CEB_09-27-88_Minr The Code Enforcement Board of the City of Longwood, Florida met on September 27, 19880 Present: Pat Corbin, Chairwoman Don Delaney, Vice Chairman Maureen Sikora Betty MacDowell James Perry Mark Showers Michael Kramer, City Attorney Cathy Price, Code Inspector Martha Tyler, Recording Secretary Absent: Jeff Morton (excused) 1. The meeting was called to order at 7:30 p.m. by Chairwoman Corbin. 2. The secretary called the roll. Mr. Morton had notified the secretary two weeks in advance that he would be on vacation and would not be able to attend tonight's meeting. 3. Approval of Minutes - Motion by Ms. Sikora seconded by Mr. Showers to approve the minutes of the last meeting held on June 28, 1988. Motion carried by a unanimous voice vote. 4. Public Hearing: A. Appearances - New Case: 1. CEB -1007 - D. Kim Hackett, Mgr. Courtesy Pontiac, Inc. 650 N. Hwy. 17 -92 Longwood, F1 32750 Violation of Zoning ordinance 495, Section 621. 3. A. 1 Ms. Price stated that Mr. Hackett was brought before the Board at this time because he has violated Courtesy Pontiac's conditional use requirements. A Notice of Violation was sent by Certified Mail on August 22, 1988 requiring corrective action by September 2, 1988. She stated on September 2, 1988 the violation still existed and on September 9, 1988 the Code Enforcement Secretary executed the Notice of Formal Hearing by certified mail with the hearing being scheduled for tonight. Ms. Price presented pictures to the Board showing that the pennants are still flying over Courtesy Pontiac today and she stated she was disappointed that Courtesy Pontiac had not complied. Ms. Price stated that Mr. Hackett made no effort to contact her but did inquire of the City Clerk's office as to whether other people had been cited for the same violation. She pointed out that the City's goal is for voluntary compliance, hoping that the residents or businesses will realize the Codes and Ordinances are for their benefit and not being unjustly imposed at random. When he was asked by Mr. Delaney what his position was, he stated he was a real estate agent anti the land use consultant for Courtesy Pontiac. He stated there was nothing ment ioned at the cone i -t tonal use hearinq and he asked if a new ordinance had been passed relating to this type violation. Mr. Fess said he would like to pick up a copy of the ord finance and Ms. Price gave him a copy. He stated they would comply if they are to violation of the City's Codes. He stated they would need a week to ten days to comply. Ms. Sikora suggested that Ms. Price meet with Mr. Hackett at Courtesy Pontiac in order to take steps to correct anv problems. Mr. 14 `es s stated that both of them are out of town quite a bit but will meet with Ms. Price within the next -W days. A"% Motion was made by Ms. Sikora, seconded by Mr. Perry, that based on evidence and testimony, that the respondent is in violation of Ordinance 49 , Section 621. 1. A. 1. A Ms. Sikora stated in the motion that a meeting be held between Ms. Price and Mr. Hackett of Courtesy Pontiac, Inc. to identify any other v�ol_ations at Courtesy Pontiac. Motion carried by a unanimous roll ca 1 . Mr. Del aney made a recommend that in the future f up inspection within 48 hours of date set in order. Mr. Delaney stated that Tuesday night is a problem for him to attend t he Code E n forcement Boa meetings and he resigned as of tonight. He stated he had been on the Boa nearly two years and ha enjoyed workinq witn the other members. The Boa was open for nominations to replace Mr. Delaney who held the position of vice Chairman. Nomination by Ms. Sikora seconded by Mr. Perry to nominate Ms. MacDowel 1, Ms. MacDowel l declined. Motion was mane by Ms. Sikora, seconded by Mr. Perry, to n_l.ace the nomination of co-- chairman on the agenda for the next reqularly scheduled meeting immedlately after the roll call. 6. Unt in ished Business: None 7. Oicl Business: Ms. Prise states. that Mr Hepp had come into com- pliance August 18, 1988. H. Mr. Kramer announced that this would be his last meeting as the attorney for the Code Enforcement Board since he will no longer be the City Attorney after September 30, 1988.
