SECTION l:LICENSE BEOBI- ISSUED BY A. There is hereby Levied an occupational Sic ense tax in the amounts set out in this ordinance for the privilege of engaging in or managing any business, profession or occupation within the City limits on the following: (1) Any person who maintains a permanent business location or branch office within the City for the privilege of engaging in or managing any business within its jurisdiction; and (2) Any person who maintains a permanent business �- location or branch office within the City for the privilege of engaging in or managing any profession or occupation within its jurisdiction; and (3) Any person who does not qualify under the provisions of (1) or (2) above and who transacts any business or engages in any occupation or profession in interstate commerce where such license tax vs not prohibited by Section 8 of Article 1 of the United States Constitution. B. No person sha11 engage in or manage any business, occupation or profession for which there is an occupational license tax required by this Ordinance or any other ordinance of the City, unless such person shall first procure a license to conduct the same from the City Clerk. C. All licensos shall be signed by the City Clerk and shall be upon blanks furnished by the City council. SECTION 2: APPLICATION IN WRITING AFFIDAVIT AS TO BASIS OF LICENSE. No license shall De issued except upon written application of the person applying for the same, and it shall be _2_ the duty of the City Clerk before issuing a license based wholly employed, or any other contingency, to require the person applying fox such license to file with her an affidavit giving full and complete information thereof. The applications and affidavit required by this section sha11 be retained as a part of the records of the office of the City Clerk. A. All business licenses may be transferred to a new owner when there is a bona fide sale of the business upon paymen' If a transfer fee of Three Dollars ($3.00) and presentation of evidence of the sale and the original license. H. Upon written request and presentation of the original lvicens e, any license may be transferred from one locati to another location in the same municipality upon payment of a transfer fee of Three Dollars ($3.00). SECTION 4: LICENSE TAXES BASED ON NUMBER OF HOW COMPUTED. Whenever the amount of a license tax shall be based wholly or I. part on the basis of the number of persons employed the number to be used in calculating the amount of the license tax shall be the average number of persons employed during the preceding license year or business operating period, ox the number shall be the greater. The overage shall be obtained by adding the maximum and min amum number of persons for the period for which the average is to be obtained and the division by two If the sum of the maximum and the minimum. The term "persons I employed" includes all persons actively working in the business, whether owners thereof or not. �ECTION 5: EXEMPTIONS OF CERTAIN P ASONS FROM PAYMENT OF LICENSE TAX. A. Persons who have been residents of the State of Florida £or one yeas and who are widows with minor dependents, o over sixty-five (65) years Of age or confirmed cripples, or deaf and dumb, who employ not more than one employee or helper and who use their own capital only of not in excess of Five Hundred Dollars ($500.00), shall be allowed to engage in any business, occupation or profession without being required to pay a license tax, except that this exemption sha11 not apply to fortunetellers, as listed in Section I hereof. B. Any veteran of any war in which the United— armed forces participated wno has been a resident of the State of Florida for one year and who was honorably discharged from the services of the united States and who at the time of his appli- cation for license, shall have a rated -service connected dis- ability sha11, upon due proof o£ his qualifications for exemption, be granted a license to engage in any business, profession oz o cupation which may be Carried on mainly through the personal efforts of the licensee as a means of livelihood and for which the license tax does not exceed the sum of Fifty Dollars ($50.00) or sha11 be entitled to an exemption to the extent of Fifty Dollars ($50.00) on any license to engage in any business, pro- fession or occupation which may be carried on mainly through the personal efforts If the licensee as a mean., of livelihood when the el e license tax therefor shall be more than Fifty ➢ollars ($50.00). C. Nothing in this ordinance shall be construed to require a license for practicing the religious tenants of any church. SECTION 6: IONS; ➢NE ➢ATES: HAL YEAR LICENSES. No License shall be issued for longer than one year. All licenses shall expire on the thirtieth day of September and shall be payable on Or before the first day