CQU MEETING TO ORDER. P Chairman Bob Lomas called the meeting to order at: 7:10 p.m. Chairman adxised of two excused absences, Lany Moore and Joe Hartrnan. 2. ROLL CALL. 3. APPROVE MINUTES OF LAST MEETING 4ctober 24,2000 The minutes were approved and a motion was made and carried to change the agenda and hear Old Business and New Business before the cases. OLD BUSINESS: ErnieTolos brought up copies of new codebooks to be distributed to board members. -h y Goodblatt advised she had received a new copy. Code Compliance Inspector Cathy Price rolunteered to check up on it. Regarding the Negrich case fiom last months meeting, it was noted that the property is cleaned up and thc owner is looking to sell. NEW BUSINESS: Board Attorney .\my Goodblatt requested an addition to the next agenda. She requested that the rules and regulations be reviewed in the January meeting. It was noted that this should be put on the agenda for the next meeting. These are internal Board rules and regulations that do not supercede the code but govern the m y the Board is to proceed. The question was raised about a December meeting. A% motion was made to suspend the meeting by Laura Mohlenkamp and seconded by Ernie Tolos. -411 were in hvor. A motion was made to update rules and regulations set up at the nest scheduled meeting in January by Ernie Tolos and seconded by Laura iliohlenkamp. A copy of the old rules and regulations is to be distributed P before January meeting. All were in fax-or. Ernie Tolos requested that the Code Enforcement Board Member list be updated. Attorney &chard Taylor advised that that the Negrich property was inspected today by him and could be the biggest c1e.m up in history of city. 4. PUBLIC HEARINGS: Chairman asked for myone who was going to testi6 to be sworn in. A. CEB 00-11-084 Angela J. Diers, Prop. Owner and Richard Clouse, Tenant 102 Mound Street Longwood, FL 32750 City adnsed respondent complied with this case. B. CEB 00-11-085 Ralph E. Locke, Pers. Rep. For Estate of Edward L. Locke 118 Fourteenth St., Longwood, FL 32750 City advised respondent complied with this case. C. CEB 00-11-086 Mark S. and William C. Sussman, Trs. for 614,616 and 618 Vincent Place Longwood, FL 37250 Case continued by city because of no proot of sen-ice. The chairman c;illcd the nest case: D. CEB 00-11-087 Kirk H. and Jo Ellen C. Williams, Prop. Owners of 850 Lyns Dr., Longwood, FL 32750 City advised the case was started in September of 1999. Code Compliance Inspector D.m Spak lett notice at property and nothing mas done. S o hnvardng address for property owners. Tases being paid by mortgage company but no mortgage. City did not hare a respondent to contact. ;\n address was obtained and a letter of sen-sen-ice was sent to property owners in Sanford in September o i 1999. Eventually the yard mas mowed and the case was closed out. A letter was written again because ot a neighbor complaint in October 2000 to the same Sanford address. 'There was no response to the latest notice. A phone number was obtained from someone who had been interested in the house. -3 call was made and a message left. still no response. On 11/11/00 notice of hearing mas sent, no proof of senrice card was received. ;\ phone cd1 was made today and RIr. \irilliams answered. I Ie was told that the case was going before the Board. He advised he could not come to the meeting because he had to work. He was asked to Fa.. a letter advising how long it would take tor the x-iolations to be corrected. 'The city received no letter by fas. No one is living in the house. Several years' hack everything in the house was water damaged and everything in the house nus moved to the garage but nothing has been done with it. There is high grass, pine needles. and brmches and the house looks abandoned. Board attorney Amy Goodblatt advised that there was not good s e n k made and the case needs to be continued. CEB 00-11-088 C & J Towing (Repeat violation) James T. and Lori Jo Ferry 845 Pasadena Avenue Longwood, FL 32750 Code Compliance Inspector D,m Spak advised on 08/22/00 final orders were written. 'Ihe Board heard this case #00-08-071 in August. The final order stated I-\dministrativc costs of S200 and a total fine of S500. The respondent had 45 days to come into compliance and to hme no tow trucks parked in a residential area, by 10/26/00. Board :lttorne); -.hy Goldblatt asked when order was served. Date was not put on by city. Problems with senice date. Sen-ice of order not needed because respondent was found repeat violator. Code Compliance Inspectors did not document what occurred on the property ever)-day. They went by when in the area. Photos introduced as e-dence. On 10/10/00 hvo tow trucks were parked in the driveway. On 1 1 /06/00 a red truck n-as parked beside the housc at 7:01 ,\.A1 and yellow truck on east side ot house. On 11/07/00 the yellow truck was parked across the street from the residence. On 1 1 /13/00 a commercial trailer and a wrecker parked in yard, and wheels with axles in tront yard. On 11/13/00 there \t-ils a truck behind a tence. On 11 /28/00 there was a truck behind a fence. There were heavy tire tracks indicating truck had been there since the weekend. Dan Spak read for tlic record; Land P Dm-elopment Code 24-23.08B it is unlawful for any cornrncrcial vehicles and/or trailer to be parked in residential area other than inside garage with door closed. Rlr. 1;crry testified he was allowed to park a truck for one out of every 24 hours as indicated by Terry I3,nker Director Public Safety. Director Raker also said it mas okay to pxk a truck behind a tence. Mr. Ferry testified his personal vehicle's engine went out and that mas why the tlatbed truck had been parked in his driveway because it was his only means OF transportation. There were heavy tire tracks because he had been going into the backyard and moving things out to another location. Red truck staying behind fence whch had to be behind the centerline of the house and had to be an opaque fence. Mr. Ferry testified that he spoke with Director Baker after Code Compliance Inspector Cathy Price delivered the final notice: hc did not remember the esact date. Fines have not been paid because he does not have the money. Motion made to close public hexing by Ernie Tolos and seconded by 1,aura Molilenkamp. Screening is allowed for regular trailers. boats and R\"s but code does not say a commercial vehicle can be screened behind a fence. Board .ktorney Amy Goodblatt advised the new code does allow one commercial vehicle pcr lot to be screened and was mended in 1999. There is no code that says a commercial vehicle may be parked For 1 hour out ot 24 hours. City -Attorney Kichard Taylor testified that parking a truck for an hour for lunch is not tlie problem. It is commercial use in a residential area that needs to be corrected. It is a neighborhood disturbance. There was a Commission meeting involving relaxing the law to accommodate commercial vehicles. ;ittorncy 'l'aylor advised the Board not to take action tonight. Board Attorney Amy Goodblatt pointed out this is a second violation. 1:rnie 'I'olos advised that the case was heard at the \lay 1999 board p meeting and Mr. 1;ert-y was found in violation .and given finc and 45 days at th;lt time.
