CEB_08-25-87_MinApk August 25, 1987 PO* O pIk The Code Enforcement Board of the City of Longwood, Florida met at 7:30 P.M, on August 25, 19870 Present: Charles Heffner, Donald Delaney Betty MacDowell Pat Corbin Mark Showers Ann Colby, City Rhonda L edf o r d ■ Vice Chairman Attorney Legal Secretary 1, The meeting was called to order by Acting Chairman Heffner, The Secretary called the roll and all members were present except Maureen Sikora, and Norman Jacobs. 2, Approval of Minutes - 5/26/87 Motion by Mr. Delaney, seconded by Ms. MacDowell to approve the minutes of 5/26/87. Motion carried by a voice vote. 3, Reports: None. A. Cases to be Continued: 1. The secretary stated that Case 87--8, Brown, Rebecca came into compliance on August 21, 1987 before initial hearing. 2, CEB 87-6 -- TROMB LAY i BETTY Lot 1, Haynes Subdivision ( 434 East of Wags Restaurant) Chapter 12, Sec. 12 -2 Zoning ordinance 495, Sec. 507.4A Peter Butt notified the Board that he was no longer the Code Inspector; He stated that the new Code Inspector was Cathy Price. He said he would be glad to give any information regarding the case that he originally cited. Mr. Butt was sworn in and gave testimony as to the current condition of the trailer in violation, He said to date that the trailer was in the same condition as the last inspection May 26, 1987 . Cathy Price was sworn in. She said the trailer appeared to be in the same condition and that no visable attempts to repair the trailer had been made. Attorney Cary Siegel represented Mr, Tromblay and gave argument on the case. He stated that Mr. Tromblay has had the trailer at present location for 18 years; used only as a storage trailer not as a dwelling. He said that Mr. Tromblay had made some improvements to the roof of the trailer and had cleaned up around the outside and inside of the trailer. Discussion by Mr. Siegel /. dok,6 !O'6 regarding the word "nuisance" as stated on the Order, Mr. Siegel presented a picture of the trailer to the Board for the record, Ms. Price read a section of the Code of ordinances relating to the def inition of a "nuisance" , Section 12 -2 Mr, Siegel requested that the Board and /or the Code Inspector tell him what needs to be done to comply with the Ordinance, Discussion was made regarding the repairs of the trailer and the existing rust and bulges. Motion made by Mr. Delaney that the Code Inspector conduct a complete inspection of the trailer and prepare an itemized list of the code violations, by chapter and section, to be given to Mr. Trombl ay by September 3, 1987; Mr. Trombl ay to begin repairs to the trailer on September 3, 1987 or arrange to have the trailer removed; The repairs or removal to be completed by September 22, 1987. Motion was seconded by Mr. Showers and carried by a unanimous roll call vote, 4. PUBLIC HEARINGS: A. Appearances - New Cases: 1. The secretary notified the Board that Case #87 -7 came into compliance on 7/31/87. OW 2, CEB 87-9 - Stoddard, James E. 101 Margo Lane, Longwood Violation of Chapter 12, 12 -1 (3,6) Air, Heffner stated that the Code Inspector remained under oath. Mr. Stoddard was sworn in Ms. Price presented the case. She stated that Mr, Stoddard had a Recreational Vehicle improperly parked; She stated that he had vending machines in his garage and had several complaints that he was operating a business out of his garage, She stated that Mr. Stoddard had a 3/4 ton truck parked in f rant of the house. Ms. Price presented pictures to the Board as exhibits. Mr. Stoddard stated that the vending machines and equipment were removed from his garage over one month ago and he only has a office at his home not a business, Ms. Colby advised the Board that Mr. Stoddard was not cited f or the truck parked in a residential area, therefore, discussion relating to the truck should be avoided, Ms. Price said that the Motor Home is not a problem at that time. Motion by Mr. Delaney to let the records show that Mr, Stoddard Apk was in Compliance. Motion seconded by Pat Corbin and carried by a unanimous roll call vote. A. AW 5. Unfinished Business: A. Compliance before Second Hearing: 1. William Tobol , Case #87-5, complied June 9. 1987. B, continued Cases: None 6. old Business: None 7, New Business - ( other than public hearings) : Discussion regarding the newspaper article which addressed the vacant position of a new Board Member for the code Enforcement Board. 8, Next Meeting Date: Acting Chairman Heffner stated that the next meeting would be held on Tuesday, September 22, 19870 9. Adjournment: Motion by Mr. Delaney, seconded by Ms. MacDowell to adjourn meeting. Motion carried by unanimous voice vote.
