WHEREAS, The City o£ Longwood's Code En{oicement Code needs to
be amended to provide for liens to attach to property on which the
violation exrsts and real and personal property owned by the
violator antl to provide Eor an .vncreased lien tluxation and
attorney's fees upon foreclosure of the liened property,
SECTION 1. Chapter 2, Administration, Drvrsron 2 Codes
Enforcement Board, Section 2-143 Administrative fines, liens, of
the Longwood City Code shall be amended to read as follows:
Section 2-143. The enforcement board, upon notification by the
code inspector that a previous order of the enforcement board has
not been complied with by the set t. _ n finding that the
same violation has been r _ ted by «he same violator, may order
the violator to pay a fine not to exceed two hundred fifty dollars
(5250.OO) for each day the violation continues past the date Eor
compliance. A certified copy o£ the order imposing an
administrative Eine may be recorded rn the public records and
thereafter, shall const rtute a lien against the land on which the
violation errs
upon any other real or personal property owned by the violator, and
say be enforced rn the same maeeer as a court judgment by the
sheriffs of this sta , including levy against the personal
property, but shall not be deemed to be a court judgment except for
enforcement purposes. After srx ~6) months Erom the filing of any
such lien which remarns unpaid, the enforcement board may authorize
the local governing body attorney to foreclose on the lien. No
Lien created pursuant to the provisions of this chapter
may be foreclosed on real property which is homestead under Article
ectrnn 4 0£ the state constitution.
SECTION 2. Chapter 2, Administrztion, Dvvvs ron 2 Codes
Enforcement Hoard, Section 2-149 Duration of ,r , of the Longwood
City Code shall be amended to read as follows:
Sec .2-144 Duratvon o£ lien. vo _aen imposed pursuant to this
chapter shall contvnue for a longer p iotl than twe twenty years
{2}!201 after the certified cooy of an order imposing a fine has
been recorded, unless within that time frame an action to foreclose
on the lien is commenced in a cour_ o_ competent jurisdiction. Ail
legal costs vncurred _n the foreclosure actr vncluding
reasonable attorney's fees, shall be assessed as part of the costs
against the violator or owner of the property foreclosed. The
contvnuatvon o£ the lien effected by the commencement of the action
shall not be good against credi^_ors or subsequent purchasers {or
valuable consideration without notice, unless a notice o£ lis
pendens is recorded.
sECTioN 3: Con£l icts. All ordinances or parts thereof
in conflict herewith, be and the same axe hereby repealed.
EECTZON 4: Eeverabil ity. Should any sectvon, paragraph,
clause, senten , tem, word, o _ vrsion of this ordinance
be declared invalid by a court of competent jurisdiction,
such decision shall not a££ect the validity o£ this Ordinance
as a whole or any part hereof, not so declared to be invalid.
