The Code Enforcement Board of the City of Longwood, Florida met
at 7:30 P. M. on December 4, 19860

1. The meeting was called to order by Chairwoman Sikora. The
Secretary called the roll and all members were present.
2. Approval of Minutes - 11/11/86: Motion by Mr. Delaney,
seconded by Mrs. Corbin to approve minutes of November 11, 1986
as submitted. Motion carried by a voice vote.

The Secretary stated that the following cases were in compliance
with the City Code before the Hearing was convened:

The Secretary informed the Board that the Return Receipt for the
Notice of Hearing had not been received. Chairman Sikora
4 suggested the case be continued until next meeting and that
further attempts be made to serve Mr. Latorre.

Motion by Mr. Heffner, seconded by Mr. Delaney to continue case
86 -59 until next scheduled meeting date. Motion carried by
unanimous roll call vote.
4. Public Hearings,
A. Initial Hearings:
1. CEB 86 --55, WATSON, Cary
241 S. Lakeview Drive, Longwod
Violation of Chapter 12, Section 12 -2
Code Inspector Peter Butt, stated his qualifications and was
sworn under oath. Mr, Butt stated the violation and presented
the case. He stated that six complaints had been received from
residents, in nearby areas, regarding the overgrown grass and
growth of vegetation around the premises. Mr. Butt stated that
the copy of the deed in the f it e showed the owner of record to
be Cary Watson. Mr . Butt presented pictures and copies of the
complaints to the Board. He stated that he had spoke to Mr .
Watson twice and and was told that Mr. Watson came into
possession of the property through foreclosure. Mr. Butt
recommended that Mr. Watson be given until December 9, 1986 to
correct the violation, if no compliance, then be assessed a f ine
of $50.00 a day. Mr. Delaney questioned the occupancy of the
house. Mr. Butt responded that the house was vacant.
Mr. Watson stated his case. He explained that he contracted
some work on the property f rom Mr, Peter Clark, Freedom
Development, Corp. two years ago and have yet to be paid. He
stated that he went through the Florida Lien Law to foreclose on
the property to try to get the money owned to him. Mr. Watson
stated that there was alot of money owed on the property and
since he had lost over $5,000.00 himself, he said he does not
feel that he should do anything else to the property. He also
stated that he had deed at the Courthouse but the mortgage was
still held by Freedom Development corporation.
Ms. Colby arrived at 7:40 P. M.
Chairwoman Sikora asked if the actual foreclosure action had
been filed by the Mortgage Company. Mr. Watson replied no. Mr.
Delaney asked if the lot had ever been cleared. Mr. Butt
responded that it had, chairman Sikora asked the City Attorney
who had the legal responsibility if the property would go into
foreclosure. Ms, Colby stated that there was no evidence that
the property was in foreclosure and until the title was
transferred, the property remained Mr, Watson's responsibility.
Motion by Mr. Heffner, seconded by Mr. Delaney to find the
Respondent in violation of Chapter 12, Section 12 -2, and to set
a compliance date of December 9 ■ 1986. If there is no
compliance with Board's Order by or before that date, a fine of
$50.00 per day will be imposed for each and every day violation

continues past December 9, 1986. Motion carried by a roll call
vote.
2. CEB 86 -57, DUDLEY, FRED
638 N. Credo St. , Longwood
Violation of Chapter 12, Section 12-2.
Chairman Sikora stated the Code Inspector remained under oath.
Mr. Butt presented the case and stated that neither Mr. Fred
or Estelle Dudley were present. He stated that the property was
going through foreclosure handled by Essex Mortgage Company. Mr.
Butt informed the Board that Mr, Shoope of Essex Mortgage
Company had been contracted and Mr . Shoope said as soon as
title /deed was transferred to Essex he would correct the
violation. Mr. Butt presented pictures of the property and
recommended to grant the Respondent until December 16, 1986 to
comply ■ if no compliance, then be assessed a fine of $50-00 per
day .
Chairman Sikora asked if the foreclosure complaint had already
been filed and was an active case. The Secretary stated that
she spoke with Mr. Shoope of Essex Mortgage Company and the
property was in foreclosure and that Mr. Shoope would try to
expedite the transfer of title /deed so the problem could be
corrected as soon as possible.
Mr. Butt read aloud a letter f ram Mrs. Dudley to the Code
Enforcement Board dated November 24, 1986, which stated that
Essex Mortgage Company of Virginia Beach, Virgina should have
taken over responsibility of the property through a Bankruptcy
Hearing. He said Mrs. Dudley also wrote that her current
address was 500 Camp Gettysburg Road, Gettysburg, Pa. 17325,
Mr. Butt stated that the property had been vacant and the water
had been shut off since February 10, 198610
Ms. Colby explained that this case differed from the previous
case heard in that the foreclosure was in progress and she
suggested that Mr. Shoope be contacted to get an estimated time
when the title would be transferred. Discussion regarding the
cost of filing liens. Discussion regarding the Code Inspector's
recommendation.
Motion by Mr. Del aney, , seconded by Mr. Faulkner to continue
this case at the next scheduled meeting in January. Motion
carried by unanimous roll call Grote.

a recommendation to the City Administrator*

7. Next Meeting Date:
Chairman Sikora Stated that the next meeting will be held on
Tuesday, January 27, 1907.
8. Adjournment:
Motion by Mr. Delaney, seconded by Mr. Heffner to adjourn
meeting. Motion carried by unanimous voice vote. Meeting
adjourned at 8:37 P. M.
