Ordinance 01-1573ORDINANCE NO. 01-1573 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, ANNEXING AND AMENDING THE OFFICIAL BOUNDARIES OF THE CITY CORPORATE LIMITS ON THE EAST SIDE OF LAKE EMMA ROAD, ONE-HALF MILE NORTH OF LONGWOOD HILLS ROAD PURSUANT TO THE REQUIREMENTS OF CHAPTER 1'i1A42, FS; PROVIDING FOR THE SUBJECT PROPERTY TO BE SUBJECT TO TAXATION AND REGULATION BY THE CITY EXCEPT LAND DEVELOPMENT AND BUILDING CODES UNTIL THE CITY'S COMPREHENSIVE PLAN IS AMENDED PURSUANT TO THE REQUIREMENTS OF CHAPTER 163.3184 AND 163.3187, FS; AND, THE SUBJECT PROPERTY IS ZONED IN CONFORMANCE WITH THE REQUIREMENTS OF CHAPTER 24-97 OF THE CITY CODE; PROVIDING FOR CONFLICTS, SEVERABR.ITY AND EFFECTIVE DATE WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance 1019) pursuant m the requirements of Chapter 163, Pan 11, Florida Stet— end Chapter 9J-5, Florida Administrative Code:. and WHEREAS, on November 19, 1993, the Florid. Department of Community Affairs determined the City', Comprehensive Plan was IN COMPLINACE with the requirements of Chapter 163, Part 11, Florida Statutes and Chapter 9J-5 blond, Administrative Code; and WHEREAS, Chapter 163, Part D requires the City to implement the adopted Plan by land development regulations, and WHEREAS, pursuant to the authority of Chapters 166.041 and 163.3202, FlInda Statutes, the City enacted a Laud Development Code, end WHEREAS, Chapter 17I IS establishes the process for annexation by municipalities; WHEREAS, Chapter 24-100 and 24-101 of the City Code desenbes the process for City review of annexation requests; and WHEREAS, the Lend Planning Agency (LPA) held a public hearing on May 9, 2001 and eootinued to May 30, 2001 to wnsider the annexation request; and rewmmended the proposed annexation be denied by the City Commission; and r WHEREAS, the my has complied with the procedure Por mooting ordinances described in Chapter 166.041, FS and the prooedures for annexation described in Chapter 171 FS. RE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1. The ofli,ial City boundaries are hereby amend to include the real property described as Ibllows: l'he east side of Lake Emma Road, onnM1alf mile north of Longwood Rigs Road, and depioted on EXHIBIT A, .—hid! heroto although filly contained heein. SECTION 2: Upon annexation. the real property du'oribed herein mall retain the Seminole Cooly Comprch—ive Plan land use duignafion zoning, lend development and building r regulation authority until such time when the applicant requests and the City amends the City's comprehensive plan and zoning. SECTION 3: All real property described heroin shall bo assessed for payment of ad valorem taxes pursuant to law. SECTION 4: All persons who have been lawfully engaged in any pr.,,ly lioensed -.p.ion, businua trade or profusion with the real property described herein shall, upon the efPeotive date of this ordinance, have the right to continue said occupation, businesstrade or profession upon securing a valid city—pational license from the Off ice of1he City Clerk. SECTION 5: The City Clerk is hereby directed to file a certified oopy of this ordinance with the Office cf the Secrotary cf State the Office of the G.—, of the State of Florida, the Clerk oflhe Court.
