CEB_05-27-97_MinCity of Longwood Code Enforcement Board Minutes May 27, 1997 Present: Haywood Bundy, Chairman Ernest Tolos Dana Addison Lynette Dennis George Valkenburg Staff: Amy Goodblatt, CEB Attorney Richard Taylor. City Attorney Cathy Price. Code Enforcement Officer Carl Gosline, City Planner John Groenendaal, Recording Secretary Call meeting to order. The meeting was called to order at 7:30 by Chairman Bundy. 2. Roll Call. The secretary called the roll. All members were present. 3. Approval of the minutes for April 22, 1997. Ms. Goodblatt offered three corrections. In the first sentence of agenda item # 4 replace the word "applied" with "complied." In the second paragraph, first sentences of agenda item # 4 change "CEB 97 -04 -016" to "CEB 97- 04 -17 ". The final change was in the final sentence of agenda item # 6 to change "compliance to "comply." 4. Public Hearings: Chairman Bundy called the first case CEB 97 -05 -019 - Eli Melamed. Reg. Agent/Dir. And ERM Homes. Inc. Mr. Taylor asked that this case be continued, based on concerns he had on service. Ms. Goodblatt agreed that a continuance would be best. The motion was made to continue to a later date and passed unanimously. Chairman Bundy called the next case CEB 97 -05 -020 - Carl and Donna Flowers. Ms. Price presented the facts of the case. On April 25, 1997, she noted the parking of a large white trailer in the driveway of the defendants. She stated that the standard letter was sent for the defendant to come into compliance by April 30, 1997. On subsequent reinspection the trailer had not been moved and a notice to appear was sent on May 19, 1997. Ms. Price placed into evidence a photo of the trailer in the driveway dated May 5. 1997. Ms. Price stated that the defendant had moved the trailer prior to the Code Enforcement Board meeting. Ms. Price asked that the defendant be found guilty and requested that the repeat offender clause be invoked and a $50.00 fine per day if the problem reoccurred. Mr. Bundy asked if the defendant would like to speak. Mr. Carl Flowers of 338 "Tartan St. did speak on his own behalf. Mr. Flowers stated the trailer was used to store his children's motorcycles and that he has moved the trailer to Volusia County. Mr. Flowers felt that he had been singled out based on other boats mid trailers he had observed. Mr. Bundy assured the defendant that he was not and he was advised that he could report any code violations he observed to Ms. Price. Mr. Addison moved to close the public hearing and the motion carried. Mr. Bundy asked for any discussion but none was offered. Mr. Valkenburg thought the Board should follow Ms. Price's recommendations. Ms. Dennis agreed and Mr. Valkenburg moved to find the defendant guilty and that a repeat violation would carry a $50.00 a day fine. Ms. Addison seconded the motion and it carried unanimously by voice vote. Old Business: None 6. New Business: Chairman Bundy stated that the Board still needed a Vice Chairman and that all of the members were in attendance. Ms. Goodblatt stated it would be permissible to elect a Vice - Chairman even though it was not on the agenda. None of the Board members objected and Mr. Bundy asked for nominations. Ms. Dennis nominated Mr. Valkenburg and Ms. Addison. Mr. Valkenburg respectfully declined the position and Ms. Addison accepted. No other nominations were put forward. The Board accepted Ms. Addison by acclamation. Mr. Bundy asked if any other business needed to be discussed. Mr. Gosline introduced himself and invited the Code Enforcement Board to attend the Land Development Code workshop hearing scheduled for May 28, 1997. Mr. Gosline pointed out that code enforcement issues would be discussed. One of the major issues would be the citation system. Ms. Goodblatt encouraged the Board to attend as a way of molding codes based on the Board's past experience.Both Mr.Gosline and Ms. Goodblatt enlightened the Board on how this citation will affect the Board. Ms. Goodblatt said she would attend. 7. Adjournment: The Code Enforcement Board Meeting adjourned at 8:00 P.M..
