The Codes Enforcement Board of the Ci ty of Longwood,
at 7:30 P. M.

1. The meeting was called to order by Chairman Fleck followed by
the Pledge of Allegiance to the United States Flag, The
secretary called the roll and all members were present except Mr.
Helms. Mr. Helms had notified Chairman Fleck that he was ill and
unable to attend the meeting.
2. Approval of Minutes -- 1/8/85. Motion by Mrs. Sikora,
seconded by Mr. Ritter to approve minutes of January 8, 1985 as
submitted. Motion carried by a unanimous voice vote.
3. Public Hearing, Case No. 32, Daniel L. & Sharon Peterson,
745 Pasadena Avenue, Longwood ■ FL, Violation of Chapter 11, Sec.
11-2(5) and Chapter 4, Sec. 4--15 ( Seminole County Animal Control
Ordinance No. 74-8). The secretary read the violation. Chairman
Fleck asked the respondent if he wished to contest the charges.
Mr, Bob Kieffer stated that he was the attorney for Mr, & Mrs.
Peterson and was present to answer charges. Mrs. Sikora stated
that in order for the board to follow its rules and regulations,
the City shall present its case first. officer Rossi was sworn
under oath and presented the case. officer Rossi presented
Exhibit A, copies of complaints and incident reports, Exhibit B,
patrol special detail reports, and Exhibit C, interviews of
surrounding neighbors. officer Rossi stated that 18 dispatched
calls had been made and that only two calls had been
substantiated and a special detail had spend 6 1/2 hours
listening for the dog to bark and heard the dog bark once. He
stated this was a dispute between the neighbors. officer Rossi
stated that he can neither prove or disprove the charge.

Chairman Fleck stated that he understood that Officer Rossi state
there was no charges. Officer Rossi stated that he did not hear
the dog barking so he stated that there were no charges.
Chairman Fleck asked officer Rossi if he had checked with the
neighbors. officer Rossi stated that he had checked with
eighteen neighbors. Mrs. Sikora asked if the sound of the dog
was frequent or loud continued noise. Officer Rossi stated that
Officer Leonard said the dog yipped, Mrs. Sikora asked if this
was a public or private nuisance. officer Rossi stated it was a
private nuisance between neighbors. Mrs. Sikora stated that this
was a private nuisance between neighbors which could be pursued
in court as a civil matter so some relief is available. Mr. Bob
Keeif er stated the burden was on the City of Longwood to
establish proof that his clients were in violation. Mr. Reeif er
stated that this matter was not beween Mrs. Ryan and Mr. Peterson
and it was a matter for the civil court. Mr. Keeif er stated this
was City of Longwood versus Mr. Peterson and the burden was on
the City of Longwood to establish proof that his clients were in
violation. Mr. Keeifer asked that the board dismiss the charges
pending against his clients at this time. Motion by Mr. Kennedy,
seconded by Mr. Ritter to dismiss charges due to the evidence
that has been presented. Motion carried by a unanimous roll call
vote.
4. Unfinished Business. Chairman Fleck stated that a letter had
been given to the City Commission requesting that the probable
cause hearing be abolished and that the first step was being
taken to abolish the probable cause hearing.
5. Presentation of Filed Affidavits of Violations.
None Submitted.
6. New Business, Mr. Taddeo asked the four members of the City
Commission if Mr. Pratt had paid his fine. Mrs. Sikora suggested
that the board ask the secretary to find out if the fine has been
paid and if not whether a lien has been filed on his property and
to make a report to the board at the next meeting.
7. Adjournment. Motion by Mr. Taddeo, seconded by Mrs. Sikora
to adjourn. Motion carried by a unanimous voice vote. Meeting
adjourned at 8:05 P.M.
