Meeting called to order by Mr. Wallsh followed by pledge of allegiance to United States flag. 2. The secretary called the roll. All members were present except Arthur Carullo. Mr, Wallsh stated that Mr. Carullo' s absence would be unexcused unless he presents a reason satisfactory to the board. 3. Approval of Minutes. Moti by Mr Pavone , seconded by Mr. Mitchell that minutes be read. The secretary read the minutes of 8-24-82. I btion made by Mr. Mitchell and seconded by Mr. P avore that minutes of 8-24-82 be approved as read. 4. Public Hearing. Case No. 14: In case of Dcminick F, Sass., 803 Church Street ■ charged with violation of Ordinance No. 207. Mr . Wallsh asked if city had a representative pre and if Mr Sass was pre sent . Officer Grose was present to represent the city and Mr . Sass was present, Mr. Wallsh asked Mr. Sass to listen to Mr. Terry, Mr. Terry read the violation. Mr. Wallsh wanted to }snow if Mr . Sass wanted to contest the charge. Mr. Sass stated that he would have his property cleaned when he received his check the third of next month. officer Grose submitted photographs of August 24 , 1-982. of f icer Grose said that on the 29th of June , he issued a warnin advising Mr Sass that the prcpe rty was in violation of the City of Lon g wood Ordinance No. 207, that the excessive amount of trash debris and a wooden boat must be removed from the property. Due to the amount of trash and the s i ze of the boat, Mr Sass w as given a thirty day notice instead of the s tan dard ten day notice. The correction date was set at July 29, 1982. On August 17, 1982, a inspection of the property revealed that the boat was removed but the trash debris remain in a condition which indicated that there had been no attenpt to correct the violation, on August 24, 19 8 2 , off idavit submitted to the Code Enforcement Board. Mrs, Zike asked if lawn had been m7wed. Officer Grose stated that neighbor had mowed the yard. Mr. Kennedy suggested that -the board give Mr Sass until the 12th of October to clean up his property. Mr. Mitchell asked "if two truck loads had been taken off the property already. Grose said yes, that- he had tried to work with Mr. Sass but has done all he could do. Mr. Sass stated that when his ANN Page 2 Codes Enforcement Board Minutes- 9/14/82 check comes on the 3rd of next month he will have property cleaned up, Mr. Rooks asked officer Grose what kind of trash remained on property. officer Grose said there were 1 imbs , beer cans and trash. There was no further questions. Mr. Wallsh asked that a roll call vote be held to determine whether there was a violation of Ordinance No. 207,with a Yes vote being a vote for violation and a No vote being against violation. Roll call vote was as follows: Mr. Mitchell, Yes Mr. Wallsh, Yes; Mr. Pavone, Yes; Mr, Dmmen , Yes; Mrs. Zike , Yes and Mr. Kennedy, Yes. The board found the property in violation by a unanimous vote. Mr. Sass stated that he could not clean up the property until he receives his money after the 3rd of the month, Mr. Mitchell stated that progress has been node and Mr, Sass should be given until 12th of October to clean. up property. Discussion on the amount of the fine . Mrs. Zike stated the f ine should be as small as possible since Mr. Sass is on a fixed inccrr e and suggested $10,00. Mr. Pavone and Mr. Mitchell stated they thought the fine should be $ 2 0.0 0 to $ 2 5.0 0 . • officer Grose stated that it should be $20.00 to $25.00 per day since Mr. Sass had already received several checks and had not cleaned the property. Mr. Wallsh motioned and Mr. Pavone seconded that there be a roll call vote for $10.00 a day fine, Roll call vote was as follows: Mr. Mitchell, Yes; Mr. Wallsh, No; Mr. Pavone, No; Mr, Downen, Yes; Mrs. Z ike , Yes and Mr. Kennedy, Yes. Nbtion carried by a voice vote with fine to begin on October 13, 1982 if property not in compliance. Mr. Wallsh stated to Mr. Sass that officer Grose would be checking the property on the 12th of October to make sure Air. Sass was in ccopliance and there would be a fine of $10.0 0 a day if he was not in com1pliance . 14r. Rooks asked Mr. Sass how old he was? Mr. Sass replied 75 years old. Mr. Rooks asked Mr. Sass how he arrived at City Hall and he replied a friend dropped him off. Mr. Rooks asked Mr. Sass if he knew why he was here? Mr. Sass rep lied that it was because he had trash on his property. Mr. looks asked rIr. . Sass what his daughter's name was? YIr. Sass replied it was Sally and that she lived in California. Mr. Rooks asked Mr. Sass if he had any other relatives that live in Florida? Mr. Sass replied, he had a brother and his name was valentine Sass. Mr. Rooks asked Mr. Sass if he knew that he was in violation of City ordinance and how long he had to remove the trash? Mr. Sass replied, no. Mr. Rooks stated that officer Grose will make a report and that Mr, Sass will be fined $10.00 a day until property, 'is cleaned up. Mr. Mitchell asked Mr. Sass for brother ' s address and Mr. Sass said that he lived on Church Avenue. Mr. Rooks asked the secretary to note in the record that Dcminick Sass is sufficiently competent to understand the nature of the offense, the nature of the hearing, the deadline for comliance set by the board, but not the consequences should he f ai 1 to cmply , with this order of the board. Mr. Rooks asked for name of person 11r. Sass is going to hire to clean up the property. Mr, Sass replied Burgess. 14r. Pavone asked if this was Larry Burgess, Mr. Wallsh asked Mr. Grose to remind Mr. Sass on October 4, 1982 to have the property c leaned . Mr. Mitchell asked to have his brother notified. Mr. Rooks suggested that they contact Mr. Sass's relatives and asked for daughter's telephone number. Mr. Rooks asked Mr, Sass to contact Mr, Terry or himself with daughter's telephone number. Mr. Rooks stated that himself or Mr, Terry to contact brother or daughter. Mr. Rooks concern is that Mr. Sass understand. Officer Grose asked if Public T,brks Department could go on the property and clean it up. -Mr. Rooks said he would check. 5. Unfinished Business-None 6. Wallsh stated that several of the board members terms of off ice had expired. The City conmi s s ion reappointed Mr. Downen and -Mr. Kennedy. Mrs. Z ike will be contacted by Commission O'Leary concerning her reappo intment . Fred Ritter was appointed to take Mr. Wallsh's place, New ordinance No. 558 passed on Septertber 13, 1982 to comply with changes in the State Statute. Mr, Wallsh stated that the rules need to be up -dated and adopted. 14r. Wa l l sh stated October election will be held for Chairman n and Vice - chairman . Mr. Kennedy made a motion , seconded by Mr. I- iitche 11 that the next meeting be held on October 12, 1982. Motion passed by a voice vote. 14r. Wallsh asked that minutes reflect appreciation to 14r.
