Ordinance 10-1939 ORDINANCE NO. 10 -1939 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, ANNEXING AND AMENDING THE OFFICIAL BOUNDARIES OF THE CITY CORPORATE LIMITS APPROXIMATELY 150,281 SQ. FT. (3.45 ACRES) +1- FOR PARCEL NUMBERS 04- 21-30- 300 -002A -0000, 26- 20- 30- 5AR- OD00 -058E, and 26-20-30 - 5AR-OD00-058D PURSUANT TO THE REQUIREMENTS OF CHAPTER 171.042, FLORIDA STATUTES; AND PROVIDING FOR THE SUBJECT PROPERTY TO BE SUBJECT TO TAXATION AND REGULATION BY THE CITY EXCEPT LAND DEVELOPMENT AND BUILDING CODES UNTIL THE CITY'S COMPREHENSIVE PLAN IS AMENDED PURSUANT TO THE REQUIREMENTS OF CHAPTER 163.3184 AND 163.3187, FLORIDA STATUTES; PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, the owner(s) of certain lands more particularly described herein below, have requested that the same be annexed and incorporated into the corporate limits of the City of Longwood, Florida. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: Section 1. The lands described (Tax Parcel I.D. #04- 21 -30- 300 -002A -0000, 26- 20-30-5AR-OD00-058E, and 26- 20- 30- 5AR- OD00 -058D) and shown on the map in Exhibit A, attached hereto, be and the same are hereby annexed to and included within the corporate limits of the City of Longwood, Florida. Section 2. The Corporate limits of the City of Longwood, Florida, be and the same are hereby revised to include the land described in Section 1 hereof. Section 3. The City Commission of the City of Longwood, Florida does hereby find that the lands described in Section 1 are contiguous to the corporate limits of the City of Longwood, Florida, that said lands meet the criteria established by Chapter 171, Florida Statutes, that said lands should be annexed, and hereby consent to the annexation. Section 4. Upon annexation, the lands described in Section 1 shall retain a land use designation established by the Seminole County Zoning Ordinance and Comprehensive Land Use Plan until otherwise changed or amended by appropriate ordinance of the City of Longwood, Florida. Effective as provided by law, all real property lying within the boundaries of the corporate limits of the City of Longwood, Florida, as hereby revised, shall be assessed for payment of municipal ad valorem taxes. Section 6. All persons who have been lawfully engaged in any occupation, business, trade or profession within the area described in Section 1 above, upon the effective date of this Ordinance under a valid license or permit therefore issued by Seminole County, Florida, shall have right to continue such occupation, business, trade or profession within the entire corporate limits of the City of Longwood, as revised, upon the securing of a valid occupational license from the City of Longwood, which license shall be issued upon payment of the appropriate fee therefore. Section 7. The City Clerk is hereby directed to file a certified copy of this ordinance with the Office of the Secretary of the State of Florida, the Office of the Governor of the State of Florida, the Clerk of Court of Seminole County, Property Appraiser and the Seminole County Tax Collector, within 7 days from the effective date of the ordinance. The City Clerk and City Staff are hereby directed to waive the $300 voluntary annexation fee, the $800 small scale comprehensive plan amendment fee and the $800 Longwood Design Guidebook map amendment fee. Section 8 Conflicts. All Ordinances or parts of Ordinances in conflict with any of the provisions of this Ordinance are hereby repealed. Section 9 Severability. If any section or portion of a Section of this Ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any other Section or part of this Ordinance. Section 10 Effective Date. This Ordinance shall become effective ten days after its passage and adoption. Ord.
