Ms. Price presented the case, The p r operty was i nspected
after receiving several complaints in regard to a fence that
was severely dry Upon inspection it was n oted that
two sections of fence were missing in the front. This
property also has a pool Be cause t fence iS not. secur
with the two secti +- missing, the is unsecured.
Pictures were pr e_sente. d . showing the fence sections not being
secured. The first picture is the front view of the fence
showing the hinges, of the gate on the outside, with latch
mi ssing. There are only tc, ro sections o ferice, between the.
hous and the neighbor's propert The one section on the
North side has the state with the missing latch. The Sout.1,
side has two sections Just le, -=ini ig up against a p ole. A

Service was made by the Longwood Police Department, bilt
there was still no response. There is a problem with
neighborhood children being able to access the pool by just
moving the fence to one side. The main concerns are shown in
the pictures with the gate not having the self - closing latch
that is required (placing the latch can the correct side of
the fence) , and securing the property by repairing the fence
sections.
Ms Price recommended that the subject sections of fence be.
put up and the gate secured. The two sections of fence need
to be secured, with the gate being repaired, with a self
closing, self latching mechanism.
Iris. Taylor reoomnle"Ided that they be given until Monday 12-2-
96 at 8:00 am to secure the fence.
Motion was made by Mr. DiFiore to fine the respondents in
violation of the City of Longwood Code Section 609.3(•a).1,
_subsection c, of the Appendix A and Section 5 -94 Of City
Code as a matter of law. Service was properly made by the
City of Longwood Police Department on November 19 ,1996 .
Further move to give the respondents until Monday 12 -2 -96 to
bring the matter into compliance, including that the gate
must be secured and the fence must be firmly secured, that
it will not be possible to enter the perimeter anywhere
surrounding the pool by any children or any individual,
either by nails or by board or what ever methods necessary;
but it must be secured by Monday at 5:00 pm. Upon failure of
having fence secured by 5:00 pm, then the City of Longwood
will secure this in whatever manner is necessary for the
public safety and to comply with the section of ordinance
above mentioned. If the city is called in, the cost of
repairs will be incurred by the respondent and a penalty of
$250 per day will be imposed and continued for each and
every day of non - compliance. The cost of this will be
assessed against the respondent if this order is not
complied with in a timely manner. Panels loose, no latch on
the door, hinge_ are broken, wood fence itself will fall
over at touch and this is what needs to be brought into
compliance and secured in a fashion such that there is no
admission from anywhere around the perimeter of the pool as
per exhibits presented in A and B by Ms. Price. Seconded by
Ms. Dennis. Unanimous voice vote.
CEB -11 - 012 Complied shortly after the notice was served on
