The Codes Enforcement Board of the City of Longwood,
at 7:30 P.M.

1. The meeting was called to order by Chairman Fleck followed
by the Pledge of Allegiance to the United States Flag. The
secretary called the roll and all members were present except Mr.
Ritter and Mr. Faulkner, Mr, Ritter had notified the secretary
that he would be out of town and unable to attend the meeting.
2. Approval of Minutes - 6/4/85 and 6/11/85. Motion by Ms.
Sikora, seconded by Mrs. Martin to approve minutes of June 4,
1985 and June 11 1985 as submitted. Motion carried by a
unanimous voice vote.
3. Public Hearings.
Case No, 34 Frank J. & June J. Sobotka, DBA JCL Land Clearing,
Inc., 268 Park Avenue, Longwood, FL. Violation of Appendix A.
Section 620.2C. Ms, Sikora asked if Mr. and Mrs. Sobotka were
notified of the hearing and Mr. Gougelman stated that they had
been notified on July 30, 1985. Officer Rossi was sworn under
oath. Officer Rossi stated that no action was taken to install a
fence and that a variance had not been requested by August 5,
1985. Motion by Ms, Sikora seconded by Mr. Heffner to fine the
respondents $25.00 per day until in compliance and if the fine is
not paid on or before August 20, 1985, a lien is to be placed on
the property. Motion carried by a unanimous roll call vote.
4. Unfinished Business.
Case No. 33, Eugene J. Kocol DBA Paramont Auto Center, 619 N. CR
427, Longwood, FL and Wells, Gatt is , Hal lowes & Carpenter, 130
Hillcrest St . ■ Orlando, FL ( owners of the property) . Violation
of Chapter 10, Sec. 10 -1 10- B(14 )6 Appendix A. Secs. 201.1 and
508.4A. Secretary read the violation. Officer Rossi stated that

Mr. Kocol was now in compliance. Mr. Gougelman stated that
final disposition was to send Mr. Kocol a letter notifying him of
the fine that the board had imposed. Mr. Gougelman stated that
for the order to be legal that it needed to pass by a vote of at
least four members. Motion by Ms. Sikora, seconded by Mrs.
Martin to rescind the fine due to possible legal errors. Motion
carried by unanimous roll call. vote.
5, Presentation of Filed Affidavits of Violations, None filed.
6, New Business. Memorandum from chief of Police dated June 4
1985. Ms. Sikora stated that she agreed with the memorandum and
had made recommendations previously to the attorney. Ms. Sikora
stated that additional changes had been made by new legislation
and there was a need to eliminate the probable cause hearing.
Mr. Gougelman stated that the city Code conflicts with the state
law. Mr, Gougelman stated that his legal advice is for the board
to officially communicate to the City commission that the City
Code needs to be changed. Ms. Sikora stated that the code needed
to be revised before action was taken on the memo. Motion by Ms.
Sikora, seconded by Mrs. Martin that the Codes Enforcement Board
recommend to the City Commission that City code pertaining to
code enforcement be amended to be consistent with the state
statutes and to eliminate the probable cause hearing. Motion
carried by a unanimous roll call vote.,
7. Adjournment. Motion by Ms. Sikora, seconded by Mr. Taddeo to
adjourn meeting. Motion carried by unanimous voice vote.
