CALL MEETING TO ORDER/ ROLL CALL: Special Magistrate Goodblatt called the meeting to order at 7:OOpm. 2. SPECIAL MAGISTRATES'S EXPLANTION OF PROCEEDINGS: n/a 3. APPROVAL OF THE MINUTES FROM THE OCTOBER 27, 2009 HEARING: Special Magistrate approved the Minutes from the October 27, 2009 Code .Enforcement Hearing. 4. REPORTS-CASE UPDATES: Code Enforcement Officer Howington provided updates on CEH case #06-05-551, Runge and CEH case #09-10-772, Clarendon Petroleum. Code Enforcement Officer Winters provided an update on CEH case for EE Builders. 5. UNFINISHED BUSINESS: None 6. OLD BUSINESS: None 7. NEW BUSINESS: Cmdr. Cohen introduced the new City Attorney, Gayle Owens. Brief recess to allow respondents time to appear. 8. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. CEB 01-26-10-1 . _ r 9. PUBLIC HEARINGS: D. CEH 10-01-777 CC, Chap. 38, Sec. 38-121 Trash, Debris & Junk and ~ CC, Chap. 86, Sec. 86-54 Inoperable Vehicle CLARA B. HOLCOMB HEIRS 764 Meadowlark Court Longwood, FL 32750 Code Enforcement Officer Winters introduced herself and presented her case. She gave testimony that a Notice of Violation was issued on 12/14/09 to comply by 1.2/21/09. Upon reinspection on 12/22/09, the property was not in compliance and a Notice of Non- compliance was issued to comply by 12/26/09. A reinspection on 01/05/10 showed the property still not in compliance and was then scheduled for the Code Enforcement Hearing. A Notice of Hearing was issued on 01/14/10 however Office Witt of the Longwood Police Dept was not able to obtain service. Therefore, the Notice of Hearing was mailed first class and posted at the property & City .Hall on 01 /15/10. Service was made .later that day on Brandon Holcomb (21yr old nephew) by Officer Baschab. A reinspection on 01/26/10 showed the Trash 8~ Debris had been removed and was in compliance however the Inoperable Vehicle was still present. The City requested that the Respondent be found guilty of violating CC, Chap. 86, Sec. 86-54 Inoperable Vehicle and that they be given 10 days upon service of Final Orders or a $100.00 per day fine be assessed. The City also requests an administrative fine of $350..00 be assessed to be paid within 30 days from date of service of Final Orders. Code Officer Winters answered questions posed by Special Magistrate Goodblatt. ~ No Respondent present at hearing but service was properly made. Special Magistrate Goodblatt made her findings of fact and found the respondent guilty of violating CC, Chap. 86, Sec. 86-54 Inoperable Vehicle and ordered they be given 10 days from date of service of Final Orders to come into compliance or a $100.00 per day fine will be imposed. She also assessed a $150.00 administrative cost to be paid within 30 days from service of the Final Orders. B. CEH 10-01-775 CC, Chap. 18, Sec. 18-221 Outdoor Storage MOORE, Timothy and WALKER, Angella . 790 Wildmere Avenue Longwood, FL 32750 Code Enforcement Officer Howington introduced herself and presented her case. She gave testimony that she noticed 2 large wooden boxes at the. property in October 2009. A Notice of Violation for CC, Chap. 18, Sec. 1.8-221 Outdoor Storage was issued on 12/07/09 to comply by 12/14/0.9. Upon reinspection on 1.2/15/09, the property was not in compliance and a Notice of Non-Compliance was issued to comply by 12/19/09. Reinspections were performed on 12/21/09, 12/28/09 and 01/05/10 showed the property still not in compliance and it was then scheduled for the Code Enforcement Hearing. A Notice of Hearing was issued on 01/14/10 and served on Julia Deitey (61yr old mother) at 4:39pm by Officer Arciola. ~ Also, a Notice of Hearing was mailed. on 01/14/10 to Timothy Moore and was signed for by~ Tara Moore on 01/15/10. A reinspection on 01/26/10 showed the property was still not in CEB 01-26-10 2 ~ compliance. The City requested that the Respondents be found guilty of violating CC, Chap. 18, Sec. 18-221 Outdoor Storage and that they be given 10 days upon service of Final Orders to comply or a $100..00 per day fine be imposed. The City also requests an administrative fine of $350.00 be assessed to be paid within 30 days from date of service of Final Orders. Code Officer Howington answered questions posed by Atty. Owens. No Respondent present at hearing but service was properly .made.. Special Magistrate Goodblatt made her findings of fact and found the respondents guilty of violating CC, Chap. 18, Sec. 18-221 Outdoor Storage and ordered they be given 10 days from date of service of Final Orders to come into compliance or a $100..00 per day fine joint & several wilt be imposed. She also assessed a $100.00 administrative cost to be paid within 30 days from service of the Final Orders. A. CEH 10-01-774 CC, Chap. 14, Sec. 14-5 Prohibited Animals and LDC, Art.. X, Sec. 10.1.0 Building Permit BARAGONA, Charles III 423 Overstreet Drive Longwood, FL 32750 The City withdrew this case as complied. C. CEH 10-01-776 LDC, Art.
