CEB_05-23-89_MinThe Code Enforcement Board of the City of Longwood, Florida met on May 23, 1989. Present: Pat Corbin, Chairwoman Betty MacDowell George Holleman Sondra Lomax Maureen Sikora Jim Duncan Cathy Price, Code Inspector Martha Tyler, Recording Secretary Absent: James Perry (unexcused) 1 . The meet ing was called to order at 7:35 p.m, by Chairwoman Corbin. 2. The secretary called the roll. 3. Minutes of Previous Meeting: Under Item 4, approval of minutes, change "motion by Ms. Corbin, seconded by Mr. Holleman", to "motion by Mr. Holleman, seconded by Mrs. Lomax". Motion carried by a unanimous roll call vote. 4. Reports: None 5, Public Hearings: a. CEB -1003 - William S. Largent & Robert Lusk 402 South Wilma Avenue Longwood, F1 32750 Violation of Chapters 10, 10-1 12, 12 -1 ( 6) , 12 -2 (9 ) Zoning ordinance 495, Section 507, 507.1 , 507.2A, 507.2B Ms. Price was sworn in by the recording secretary and stated that she had cited the above described property because they are operating a business from a home site. She said Mr. Terry, City Clerk, had told Mr. Lusk he could not operate the business from this location. Ms. Price stated she had tried several times, unsuccessfully, to reach Mr. Lusk but he made no attempt to come into City Hall to obtain an occupational License. She read the violation information pertaining to his case ( attached hereto) . Ms. Sikora asked if this property could be rezoned, Mr. R Robert Lusk w was sworn in by the recording s secretary s stating maintenance field for Carmel Development Croup who works for Central Cablevis ion . He stated that at the present time his men meet at his home, pick up his trucks and leave their cars during the day. Ms. Sikora asked him how his men get in touch with him and he stated he has a beeper with the number being listed through a pager service. Ms. Sikora asked Mr. Lusk if he would be willing to apply for a rezoning permit in order to come into compliance and he said he would. Mr. Robert Largent was sworn in by the recording secretary stating that he resided at 100 Slade Drive, Longwood, Fl. He said that several family members had gotten together and installed a fiber glass fence around the back yard to hide some of the large cables and other materials . Mr. Korman asked Mr. Lusk if any work pertaining to his business was ever done on his property and he stated no, Mr, Lusk stated that he stores tools on his trucks that he parks in his yard which are valued at around $4,000.00. Ms . Lomax asked Mr. Lusk if he could get another place for his business and he said it would be too costly for him. Mr. Korman suggested to Mr. Lusk that he go into City Hall and describe to the City Clerk, Don Terry, and city Planner, Chris Nagle, exactly what he does at the above address. Ms, Sikora stated he needs to come into compliance by obtaining an occupational license, She told Mr. Lusk he should contact Martha Tyler, the recording secretary, if he was refused a license, Motion by Ms. Sikora seconded by Mrs. Lomax that William S, Largen t and Robert Lusk are in violation of Chapter 10, Section 10 -1 of the Codes as cited. They are ordered to come into compliance with that section of the Codes within 14 days, which would be Tuesday, June 6, 1989. If they are not in compliance on or before Tuesday, June 6, 1989, she moved to fine the respondents in the amount of $150.00 per day for each day the violation is in effect. Motion carried by a unanimous roll call vote. Motion was made by Ms. Sikora seconded by Mr. Holleman that a hearing on the other violations as cited be continued until the next regular meeting on June 27, 1989 or a special meeting and at that time Mr. Large n t and Mr. Lusk should report back to the code Enforcement Board and present whatever information they have acquired from the appropriate City officials. Motion carried by a unanimous roll call vote. b. CEB --1012 -- Z. Brent & Cynthia & Alfred Chapdelaine et al 750 Logan Drive Longwood, F1 32750 Violation of Zoning ordinance #495, Sect ion 501.4B ( 2 ) ( 3 ) , Section 807.6 City Code, Section 5.19 , Article Chapter 12, 12 -2 (9) Ms. Price stated Mr. Chapdelaine had been cited for installing a fence without obtaining a permit. She stated the wood stockade fence extended beyond the front of his home which is a violation because City Codes requires that a fence only be allowed up to the front corner of a house. Mr. Chapdelaine was informed by Ms. Price that he could apply for a variance however he said he did not want to pay the $200.00 fee. She said today she noticed three sections of the fence had been removed, however one six foot section still needs to be removed in order to come into compliance. She also stated he has a hedge that prevents clear visibility and it should be cut back to no higher than 30 inches in order to come into compliance with City Codes. Mr. Z. Brent Chapdelaine was sworn in by the recording secretary. He stated he chose to appear before the CEB rather than apply for a variance. He stated he had seen others put fences up without permits and felt he had been singled out. He commented that a truck had run over his fence knocking down the three sections that were still on the ground. Ms. Lomax asked him if he was ever aware that he needed a permit to put a fence up. He said he wasn't; that he had put the fence up on Sunday and the next day was told by Ms. Price that he had to take it down. Motion by Ms. Sikora, seconded by Ms. Lomax that Mr. Chapdelaine is in violation of Section 501.4B (2) , Section 807.6 City Code as continuing violations which exist at this time and that Section 501.4B (3) is in compliance now but has been a violation in the past and may be subject to a repeat violation. She stated she would like to give the respondent a period of two weeks to bring these violations into compliance. If at that time he has not come into compliance a fine of $150.00 per day for each of the two existing violations and $150.00 per day, if the fence is put back up as it was originally, will be imposed. A roll call vote was taken with Ms, Sikora, Ms. Corbin, Ms. Lomax, Mr. Holleman voting aye and Ms. MacDowe l l and Mr. Duncan voting nay. Motion carried with the majority ruling. Mr. Chapdelaine asked the Board to clarify exactly what he has to do. Ms. Sikora stated that within two weeks he needs to ( 1) trim the shrubs so they are no higher than 30 inches, (2) take down the fence and let Ms. Price see that it has been taken down and apply for a $10.00 fence permit or if he chooses not to take down the fence before applying for a permit he'll be fined $100.00, and (3 ) when he installs the fence again to be sure that he observes the front yard set backs. Mr. Chapdelaine suggested that some type of notice be put on residents water bills to make everyone aware that permits are required for installing fences, sheds, etc, Motion by Ms. MacDowell seconded by Ms. Lomax to adjourn.
