CEB_02-27-90_MinThe Code Enforcement Board of the City of Longwood, Florida met at 7:30 p.m. on February 27, 19 90 . Present: Pat Corbin, Chairwoman Betty MacDowell , Vice Chairwoman Sondra Lomax Jim Duncan Gloria Latoski George Holleman Dick Davidson, CEB Attorney Martha Tyler, Recording Secretary Cathy Price, Code Inspector Richard Taylor, City Attorney Absent: James Perry 1. The meeting was called to order at 7:30 p.m. on February 27, 1990. 2. The secretary called the roll and then stated that Mr. Perry has resigned from the Code Enforcement Board due to the possible conflict of interest that may arise at times since his wife, Adrienne, is serving on the City Commission. Ms. Sikora has also resigned and Chairwoman Corbin introduced her replacement, Gloria Latoski . She also introduced the new attorney for the Board, Dick Davidson and his assistant, Dan Mantzaris , who will attend the meetings when Mr. Davidson is unable to and Dawn Jackson who will be taking over as recording secretary beginning with the next meeting replacing Martha Tyler. 3. Approval of Minutes: Motion by Ms. MacDowell, seconded by Mr. Holleman to approve the minutes of October 30, 1989. Motion carried by a unanimous roll call vote . 4. REPORTS: Chairwoman Corbin read a letter that she had been sent by the secretary stating that Final orders had been sent by certified mail on November 13, 1989 to Frank S obo t ka , President of JCL Land Clearing; Industrial Waste Service; Dale B it t house , General Manager of Dump All, Inc.; and John F. Ilepp, 5. PUBLIC HEARINGS: A. Initial Hearings: CEB -1039 -- David & Thelma Agar (Owner) 1000 Lake Weldone Drive Orlando, F1 32806 Steven Blodgett (Tenant) 256 E, Bay Avenue Longwood, Fl 32750 Violation of Section 501 . 4B , Zoning Ord. #495, City Code, Article II, Sec. 5 -19, Chapter 12, 12 -2 Ms. Price stated they came into compliance February 26, 19948 There was discussion among the members that when someone comes into compliance before the hearing the violation should be followed up on to see that it doesn't reoccur. Ms. Price agreed to recheck this violator periodically. CEB -1050 - Raymond & Donna Maltby 799 Sutter Loop Longwood, F1 32 750 Violation of Section 618. 6B(2 y Zoning ordinance #495 Ms. Price was sworn in by the recording secretary and she presented the case. Mr. Davidson asked her if she had any exhibits that she would be presenting tonight and if so they should be marked for identification purposes. Ms, Price stated the case was originally cited on August 12, 1987 after she observed the boat in the Maltby' s driveway for several days. She contacted Ms, Maltby when she received a complaint but was always given a reason for it being there, however Ms. Maltby never called to advise her in advance if the boat was going to be there, On September 13, 1988, Ms, Price received another complaint and just recently she noticed the boat in the driveway for several days. She stated she left a notice for the Maltby' s to contact her and since she got no response a Notice of Violation was sent out to them. She further stated that the President of the Tiberon Homeowners Association advised her today that they were concerned about the boat and had sent a letter to the Mal tby' s . Ms, Maltby was sworn in by the secretary. She stated they keep the boat in storage at U Lock It; they have had a boat at their residence, usually on week -ends, since 1983 and she felt that someone is deliberately calling City Hall to complain. She said it takes her husband three hours to wash and clean the boat after they have used 'it for the weekend. Her husband is not allowed t o work on the boat for minor repairs where they have 'it stored and sometimes he tries to do that at their residence and send it out for major repairs, Ms. Maltby related that she thought they were only allowed one hour to keep the boat at their residence without being fined, but she was informed tonight that they have 24 hours within any seven day period, Mr, Davidson stated that it appears from the testimony that she has admitted she has been in violation. He further stated that at the present time she is not in violation, Motion by Ms, Lomax, seconded by Ms. MacDowe 11, that they know Ms. Maltby is guilty, but she would like to give her one more opportun- ity to come into complete compliance or she will be immediately fined the maximum of $250 per day. Motion carried by a unanimous roll call vote. Ms. Maltby said she will call tomorrow to f ind out what the set- backs are to see if there is any way she can keep it on their property, CEB - 1048 -- Mohammed & Ahmedi Zaman d/b/a Minit -Weld Shop, Inc. 162 E. Palmetto Avenue Longwood, Fl 32750 Violation of Ord. #495, Sections 12 -1(1 ); 12 -1(3); 12 -1(6) 12 -2(2); 12-2(3); 22, 22-28: Appendix "A" & 508.4A Ms. Price, still under oath, presented the case. She stated the case originally went before the Board on June 28, 1985 and the Zaman' s were found guilty of the violations and it was found that if the violations were repeated a fine of $loo per day for each repeat violation would be imposed. She stated he had spoken with Chris Nagle, City Planner, several months ago about enlarging his building. He was advised that he had outgrown the property and should look for a larger place for his business. The city has received complaints that he is backing his forklift into the northbound traffic lanes on CR 427 all times of the day; this has been observed during the mid -day traffic, as well as late afternoon traffic. Ms. Price presented pictures taken January 10, 1990, "Exhibit 3 ", of trash and material scattered all over his property. Again today she took pictures, "Exhibit 1 & 2" showing trash on grounds still remaining and vehicles obstructing traffic. She stated she has had complaints from the Longwood Police and residents. Some pictures were taken today showing he is still not in compliance. Mr. Zaman was sworn in by the secretary. He stated that Ms. Price had talked to him a couple of times regarding the problem at his site and he admitted there is a problem, however he said he has put his property up for sale because he realizes the space is too small for his business. He stated he has talked to Mr. Demetree about renting space from him in Industrial Park. Ms, Corbin asked Mr. Zaman if he realized on January 10 1990 when Ms. Price came by that he could be fined $100 per day. He said he did realize it but he was in the middle of a job but now he doesn't have as much on the property. He said as soon as the job was over he moved it out and the forklift has been moved. Ms. Corbin told him that he is in violation of the City Codes and whether he has a job to finish or not has nothing to do with his coming into compliance. She showed him pictures that Ms. Price had taken today indicating he has still not come into compliance. He asked that he be given a couple of months to move out, Mr. Duncan asked him if he had signed a contract with Mr. Demetree and he said he would be signing it within a couple of weeks, Richard Taylor, City Attorney, recommended on behalf of the City of Longwood, that Mr. Zarman be fined $loo per day from January 10, 1990 through the time he complies giving him a reduction in the fine if he comes into compliance within a certain period of time, Ms. Corbin asked him if he understood what Mr. Taylor had said and that it would be up to the Board to reduce the fine, Mr, Davidson stated the Board should make a Finding of Fact saying whether the violation exists or does not exist and also has to make a Finding of Fact as to what the violations are and when they commenced. Discussion was held regarding the Boards findings and conclusions, Motion by Ms, Lomax, seconded by Mr, Duncan that the public hearing be closed, Motion by Ms. Lomax, seconded by Ms. MacDowell that Mr. Z aman be found in violation and guilty of violation of ordinance #495,, Sections 12 -1( 1) ; 12 -1( 3) ; 12 -1( 6) ; 12-2(3); 22, 22 --28; 508 -1; 508.4A and should be fined $100 per day starting January 10, 1990. Motion carried by a unanimous roll call vote. Chairwoman Corbin stated the next March 27, 1990.
