Me 2, The roll was called, and all were present except Mrs. Sayer who arrived at 7 :388 31 APPROVAL OF MINUTES OF PREVIOUS MEETING: September 27, 1994 Mrs. G❑odblatt stated a correction needed to be made on the last page ( page five), l i n e three, It should say "foreclose on the lien" no t "close on the lien". Mr Bundy made a motion to accept the minutes as amended seconded by Ms. Addison. Motion carried by unanimous voice vote. 4. PUBLIC HEARING: Chairman To los asked all persons wishing to testify to please s tand and be sworn in. Mr . Taylor then swore in Ms. Price and Mr. and Mrs. Jenkins., A) APPEARANCES: 1 . CEB- -94 -1 0--73 BHAGWANDASS , Sudesh & Evangeline Ms. Price presented the case stating that Sudesh and Evangeline Bhagwandass were in violation of City code Chapter 12, Sec. 12-2(l) and Sec, 12-2(2). After verbal communication failed to resolve the problem, a letter was sent to Mr. and Mrs. Bhagwandass on September 8, 1994 asking them to clean up the junk and trash and to cut the high grass. No effort was made to comply by the son who now lives in the house. The notice of hearing dated October 5, 1994, was delivered to Lincoln Bhagwandass by the Longwood Police Department. No contact was made until October 25th when he called and asked for the property to be inspected for compliance. Ms. Price found when inspecting the property that there were still three to four foot piles of grass in the back yard and miscellaneous trash around. Page 2 October 25, 1 994 Ms. Pr ice's recommendat ion was to f ind them in vio Iat ion of C ty Code Chapter 12, Section 12--2 ( 2) , which is accumulation of trash, and Section 12-2(l), grass and weeds in excess of 10 inches, and give them one week to comply with the code. The hearing was closed and the board discussed the case, A motion was made by Mr. T❑ los to find the defendants in violation of Chapter 12, Section 12- 2,(1), high grass and weeds, and Section 12-2(2), accumulation of trash, and to g i v e them one week or until November 1, 1994 to complete the clean up of the property. If not in compliance at that t i m e , they be charged a fee of 25.00 dollars per day until it is in compliance. The motion was seconded by Mr. Bundy. Motion c a r r i e d by unanimous roll call vote, 5. OLD BUSINESS: A) STATUS OF PREVIOUS CASES; 11 CEB-- 94- -04 -59 JENK I NS , Lee A. & Suzanne M. Ms. Price stated at the last meeting the Jenkins case CEB-- 94-04- 59 had not been brought into compliance. It was the Board's decision to subpoena the Jenkins if the v i o l a t i o n s had no t been brought into compliance. As of October 25, they were not. The building permits have been approved and the Jenkins have been called twice to pick them up. The subpoena was served to the Jenkins yesterday, October 24, 1994, by the Longwood Police Department. The f i n e has continued to accrue, and as of October 25, is $17,500. After discussion by the Board, a motion was made by Mr Va 1 kenburg to give the respondents one week to come into compliance or remove said pool. At which point in time if it is not in compliance or the pool has not been removed, that the City remove the pool and then file the l i e n . The motion was seconded by Mrs. Dennis. Motion carried by unanimous roll call vote. 2. CEB- 94 -09 -72 HRH REALTY ASSOCIATES, Barnard HERSKOWIT2, Gen. Partner MORBITZER GROUP, INC., Tina MORBITZER, Pres.(Prop. Mgr.) David TYRON, Owner Dependable Lawn Equipment Lewis H. TYRDN, Lease Owner Ms. Price advised that this case came into compliance prior to this meeting. Page 3 October 25, 1994 6, ELECTION OF OFFICERS: Chairman Tolos asked for nominations for the position of Chairman. Mr. Valkenburg nominated Mrs. Addison, seconded by Mr. Bundy. There were no additional nominations. The nomination of Mrs. Addison for Chairman carried by unanimous voice vote. Chairman Addison asked for nominations for the position of Vice Chairman. Mrs. Dennis nominated Mr. DeGore seconded by Mr. Tolos. Chairman Addison asked if there were more nominations, and there were none. The nomination of Mr. DeGore for Vice Chairman carried by unanimous voice vote. 7. RULES AND REGULATIONS: A) REVIEW AND DISCUSS After discussion about changing the rule for d i s m i s s a l from the Board for non- attendance of meetings by Board members and who t ❑ notify for an excused absence, it was decided to leave it as written. Article IX, Enforcement . , Section 7 & Section 5 and Article VII, Initiation of Actions Before the Board., Section 3, Richard Taylor suggested these sections of the rules and regulations be changed to comply with the Florida Statutes. Mrs. G❑❑dblatt concurred, and at the suggestion of the Board it was decided to have Mrs. Go❑dblatt rewrite these sections, She will present them to the Board at the next meeting for their review and comments. 8. NEW BUSINESS: Mrs. Addison stated there was a request to discuss changing the meeting time from 7:30 p.m. to 7 :00 p.m. Everyone present agreed that the meeting time should be left a t 7:30 p . m . There was no other new business. 91 ADJOURNMENT: A m o t i o n to adjourn was made by Mr. Bundy and seconded by Mr. Tolos. The meeting was adjourned at 8 :10.
