Ordinance 11-1959 ORDINANCE, NO. I1 -459 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, ADDING SECTION 9O- 32(A)(5) WAIVER OF SEWER CONNECTION REQUIREMENT, PROV EYC FOR CONFLICTS AND SEVERABI LITY AND AN EFFECTIVE DATE. Whereas, the City of Longwood has codified mandatory sewer connection requirements in Section 90 -32 of the Code of Ordinances for the City of Longwood, and Whereas, the City of Longwood is desirous of enhancing development opportunities, and Whereas, the provision of a waiver process for Sub - Section 90 -32(a) regarding Sewer Connection Requirements serves public interest and would not conflict with the goals, objectives or policies of the City's Comprehensive Plan; NOW, THEREFORE, BE IT ORDAINED BY TEE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: Approves the inclusion of Section 90 -32 (a)(5) Waiver of Sewer Connection Requirement. The City Commission may, upon a finding of extraordinary circumstances waive or extend the requirements of Sub- Section 90- 32(a). To request a waiver, or an extension an a..licant must submit a request accom.anied b applicable fees and any additional information that may be required, along with a written justification for the requested waiver or extension to the City Engineer. Such request shall be placed on the B enda for review by the City Commission within 30 days of receipt of a complete request. The Commission shall have the right to impose conditions including the assessment of fees on an waiver /extension _ranted so as to better meet the intent and spirit of the City Code. Ordinance No. 11 -1959 Section 2: All Ordinances or parts of Ordinances herewith, be and the same, are hereby repealed to the extent of such conflict Section 3: If any section, paragraph, sentence or word of this Ordinance or the application thereof to any person or circumstances are held to be invalid, that invalidity shall not effect other sections or applications of this Ordinance. Section 4: This Ordinance shall be in force and take effect immediately upon adoption.
