Meeting called to order by Chairman Pavane followed by Pledge of Allegiance to United States flag. 2. The secretary called the roll, all members were present except William Mitchell and Charles Kennedy, 3. Approval of Minutes. The secretary read the minutes of October 12, 1982. Motion by Mr. Carullo, seconded by Mr. Ritter that minutes of October 12, 1982 be approved as read. Motion carried by a voice vote. 4. Public Hearings. None Scheduled. 5. Unfinished Business. None-, 6. Presentation of Filed Affidavits of Violations. The secretary read an Affidavit of Violation in the case of Country Club Kennel/ Dobmeier, , Ken (owner) for violation of Ch. 11 & 12, City Code. off icer Grose stated he brought this case before the board for them to make a decision on whether there was a problem. officer Grose briefed the Board on the case and presented two police reports of barking dogs, a petition by Mr. Lewis and Mrs. Hudak with 180 signatures from citizens of Longwood and photographs of Country Club Pet World. The Board re- viewed the material and Chairman Pavone stated that the purpose of the meeting was to decide if there was probable cause. Mr. Rooks stated that the business is legally established. Mr. Rooks stated that he is the legal advisor for the Board. Mr. Rooks referred to a previous court case stating that it does not matter if the business was there first, the issue is the undue noise. He stated that conditions change and the solution was to abate the noise. JOP 4 2 Codes Enforcement Bc. d Minutes- November 23, 19 Mr. Carullo questioned Officer Grose on different complaints concerning differing times of the barking dogs. officer Grose gave the addresses of the complainants and the times. Mr. Ritter asked if there were more complaints on holidays and weekends? officer Grose stated that there was not any specific date or time. Mr. Carullo asked that letter from Ken Dobmeier to Officer Grose be read. Secretary read the letter of July 27, 1982 concerning Mr. Dobmeier's effort to cooperate. Chairman Pavone asked for a vote tC Mrs. Zike -Yes, Mr. Carullo -No, Mr. himself, and Chairman Pavone-Yes. a vote of three to one. Mr. Rooks does not mean there is a violation. see if there was probable cause. Ritter-Yes, Mr. Downen- disqualified The Board found probable cause with stated that finding probable cause Officer Grose stated that he was not knowledgeable enough to know what to tell the man to solve the problem. Mr. Rooks asked Mr. Dobmeier if he would work with Commissioner Uskert, himself, and Mr. Lewis toward solving the problem; Mr. Dobmeier was in agreement. Motion made by Mr. Carullo seconded by Mrs. tike that Mr. Dobmeier, Mr. Rooks, Com- missioner Uskert and Mr. Lewis work toward solving the problem. Motion by Mr. Carullo, seconded by Mrs. Zike that an emergency hearing be held three weeks from date of this meeting. Motion was passed by a unanimous roll call vote. Meeting was scheduled for December 14, 19820 7. New Business. None. 8. Adjournment. Motion by Mr. Carullo, seconded by Mr. Ritter that meeting be adjourned. Motion passed by a voice vote.
