CEB_11-23-93_MinThe Codes Enforcement Board of the City of Longwood, Florida met on November 23, 1993 at 7:30 P.M. Present. Ernest Tolos, Chairman Dana Addison Warren Bull Lynette Dennis Janis Soyer George Valkenburg, arrived 7:50 Daniel Mantzaris, CEB Attorney Richard Taylor, City Attorney Cathy Price, Code Enforcement officer Mary Bruce, Secretary Pro Tem Absent. Haywood Bundy, excused 11 CALL MEETING TO ORDER The meeting was called to order at 7:36 by Chairman Tolos. 2, ROLL CALL The secretary called the roll and all members were present with the exception of Mr. Bundy. 3. APPROVE MINUTES OF PREVIOUS MEETINGS: September 20, 1993 October 26 1993 Chairman Tolos asked for a motion to approve the minutes from the Special Meeting of September 20, 19 9 3 . Mr. Bull made a motion to approve the minutes. A vote was taken and the motion carried by an unanimous voice vote. Chairman Tolos made a motion to approve the minutes from the regular meeting dated October 26, 1993, Ms. Addison seconded the motion. Motion carried by an unanimous voice vote* With the end of Gloria Latoski' s term, the board elected a new Vice Chairman. Chairman Tolos nominated Ms. Addison, seconded by Mr. Bull. There were no other nominations. Ms. Addison was elected as Vice Chairman by an unanimous voice vote. 4. PUBLIC HEARINGS: There were no respondents present that wished to speak. Ms. Price was sworn in by Chairman Tolos. A) APPEARANCES: 1. CEB- 93 -11 -37 Professional Dry Cleaning Jim Centrella, Owner 1 Ms. Price presented the case. Mr. Centrella was cited for having a roof s ign without a permit. Ms, Price stated that she did extend the original compliance date, due to a death in Mr. Centrella's family. Mr. Centrella has applied for a pole sign permit, however the sign erected on the front of the building is still there and he has not applied for a permit for this sign. Ms. Price submitted the receipt for certified mail as City Exhibit A. The hearing was closed and the Board discussed the case. Motion by Mr. Bull, seconded by Mr. Valkenburg that based on the evidence seen and the testimony given to find the respondent, Jinn Centrella guilty of violating City Code, Section 5 -19. Motion carried by a majority vote with Ms. Soyer, Mr. Bull, Ms. Addison, Mr. Tolos, Mr. Valkenburg voting aye and Ms. Dennis voting nay. Mr. Bull continued the motion to give the respondent, Jim Centrella 10 days or by December 3, 1993 to bring the property into compliance or a penalty of $25.00 per day will be imposed and will continue for each and every day of non - compliance. Motion was seconded by Mr. Tolos and the motion carried by a majority vote with Ms. Soyer, Mr. Bull, Ms. Addison, Mr. Tolos, Mr. Valkenburg voting aye and Ms. Dennis voting nay. 2. CEB- 93- -11 -38 James D. & Connie J, Van Dam Nis. Price advised the Board that this case came into compliance prior to this meeting. 3. CEB- 93 -11 -39 Jeffrey J. Grotto Ms. Price advised the Board that this case came into compliance prior to this meeting. 4. CEB- 93 -11 -47 Bruce & Susan Karp Ms. Price presented the case and submitted a picture of the truck as City Exhibit A. The tenant of this property is Mr. Dan Mills and he is also the owner of the truck. Ms. Price explained that the truck and trailer are very large and that whether Mr. Mills uses the truck as a business vehicle or a personal vehicle it would still be in violation of Zoning ordinance #495, Section 618.4B of the City code. Ms. Addison questioned if Ms. Price verified that the vehicle did not leave the property within a hour period. Ms. Price stated that she did check back in a hour. She further stated that Mr. Mills stated that the vehicle would not be leaving the location. There was a great deal of discussion regarding the tonnage of the truck. The hearing was closed and the Board discussed the case. K Chairman To los made a motion to find the respondent guilty of violating Zoning Ordinance #495, Section 618.4B. Motion died for lack of a second. Mr, Valkenburg made a motion to postpone the case to the next meeting, giving Ms. Price time to ascertain the exact tonnage of this truck. Ms. Dennis seconded the motion. Motion carried by a majority vote, with Ms. Soyer, Mr. Bull, Ms. Addison, Ms. Dennis, Mr. Valkenburg voting aye and Mr. Tolos voting nay. 5. CEB- 93 -11 -49 John W. Ward Heirs Ms. Price advised the Board that this case came into compliance prior to this meeting. 5. OLD BUSINESS: A) STATUS OF PREVIOUS CASES: 1. CEB - 93-05 -01 Gloria E. Elaine Ms. Price stated that this case was brought into compliance due to City cleaning this property. She further stated that this property was also sold on the 18th of November, therefore this will not be a violation that will reoccur. Mr. Derrick E. Cox, with the law firm of Zimmerman. Shuff ield, Kiser and Sutcliffe spore on behalf of American Savings. He wanted to know the amount of the lien and if additional penalties were accruing. Mr. Mantzaris advised that if the property is in compliance then the fine does not continue to accrue. Mr. Mantzaris stated that until American Savings actually retains possession of the property, Mr. Cox can not request any kind of reduction regarding the amount of the lien. Mr. Cox was satisfied with that, he stated that was his request anyway, to table the case until American Savings retains control of the property. 2. CEB - 93---09 -20 Josephine C. Walsh and Philip J. & Judith W. LaRue Ms. Price stated this property is now in compliance. 3. CEB- 93 -09 -21 Mary G. Gamble Ms. Price explained that Ms. Gamble asked her to check her property and verify that she was in compliance. Ms. Price stated that the fence was not stable and the posts were not in the ground and the sections were still tied to the post. Ms. Price advised Ms. Gamble that according to the order of the Board each property owner was to secure their pool. The pool was not secured thus she was not in compliance. 3 4. CEB- 93 -10 -32 Philip & Muriel Turner Ms. Price stated that when she inspected Mr. Turner's property, he had erected a fence and his property was in compliance. 81 NEW BUSINESS There was no new business. 9. ADJOURNMENT Mr. Valkenburg made a motion to adjourn. Motion seconded by Ms. Dennis. Motion carried by a unanimous voice vote. Meeting adjourned at 8:32 P.M. Dawn B.
