CEB_01-25-94_MinThe Codes Enforcement Board of the City of Longwood, Florida met on January 25, 1994 at 7:30 P. M. Present: Dana Addison, Vice Chairman Butch Bundy Jim DeGore Janis Soyer George Valkenburg Daniel Mantzaris, CEB Attorney Richard Taylor, City Attorney Cathy Price, Code Enforcement Officer Eva Neisler, Secretary Pro Tem Absent: Ernest Tolos Lynette Dennis 1. GALL MEETING TO ORDER Vice Chairman Addison called the meeting to order at 7:35 P . M . 2. INTRODUCTION OF NEW BOARD MEMBER: James DeGore Vice Chairman Addison introduced Mr, James DeGore and further stated that she had worked with Mr. DeGore before and welcomed him to the Board. 3. ROLL CALL The secretary called the roll and all members were present with the exception of Mr. Tolos and Ms. Dennis. 4, APPROVE MINUTES OF PREVIOUS MEETING. November 23, 1993 Mr. Valkenburg made a motion to approve the minutes from the November 23, 19 9 3 meeting as submitted. Motion was seconded by Mr. Bundy. Motion carried by an unanimous voice vote. 5. PUBLIC HEARINGS: Vice Chairman Addison asked all persons wishing to testify to please complete a respondent sign in sheet and submit it to the secretary. The secretary then swore in Ms. Price and Mr. Charles Costar . Ms, Price explained that the following cases were all address violations, that were referred by Seminole county. The County is changing the addresses on CR 427 and these case were notified in September of 1993 to display their address on their buildings and have failed to do so. At this time, Mr. Valkenburg requested that due to there only being one respondent present, that the Board proceed and hear his case first. It was a consensus of the Board to hear the appeals case first. B) APPEALS: 11 CEB- 93- -05 -01 Gloria E. Elaine Ms, Price advised the Board that the figures that were submitted with their packet were incorrect. She explained the corrections and stated the total fine was $ 10,607.00. Mr. Taylor reminded the Board that the fine was filed against the original owner and that the property had changed hands since that time, Ms. Price further defined the case, stating that the property had been returned to the mortgagee. Mr, Charles B. Costar, III spoke on behalf of American Savings of Florida, the mortgagee. Mr. Costar attended this meeting to appeal the fine stating that the majority of the fine accrued prior to the banks ownership, and he requested a reduction in the amount of the fine. Mr. Mantzaris stated that if the lien was recorded after the lispendens was recorded, then the fine will not apply to American Savings, Mr. Taylor added that if the equity is enough, then it should be the City's position that they should pay the full amount of the fine, however should the equity not be enough, the City might consider reducing the fine. Mr. Costar in answering Mr. Valkenburg's question, stated that the bank would like to reduce this figure to 11 0" if possible. He further explained that the bank did not create this condition. The Hearing was closed and the Board discussed the case. After much discussion, a motion was made by Mr. valkenburg, seconded by Mr. Bundy to leave the fine as is. Motion carried by an unanimous roll call vote. A) APPEARANCES: Ms, Price reminded the Board that all of these cases were address violations from the County. 1. CEB- 94 -01 -52 Pamela Morris Ms. Price explained that all information sent to this respondent was return as "addressee unknown ". Mr. Mantzaris questioned if the property had been posted. Ms. Price stated that she had not posted the property. Mr. Mantzaris further stated that there can be no action taken on this case due to the respondent not receiving good service. 2, CEB- 94- -01 -53 Edward Meixsell Ms. Price advised the Board that this case came into compliance prior to this meeting. 3. CEB- 94 -01 -54 Clara D. Ladez and Anne L. Ladez Mrs. Ladez advised Ms. Price that she called the County to advise that the property had been properly addressed. However when Ms. Price inspected the property, the mailbox was addressed with the labeling tape which does not comply with the ordinance. The other property has one inch numbering, which also does not comply with the ordinance. Ms. Price's recommendation was to give the respondent an additional two weeks, giving her time to get back with the property owner. The owner lives in Jacksonville and they were advised by the tenants that the address numbers were posted. The Hearing was closed and the Board discussed the case. Mr. DeGore made a motion, seconded by Mr. Valkenburg that based on the evidence seen and testimony given to find the respondents, Clara D. Ladez and Anne L. Ladez, guilty of the violation as stated on the Notice of Hearing submitted by Code Enforcement Officer, Cathy Price and to give the respondents, Clara D. Ladez and Anne L. Ladez two weeks or until February 9, 1994 to bring the property into compliance or a penalty of $10.00 per day will be imposed and will continue for each and every day of non- compliance. Ms. Price asked that the motion be amended to add "per violation" due to there being two units at this location. Mr. DeGore amended the motion to include "per violation ", amended motion was seconded by Mr. Valkenburg. Motion carried by an unanimous roll call vote. 4. CEB- -94- 01 -55A John D. & Ada A. Haines Ms. Price advised the Board that this case came into compliance prior to this meeting. 5. CEB-- 94- 01 -55B Ahmadi Saman Ms. Price stated that Mr. Saman called her this date and stated that the numbers would be up the next day. Ms. Price recommendation was the same as the previous case. The Hearing was closed and the Board discussed the case. Mr. Valkenburg made a motion, seconded by Mr. DeGore that based on the evidence seen and testimony given to find the respondent, Ahmadi Saman, guilty of violation as stated on the Notice of Hearing as submitted by the Code Enforcement officer, Cathy Price and to give the respondent, Ahmadi Saman seven days or until February 1, 1994 or a penalty of $10.00 per day will be imposed and will continue f or each and every day of non-compliance. Motion carried by an unanimous roll call vote. 6. CEB- 94 -01 -56 Sharon M. Bodiford Ms. Price advised the Board that this case came into compliance prior to this meeting. 6, OLD BUSINESS: A) STATUS OF PREVIOUS CASES: 11, CEB- 93- -11 -37 Professional Dry Cleaning Jim Centrella, owner Ms. Price advised the Board that the Profess iona 1 Dry Cleaning business has come into compliance. 2. CEB- 93 -11 -47 Bruce & Susan Karp Ms. Price reminded the Board that this case was the commercial truck in the residential area. The case is still pending. This case will probably be brought back before the Board at the next scheduled meeting. 7, NEW BUSINESS There was no new business. 8.
