CALL 1%- 1EETING TO ORDER Meeting was called to order at 7:02 by Chairman Bundy 2. APPROVAL OF N11NUTES OF February 24, 1998 MEETING Unanimous vote to approve minutes of previous meeting. 4. PUBLIC HEARINGS A. Dominic Boetto - CEB 98 -02 -002 Chairman Bundy called the first case, CEB 98 -02 -002, Boetto Corporation, Dominic Boetto, Registered Agent, owners of Saddle Up Western Store. Oft C 1OFF ?CE1 WFffl V61'LC DH' :-V III UTE MUNCH. 93 691, The members of the Board and Cathy Price discussed several aspects of the case before the respondents arrived at approximately 7:20 p.m. Upon Mr. Boetto's arrival, Attorney Taylor advised that the public hearing portion of the meeting should be re- started. The public hearing portion of the meeting was re- started; Chairman Bundy swore in Ms. Price, Dominic Boetto and Jeffrey Boetto Cathy Price presented the facts of this case: there is an accumulation of abandoned vehicles, boats, a camper and assorted metal debris on the Saddle Up property; the respondents have used portable signs for business without permits; the respondents have trailers on the property, which are used for storage. The respondents have been cooperating by gradually removing the trash and by investigating the removal of the boats, vehicles, etc. Although they were denied permits, the respondents have continued to use portable signs. Ms. Price advised that Mr. Boetto had told her that there is a contract for sale on the property. Ms. Price recommended an administrative fee of $250.00 and a fine of $50.00 per day, after granting a two -week period to clean up the property. Photos of the property were introduced into evidence. Ms. Dennis raised the question of whether the pending sale of the property was relevant to the case. Attorney Taylor advised that the pending sale is not pertinent to this case. The issue of the storage trailers was then discussed. Ms. Price advised the Board that the revised Land Development Code permits trailers for storage if they are used as an accessory to the APINh business. Since the trailers are used for that purpose, there is no violation. Attorney Taylor stated that lie would recommend to the city that the Code be changed to re- establish the use of storage trailers as a violation. Mr. Dominic Boetto testified that the trailers will be eliminated, and that they are working to clean up all the debris and the vehicles. The business will be sold or moved from its current location. He said he does not want the property to become an eyesore. Mr. Jeff Boetto testified that he also owns a cellular communications company on the property. He has occasionally used signs without permits for the Saddle Up store because of problems in the past with Longwood's permitting process. During the Christmas, 1997, holiday season, he said that there was a problem with a permit and with the City sending a letter regarding signage to his brother and not to him. Mr. Dominic Boetto said that he uses a truck in his business and that it also functions as a sign. Ms. Price had advised him that he can use it as a sign, but it must be moved farther back from the street. A discussion of the truck ensued. Ms. Price advised that the respondents were not cited for the truck, but were simply asked to move it back. Chairman Bundy closed the public hearing portion of this matter, and there ensued a discussion of the specific violations. Ms. Price stated that the notice that was sent to the respondents incorrectly cited the violation. Ms. Dennis moved to find the respondents guilty of violating Land Development Code Sections C tOFF7C4E"447 WIN6IWDfit.Z- 1 0UHl.' IMESINAARCH.98 �' 24- 60.06(a )(4 )(e) and City of Longwood C ity Code Sections 12. 12 -1(2) and (6), regarding the large accumulation of vehicles and debris, and that they be given 30 days from March 25, 1998 to come into compliance. An administrative fee of $250.00 will be assessed. If they do not come into compliance by the deadline, a fine of $100.00 per day per violation will be imposed. Motion was seconded by Mr. Tolos. Motion carried. B, Shannon Feldon - CEB 98- 003 -005 Attorney Taylor swore in Shannon Feldon, who goes by the name Shane Feldon. Cathy Price presented the facts of the case: several large trailers and an inoperable vehicle were stored in the driveway and at the side of the driveway of this property for more than 24 hours in a seven -day period. No opaque fence, wall or dense hedge screened these trailers or vehicle from view. As of the date for compliance, all of the violations had been corrected except for the trailer. Mr. Feldon gave testimony that the last trailer had been put into storage and that the vehicle had been removed. A receipt was submitted to the Board as evidence. Mr. Feldon stated that there was no business being operated on the subject property. A discussion ensued as to the question of a home occupation, and it was agreed that there was no evidence of a home occupation. A motion was made that the respondent be cited with a violation of Longwood Land Development Code 24- 23.09,and be fined $25.00 for administrative costs. Motion was seconded and carried A` by the majority. G, OLD BUSINESS Cathy Price provided updates on the Little Shop of Flowers, respondent has paid the $25.00 fine, and on the Ferguson matter, no payment of the $100.00 fine yet, but it should not be a problem. 7. NEW BUSINESS Nis. Dennis requested a list of names of the CEB members, with addresses and phone numbers, and Ms. Price said she will provide same. 8, ADJOURNMEENT The Code Enforcement Board Meeting adjourned at 9:00 p.m. Respectfully submitted, Carol D.
