SINCE 1883 } 1 � r �-� - t May 13, 1982 The Codes Enforcement Board of the City of Longwood, Florida met at 7:30 p . m. in a Special Meeting Present: William Mitchell Virgil Pavone Arthur Carullo Richard wal l sh B. H. Farrell -- First Alternate Linda tike - Second Alternate Marvin Rooks, City Attorney Donald Terry, City Clerk Absent: Raymond Downed 1. Mr. mall sh called the meeting to order. 2. The Secretary called the roll. All hers were present incl g two new members except Mr. Rand Downen, The Clerk said he had been # able to reach Mr. Downen since he has an unlisted telephone number. Mr. wallsh stated that NJ:. Downen would be credited with an excused absence. 3. Minutes of 4-27/82. Notion by Mr, Mitchell, seconded by Mr Pavane that minutes of 4/27/82 be approved as submitted. 4. Mr. Wal l sh stated that no pub 1 is hearings were scheduled and there was no urnf finished business . 5, Presentation of Filed Affidavits of Violations. The Secretary presented Case No, 8 in case of Gerald F. Wright, H. Hannelore , Linda Lee Ivey and Fred Petterson for Violation of Ordirmce No. 495 - Comprehensive Zoning ordinance. The Board reviewed the documents stetted. Mr. Rooks said that ordinance No. 495 is not listed on the Codes Enforcement Board Ordinance but is a revision of ordinance No. 143 which is listed. He said he did not believe there was any problen with listing this ordinance since ordinance No, 495 -- Zoning ordinance was a revision of 143 which was also the Zoning Ordinance. Mr. Carullo questioned why tickets were not being issued if the violations continued. Mr . _said not on private property, and Mr Rooks said it w as not a ticketable off e . Motion by Mr Pavone , seconded by Mr. Carullo that probable cause exists and that a hea be held. Notion. was passed by a unanimous roll call vote* The Secretary read Case No. 9 in -case of Leslie and Sharon Bennett (Owners of Record) and Mr. and Mr Dan Barker ( ten of 1187 Second Place, Longwood, for Violation of Ordinance No. 495 - CorrPrehensive Zoning ordinance. The Board reviewed the documents submitted. Mr. Rooks said his previous c nents concerning ordinance No. 495 were applicable in this case also. 0 Nw%k, Mr. Wallsh stated that he had a problem with the affidavit since it was issued prior to the expiration of a temporary permit for Mr. Fred Petterson . Mr. Mitchell stated that he thought it was necessary to cancel the temporary permit in writing. Mr. Rooks said it was not a valid permit. The Secretary stated that the permit had been cancelled at the City Cormtis s ion Special Meeting on April 38, 1982 and that Mr. Petterson had voluntarily surrendered the permit at the regular commission meeting on April 26, 1982. Mr. Nallsh su&gested that it was not proper for the Secretary to also present the case for the City and asked that the City have another representative, such as the Police officer present to present the case. After further discussion, Mr. Wallsh asked the m Tbers to vote on the sufficiency of the affidavit. It was the unanimous decision of the codes Enforcement Board that the Affidavit was insufficient. Mr. Wallsh stated that Case No. 9 mould be dismissed for lack of a sufficient affidavit. Mr. Wal 1 sh suggested that a pub 1 is hearing be scheduled for Monday, June 22, 1982 for Case No. 8 so people would have an opportunity to cool down. 6.
