Ordinance 10-1940 ORDINANCE NO. 10 -1940 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COMPREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; SAID SMALL SCALE PLAN AMENDMENT (SPA 04 -10) CHANGING THE LAND USE DESIGNATION ON THE FUTURE LAND USE MAP OF THE COMPREHENSIVE PLAN FROM COUNTY MIXED DEVELOPMENT TO CITY INFILL AND MIXED USE CATEGORY AND ASSIGNING THE EAST END PLANNING DISTRICT FOR THE PROPERTIES WITH THE PARCEL ID 04- 21 -30- 300 -002A -0000, 26- 20- 30- 5AR- OD00 -058E and 26-20-30- 5AR -OD00- 058D PROVIDING FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J -5 Florida Administrative Code; and WHEREAS, on November 19, 1993 the Florida Department of Community Affairs determined the City's Comprehensive Plan was in compliance with the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J -5, Florida Administrative Code; and WHEREAS, Chapter 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on September 8, 2010 to consider the Small Scale Plan Amendment request; and recommended the proposed Small Scale Plan Amendment (SPA 04- 10) be approved by the City Commission; and WHEREAS, the City Commission held a public hearing September 27, 2010 and again on October 18, 2010 pursuant to the requirements of Chapter 163.3187, FS. BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1: The following portions of the Future Land Use Map of the Comprehensive Plan are hereby amended to change the land use designation of the property described as: 425 S HWY 17 -92 Property ID #: 04- 21 -30- 300 -002A -0000, 26- 20- 30- 5AR- OD00 -058E, and 26- 20- 30 -5AR- OD00-058D as depicted in EXHIBIT A, from COUNTY MIXED DEVELOPMENT TO INFILL AND MIXED USE (EMU) category; attached hereto as though fully contained herein. SECTION 2: The following portions of the Longwood Planning District Map of the Longwood Design Guidebook are hereby amended to assign a planning district to the property described as: 425 S HWY 17 -92 Property ID #: 04- 21 -30- 300 -002A -0000, 26- 20- 30- 5AR- OD00 -058E, and 26- 20- 30 -5AR- OD00-058D as depicted in EXHIBIT A, to EAST END PLANNING DISTRICT; attached hereto as though fully contained here in. SECTION 3: Pursuant to the requirements of Chapter 163.3187 (3) (c), Florida Statutes, this Ordinance shall not take effect until thirty -one (31) days after City Commission adoption and after the annexation of said property (ANX 04 -10) is effective, unless a challenge has been filed within 30 days from adoption. If timely challenged, this Ordinance shall not become effective until it is found in compliance as provided in section 163.3187 (3) (c), Florida Statutes. SECTION 4: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this Ordinance. SECTION 5: If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. FIRST READING this 2.4 day of , A.D. 2010.
