MINUTES OF MEETING
SEPTEMBER 23, 1997
1. CALL MEETING TO ORDER.
Meeting was called to order at 7:26 PM. by Chairman Bundy.
2. ROLL CALL

3. APPROVE MINUTES OF SEPTEMBER 9,1997 MEETING.
Motion by Ms. Dennis to approve Minutes of September 9, 1997, seconded by Addison. Unanimous voice vote.
5. PUBLIC HEARING.
A. CEB 97 -05 -019 ERM DEVELOPMENT, CORP & ELI MELAMED, REGISTERED
AGENT.
City Attorney. Richard Taylor, swore in those requesting to speak at the Public Hearing.
Carl Gosline. City Planner, presented the case to the Board stating that the developer, ERM Homes. in Longwood Club
Subdivision removed a number of trees without the proper City Arbor Permits in violation of Section 809.2 of Appendix A
of the City Code in effect at that time, May 1995. Mr. Gosline submitted exhibits into evidence substantiating the City's case.
The Board accepted the exhibits into evidence and passed them to be viewed by each member.
Mr. Gosline was questioned by Board members, Amy Goldblatt, CEB Attorney and Richard Taylor, City Attorney.
Michael Jones. Attorney for ERM Development & Eli Melamed introduced himself to the Board and presented exhibits
concerning the case into evidence. He also distributed copies of the exhibits, a deposition taken on the prior Friday of Carl
Gosline. and originals of depositions taken of Mr. Tom Smith, and Mr. Richard Kombluh both city employees. Mr. Jones
then proceeded with cross - examination of Mr. Gosline. At the end of his questioning Mr. Jones requested to reserve the
right to recall Mr. Gosline if necessary.
Cross examination was done several times by Attorney Michael Jones and Attorney Richard Taylor.
Motion to adjourn for a five minute break made by Dennis. seconded by Addison. Voice vote unanimous.

Chairman Bundy pointed out that it was obvious due to the lateness of the hour the public hearing would not conclude tonight.
He requested to entertain motions for a time period to accommodate everyone's plans.
Mr. Jones pointed out that he had brought several witnesses to testify at the public hearing tonight and requested that three; (3)
of the witnesses be heard tonight due to very short testimony.
Motion to adjourn the public hearing at 10:00 P.M. tonight made by Ms. Addison. seconded by Ms Dennis. Voice voted
unanimous.
Mr. Jones then proceeded with direct examination of Michael Odom, Construction Manager. of Blue Locks Land Services,
Oak Groves, Florida. Mr. Taylor cross examined and the Code Enforcement Board directed questions to Mr. Odom at this
time.
Mr. Jones then proceeded with direct examination of Rick Lembrich, owner. of Blue Locks Land Services, Oak Groves,
Florida. Mr. Taylor cross examined and the Code Enforcement Board members directed questions to Mr. Lembrich at this
time.
Mr. Jones then proceeded with direct examination of Fernand Tiblier, an engineer. former city employee and former Director of
Public Works of the City of Longwood. Mr. Taylor cross examined Mr. Tiblier and Mr. Jones redirected.
Discussion ensued concerning the continuation of the public hearing by Board members. Attorney Goldblatt, Attorney Taylor.
Attorney Jones, Ms. Price and Mr. Gosline.
Motion to continue the public hearing until October 7, 1997 at 6:30 P.M. was made by Mr. Tolos. seconded by Ms. Addison.
Voice vote unanimous.
Meeting adjourned at 10:04 P.M.
