manner possible; and
WHEREAS, the City Commission has declaretl that an emergency exists In the
Highlantl Hills antl The Landings Subtlivision relative to severe Flootling that coultl
affetl the life, health, property antllor peace of mind of the residents; and
WHEREAS, the City Commission has detertninetl that the current purchasing
regulations hintlers the City's ability to quickly mrzect the severe Flootling problem in
the Highland Hills antl The Lantlings Subtlivisions.
NOW, THEREFORE, BE IT ORDAINED RV THE CITY COMMISSION OF THE
CITY OF LONGWOOD, FLORIDA:
THAT, the City Commission has tleterrninetl that a severe footling problem
exists in the Highland Hills antl The Landings Subdivisions; and
THAT. neetled improvements to the tlrainage system In the Highland Hills
Subdivision requires immetliate action in order to protect the life, health, property,
anNOr peace o! mind of the residents: and
THAT, the wrtent purchasing regulations prohibit the City from making the
ssary improvements to the drainage system in the Highland Hills Subtlivision in the
most expeditious manner possible; antl
THAT, the Ortlinance must be atlopted on an emergency basis without the
formalities of a frst reading, advertising antl secontl reading; and
THEREFORE, THE FOLLOWING EMERGENCY ORDINANCE IS HEREBY
ADOPTED AS FOLLOWS:
SECTION 1: BID PROCEDURES WAIVED. Article III of Chapter 16.5 of the
Longwood City Cotle entiHed Source Selection antl Contract Formation is hereby
walvetl for the Highland Hills Drainage Improvement Project.
SECTION 2: INCREASE PURCHASING AUTHORITY. Article II, Section 16-5.9
a(i )(3) of Chapter 165 of the Longwood City Cotle entitled Authority of the City
Administrator Is hereby walvetl. The City Administrator or his designee shall have the
authority fo approve contracts antllor purchase orders for the Highlands Hill Drainage
Project up to $250,000 00 without City Commission approval.
SECTION 3: CONFLICTS. All ordinances or parts of ordinances in con8icl
herewith are hereby repealed.
SECTION 4: SEVERABILITV. If any section, paragraph, sentence, clause,
phrase o word of this ordinance is detenninetl to be invalld, unlawful o
constitutional, said determination shall not be held to invalidate a impair the validilyr
force or effect of any other section, paragraph, sentence, clause, phrase ar word of this
ordinance not otherwise determined to be invalid, unlawful or unconstitutional.
SECTION 5: EFFECTIVE DATE. This ordinance shall take eRed immediately
upon adoption.
SECTION e: SUNSET. This Ortllnance shall sunset upon 60 days from the date