of October unless otherwise specifically provided by Law or as otherwise provided iv this Ordinance. Half year licenses may be issued by the City Clerk under the provisions of this Ordinance for the period April first to September thirtieth, upon payment of one-half (1/2) of the tax fixed as the amount of such license for one year; the license tax for all other businesses shall be one hundred percent (l OOA) of the yearly tax unless Otherwise provided in this ordinance. SECTION 7: LOCATION OF LICENSES PREMISES TRANSFER O LICENSE. Licenses shall be good only for the particular business and at III particular place of business which shall be named therein and for the person, firm or corporation to whom issued, but licenses may be transferred when there is a bona fide sale and transfer of the property used in the business, stock in trade, upon application to the City Cl—, and said transfer sha11 be written across the face of the original license; but this pro- vision for transfer of licenses shall not be applicable where the transfer is regulated by ordinance applicable to the particular business £or which transfer is sought. SECTION 8: COMPLIANCE W H OADIN CGS IiEOUI RED The issuance by the City Clerk and receipt by the applicant o£ such license shall in no case be deemed authority to conduct an occupation, business or profession in contravention o£ any ordinance or ordinances of the City now exasting or hereafter enacted, or to establish or maintain any nuvsance. SECTION 9: LICENSE TAX SCHEDULE. SECTION 11: AMOUNT OF TAX TO BE PACE. Licenses sha11 be issued to cover only one (1) of the ,eeuoations or business classifications hereinbef0re set out, unless otherwise permitted. The amounts assessed as license taxe against the various trades, businesses and professions are hereby fixed per aanum unless otherwise specified. SECTION 12: RCHANTS TO PAY MERCHANT'S TAX DNLESS SPECIFIC— CLASSIFIED. CPION — EEL INQUENCY PENALTY. A. Those licenses not renewed by October 1 shall be considered delinquent and subject to a delinquency penalty o£ tbO percent (—A) for the month of October, plus an additional 1 five percent (5%) penalty for each month of delinquency thexeaftet. until paid; provided that the total delinquency penalty shall no exceed twenty-five percent (25%) of the occsspational license £ee for the delinquent establishment. The time for assessment of penalties in this section shall be subject to the provisions of section 21 of this Ordinance. RIGHT TO HE UPON ➢EN SAL OF LICENSE: RENEWAL THEREOF. The City Council shall have the authority for just cau to direct the City Clerk not to issue or renew a license that may_ be applied £or, but the applicant for such license sha11 have the right to be heard before the City Council and show cause, if any, why such license should be issssed or renewed. CP ION 17, PROCEDURE F F LICENSE. (a) The City Council shall have the right £or just cause to revoke any license issued or renewed hereunder and may in its discretion order the refunding or any part or all of the moneys paid fox such license when the same is revoked, and any person conducting any occupation, business or profession after such revocation by the City Council sha11 be liable to the penalties as specified herein. (b) If the City Council desires to revoke any license issued hereunder, it shall cause the holder of the license to be served with written notice of its intention to do so, stating therein the cassse for the proposed revocation of such license, and It a time for a hearing on such proposed revocation. Each provision of this Ordinance contained herein and each license tax by this Ordinance imposed is intended to be s epaxate and independent, and said license taxes are intended to be construed distributively. If this Ordinance Or any provision hereof shall be held inapplicable to any person, group of persons, property, kind of property, crreumstances or set of circumstances, such holding shall not affect the applicability thereof to any other person, property or circumstances. SECTION 25; PRESERVATSON OF OTHER LICENSE ORDINANCES. Nothing herein contained shall be construed to repeal any separate ordinance or ordinances prescribing a license tax for a particular occupation, business or profession, and such separate effect; provided, however, this ordinance is not intended to repeal, amend or affect license taxes or licenses required by the City of Longwood, Flosi.da, in connec L>on with the sale o£ This Ordinance is adopted pursuant to the authority granted in Chapter 72-306, Laws of Florida, 1972. When this in the space herein provided that the same was adopted on first reading and insert the date of such adoption. Fallowing the adoption o£ this ordinance on second reading, the Clerk shall likewise indicate the date of its adoption upon second reading in the space herein also provided.
