CEB_03-26-91_MinThe Code Enforcement Board of the City of Longwood, Florida met on March 26, 1991 at 7 :30 P.M* Present: Dr. Fredrick Pearl, Chairman Pat Corbin, Vice - Chairwoman Gloria Latoski Bob Lomax Warren Bull Ernest Tolos Dick Davidson, CEB Attorney Becky Vose, City Attorney Dorothy Fisher, Recording Secretary Cathy Price, Code Enforcement Officer Absent: Clanci Keith 11 The Meeting was called to order at 7 :35 F.M. . 24. Dr. Pearl introduced the new Board Member, Ernest Tolos, and the new City Attorney, Becky Vose, 3. The Secretary called the roll and all members were present except Clanci Keith, 4, Pat Corbin made the Motion to approve the minutes of the February 26, 1991 Hearing, in the format suggested by Attorney Davidson. Motion was seconded by Gloria Latoski. Motion was carried by a unanimous vote. 5. Public Hearings: A. CEB -1163- WILLIAM C. SR, AND MARY DEMETREE,Property Owner and RICHARD O. SKAGGS, Reg. Agent d /b /a HI -TECH MECHANICAL CONTRACTORS 135 Mingo Trail Longwood, Florida 32750 Violation of Zoning Ord. 495, Section 620-2C Dr. Pearl asked the Board to consider continuing this case until the next Board Meeting. Mr. Skaggs was unable to stay and requested a continuance. Attorney Vose recommended that the City give the continuance to Mr. Skaggs. After hearing the above testimony, Mr. Lomax made a motion to grant Mr. Skaggs the continuance until the next Board meeting on April 23, 1991 at 7 :30 P.M.. The motion was seconded by Ms. Latoski. Motion was passed by a unanimous roll call vote. B. CEB -1165- THOMAS AND MARQUERITE SOH AND SAMUEL AND ESABELLA SOH Baywood Industrial Park Longwood, Florida 32750 Violation of City Code, Chapter 12,12 -2 (2) The Chairman opened the Public Hearing and directed all witnesses to be sworn. The Code Enforcement Officer was sworn in and advised the Board that the dumpster was overflowing and there was an accumulation of trash and rolls of screen and outdoor carpet around the dumpster. It appears that other people are using the area to dump their trash. IWS will not pick up the trash because Mr. Soh did not pay them. It appears that there has not been a pick up for several months. Mr. Soh was served by hand delivery and as of the date of this Hearing, he has not responded. Pictures were taken by the Code Enforcement Officer of the Soh Property and marked Exhibit # 1. Ms Latoski made a motion to close the Public Hearing. Mr. Lomax seconded the motion. Motion was made by Ms. Latoski that is the property was not cleaned up within ten(10) days from date of Hearing was met, there would be a fine of one Hundred (100.00) Dollars per day until compliance. Ms. Corbin seconded the motion. The motion was carried by a unanimous roll call vote. After discussion, upon motion made and duly seconded, It was; RESOLVED, that the following Findings of Fact and Conclusions of Law are determined by the Board: FINDINGS OF FACT 1) The City Code Enforcement Officer served a Notice of Hearing on March 14, 1991 , at the respondent's place of business, Skeeter's Barbeque Pit. Mr. Soh's manager accepted and signed for it. 2) The Code Enforcement Officer's testimony indicates that there is an accumulation of trash litter and debris on the property which constitutes a nuisance. 3) The Respondents did not appear at the Hearing. 4) The Board finds that the violations exist and the property is not in compliance. CONCLUSIONS OF LAW 1 ) Respondents are in violation of City Code, Chapter 12, 12 -2- (2 ) ISSUANCE OF ORDER Pursuant to the above Conclusions of Law and its power under Florida Statue Section 162 and local law, the Board issues an order directing the respondents to fully comply and come into compliance with the above sections of law on or before April 5, 1991 and if such compliance is not achieved to the satisfaction of the City of Longwood, a fine of One Hundred Dollars (100.00) per day is hereby assessed until compliance. The Board further directed that the clerk prepare such order and the order be duly issued with the signature of the Chairman or his designee. C. CEB- -1166- TOWNSHIP PLAZA ASSOC. LTD ALVIN LEITMAH, Reg. Agent West SR 434, Township Plaza Longwood, Florida 32750 Violation of City Code, Chapter 12,12-2 ( 2 ) The Chairman opened the Public Hearing and directed that all witnesses be sworn . All Witnesses were duly sworn by the clerk. The Code Enforcement Officer presented her case to the Board, The Code Enforcement Officer introduced Mr. Barry Revels, who is Mr. Leitman's Property Manager. Mr. Revels ask for a continuance due to not having received the original Warning. The Warning was sent to 504 Gulf Life Tower, Jacksonville, Florida, 32207, per the Seminole County tax records. The Notice of Hearing was sent "Overnight Mail", on March 14, 1991 to the same address. Mr. Revels claimed they did not get the Warning, but they did sign for the "Overnight Mail ", at the same address. Mr. Revels said the correct address is 2109 Gulf Life Tower, which is in the same building. Mr. Revels said they needed more time to come into compliance, because of not getting the original Warning. The Code Enforcement Officer thought it strange that the Warning was not returned to the Police Department if undeliverable. Atty.Vose said that if it was a question of proper notification that in her opinion the case should be continued until the next Code Enforcement Meeting, with no additional notice being required for the continuance and Mr. Revels agreed to this. Mr. Revels said it would take a couple of weeks more to bring the property into compliance. Mr. Revels requested an itemized list of what was needed to clean up the trash around the dumpsters and trash around the lake. After hearing the above testimony, Mr. Lomax made a motion for the Board to give Mr. Revels a continuance until April 23, 1991., because of not getting the original Warning and by testifying that he was making an effort to clean up the property. Ms. Corbin seconded the Motion. Five members Voting " Yes", for a continuance until April 23, 1991, at 7:30 P.M.. Mr. Tolos Voted" Ho ", Motion carried . F. OLD BUSINESS- Me. Corbin made a request that Dorothy Fisher find out if Clanci Keith was still on the Board, since this was the second meeting she had missed. Dr. Pearl said that Ms. Keith had called him and told him of not being able to attend, this meeting due to a work related conflict, therefore, she is still on the Board, as of this date. 7. NEW BUSINESS- Mr. Lomax asked the Code Enforcement Officer if she could send original Warnings out "Certified Mail ". Attorney Vose said she would recommend that the Warnings be sent " Certified Mail ", and Regular Mail. The Code Enforcement Officer agreed to this. Ms. Corbin made a motion to adjourn the meeting, seconded by Mr. Tolos. Motion was unanimously adopted. The meeting was adjourned at 8:35 P.
