Resolution 10-1246RESOLUTION NO. 1.0-1246 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LONGWOOD, AMENDING ORDINANCE NO. 09-1912 WHICH PROVIDED FOR PEES FOR EMERGENCY MEDICAL SERVICES; PROVIDING THAT EMERGENCY MEDICAL SERVICES FOR TRANSPORT OF PATIENTS BY THE CITY SHALL BE UNDERTAKEN BY ADVANCED LIFE SUPPORT SERVICES (ALS) VEHICLES BY INCREASING SAID FEES; SETTING EMERGENCY MEDICAL SERVICE AND TRANSPORT FEES FOR LONGWOOD CITY RESIDENTS; CONTAINING PROVISIONS WITH REGARD TO PROVISION OF SAID SEVERABILITY CLAUSE; CONTAINING AN EFFECTIVE DATE WHEREAS, City Ordinance No. 09-1912 provides that rates for medical transport services shall be established by resolution; and WHEREAS, the City Commission of the City of Longwood, Florida believes that the health, safety and welfare of the citizens of the City would be best protected if it assures that all rescue units providing life support services are able to provide a sufficient level of emergency care; and WHEREAS, this level of care can only be provided by a rescue unit which meets the minimum requirements for providing advanced life support (ALS) service; and WHEREAS, the City Commission of the City of Longwood, Florida deems it necessary to update its medical transport service fee schedule. WHEREAS, this fee schedule increase will provide for the necessary, funding to support an appropriate inedical transport service operated by the City of Longwood; and WHEREAS, the City of Longwood has previously adopted rates for said services pursuant to Ordinance No. , and wishes to revise said rates herein to reflect current costs; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF LONGWOOD, FLORIDA: SECTION I. That the City Conunission of the City of Longwood hereby establishes medical transport service fees, including mileage charges, for Basic Life Support (BLS) and Advanced Life Support (ALS) medical transportation, in furtherance of City Ordinance No. 09-1912 and City Code Section 2-423, Paragraph 4 Sub -section. A- F, Administrative Service Fees (Fire Service). BLS Service: $1,000.00 ALS Level I Non -Specialized Services rendered: $1,000.00 ALS Level II Specialized Services rendered: $1,000.00 Transport Mileage/Per Loaded Mile: $ 15.00 SECTION II. Fees for BLS service, ALS I non -specialized services rendered, ALS II specialized services rendered and transport mileage per loaded mile will be adjusted annually, each January for adjustment in accordance with the Consumer Price Index (CPI). All adjustments will be positive in nature. Should the CP:[ show a reduction, the EMS transport fees (all inclusive) will remain at the previous year's rate until; the next adjustment period. SECTION III. (a) Not withstanding the rates set forth in Section. 1 of this resolution, the City of Longwood shall neither charge nor collect from, any resident of the City of Longwood who receives emergency medical services and transportation from the city or any of its agencies; shall owe to the city, or any of its agencies, any amount beyond the amount payable by resident' health insurance, health maintenance organization or other third party payor for such emergency medical services and transportation; provided; to the extent he or she is eligible to have benefit payments or reimbursements made on his or her behalf by any health insurer, health maintenance organization or other third party payor to pay the cost of his or her emergency medical services and transportation. (b) Each such resident shall provide the city or any of its agencies with those items of information reasonably necessary to submit a claim for payment or bill for reimbursement for the emergency medical services and transportation rendered to hire or her to his or her health insurer, health maintenance organization or other third party payor; provided, further, in the event a resident fails or refuses to provide such information, he or she shall be held financially liable by the city or any of its agencies for the full rates adopted for those emergency medical services and transportation otherwise payable or reimbursable by his or her health insurer, health maintenance organization or other third party payor. (c) Residents covered by Medicare or Medicaid shall be billed for the current acceptable allowance and shall provide the city or any of its agencies with those items of infonnation reasonably necessary to submit a claim for payment or bill for reimbursement for the emergency medical services and transportation rendered to hum or her to his or her health insurer, health maintenance organization or other third party payor. Further, in the event a resident fails or refuses to provide such information, he or she shall be held financially liable by the city or any of its agencies for the full rates adopted for those emergency medical services and transportation otherwise payable or reimbursable by his or her health insurer, health maintenance organization or other third party. SECTION IV. Should any part of this resolution be declared unenforceable in a court of law that shall not affect the remainder hereof which shall still remain in full force and effect. SECTION V. All Resolutions or parts thereof in conflict herewith, be and the same are hereby repealed. SECTION VI. Should a court of competent jurisdiction declare any section, paragraph, clause, sentence, item, word, or provision of this resolution invalid, such decision shall not affect the validity of this resolution as a whole or any part hereof, not so declared to be invalid. SECTION VIL This resolution becomes effective upon adoption.
