RP ST ORDA INEll HY THE CITY COM19n9I55ION OF THE CITY OP LONGIYOOD, FLORIDA AS FOLLOIVA: ~' SECTION I: The Purpose o£ this Ordinance is xo .set forth 1 regulations governing the _ rcha se and dis, ition of personal property made of PTec ions metals by dealers ~,ai th in the City of Longwood, Florida and shall he applied and enforced in hoth the unincorporated and incor- p aced areas of xhe City of Longwoo dd, Florida. SECTION Z: The definitions as used in this Ordinance, unless xhe context otheriaise requires, shall mean. Dealer. Any n son, firm ox corporation engaged in the business of Pur<has ing or selling at retail or wholesale or otherw.i se dealing in any old, used or second-hand precious metals of any ki nd or ~ description and in any Form, whether with a fixed place of bu.s mess ~ Prec.i ous metal: Gold, silver or platinum or any combin at.i on thereof whether in manufac tvred, alloyed or any other form. Bullion coins. Coins bought or sold for an amount equal xo or less than their intrinsic value. SP CTSON 3: Register of transactions. (a) Any person engaged in bus.i nes.s as a dealer shall keep a register in connection with his business, said register to he approved as to type and form by the Chic£ of Police of t.ongwood, ~,,, 1 ~, Florida, and at the trme of each transaction shall enter or cause to 1 be entered therein an accurnte description of the person £rom whom any article o_ son al Property made of Precious metal is purchased or rec evved, and shell include in the description, but not limited t , 2ho nem date of birth, s a place of res idenco and driver's license or, if no other government identification numbers of the person, together with an accurate description of any article of personal _roperty made o£ p crows metal s p rchased or re carved, which descrip- taon may cont am any mark, brand, monogram, hallmark, word or letters which may ba e o ved, stamped, etched or otherwise o manently marked upon the article. A copy of the register shall be retained for one (1) year from the date of the last transaction record- ed xhere in. (a) ExcepT fox the exempt transactions hereinafter _ vided, o a. titles of p sonal property made of precious metals nor bullion coins shall be sold, melted, altered, or otherwise disposed of by any dealer until ten (10) Days have elapsed from the time the Chief o£ Police o£ Longwood, Florida has had made mail able to him a copy or transcript of the register in which such artalles of personal properly made of precious metals are entered, xnd said articles shall not fie transferred from within the City o£ Longwood, Florida during said tan r ~ (10) day period of time. (b) The following xransa<taons shall be exempt from the provisions of Section G(a) of this Ordin an<e: (1) Bullion coins repurchased by a dealer, provided the dealer repurchases from the same person and maYntaa ns e record of the p or sale and the repurchase. (2] Transactions between dealers, provided the article has been registered in accordance with this Ordinance and in the possession of any local dealer for the period set forth rn Sacti on 4 (a) O£ this Ordinance. ~. SECTION 5: All dealers shall, not later than 5:00 P.Fi. of 1 each business day, make available to the Chief of Police of Longwood, Florida, or his r p sentative, a £ull and complete copy Or a transcript of the register in which is entered the transactions of the preceding business day as req ui rod by Sec Cion 3 of this Ord~in ante. All dealers shall, not later than 5:00 P.A1, o£ each Fr.i day, submit to xhe Chief of Police of Longwood, Flerida, or his repres eat at.i ve, a full and complete copy oz transcript of the register in which is entered the transactao ns of the preceding business iaeek required by Section 3 of this Ordinance, SECTION 6: It shall be unl aw f~l for any de ater To bwy, take, r rota ava by way of purchase or exchange, any ertr cl es made of precious ', o _ metals or bullion corns from a y person under the age o_ eighteen (18) 1 SE C'fION ]: A11 articles of personal Property made o£ precious metals purchased or race rued by dealers shall remain attachod to a copy o£ the bill of sale and be so arr gad in stock as to enable the stock to be inspected by the police Department of Longwood, Florida or any other p son wixh such authority during the period set Forth in Section 4(a) of this Ordi Hence. SECTION B: Any person, firm or corporation violating any provrsaon of this Ordinance shall, uP convactro be punished as provided in Section 125.69, Florida Statutes, as amended. SECTION 9: IC any Provision of this Ordinance or the aopi is ation thereof to any person or crrcumstance rs held invalid, rt as the an tent of the City Commission o£ the City of Longvood, Pl orida, that the invalidity shall not affect other Provisions or applications of the Ordinance which can be given effect without the invalid provision or aPPl is ation, and xo this end the Provisions of this Ordinance arc dacl ared severable. SECTION 30: It is the intent ron of the City Cammiss ion o£ r the City of Longwood, Florida that then rrsaons of this Ordinance 1 shall become and be made a part of the City of Longwood Code and the word "ordinance" may be changed to "section", "article", or other appr opri.ate word or Phrase and the se ct tuns of this Ordinance may be renumbered or relettered to accomplish such intent ro n; provided, how- ev that sections 8, 9, 10 and li shall not be codified.
