Ordinance 11-1960 ORDINANCE NO. 11 -1960 AN ORDINANCE OF TILE CITY OF LONGWOOD, FLORIDA, AMENDING CHAPTER 30, ELECTION, SECTION 30 -12, EARLY VOTING; PROVIDING FOR EARLY VOTING AND DATES FOR EARLY VOTING FOR THE MUNICIPAL ELECTION IN 2011; PROVIDING FOR CONFLICTS, SEVERADILITV, AN EFFECTIVE DATE. WHEREAS, the City Clerk has met with the Seminole County Supervisor of Elections and has deemed it necessary to update Chapter 30, Election of the City Code; and WI-IEREAS, § 101.657(1)(e), Florida Statutes, allows the City of Longwood to exempt itself from the statutory early voting requirements of § 101.657 and specially provide for early voting in its municipal elections that are not held in conjunction with county or state elections; and REAS, the City's upcoming 2011 election will not be held in conjunction with any other county or state elections; and WHEREAS, the City of Longwood desires to conduct early voting at the Office of the Supervisor of Elections and establish a timeframe to conduct early voting for the City's election in 2011; and WHEREAS, this Ordinance establishes the dates, times, and location for Early Voting to be conducted for the November 8, 2011 General Election only. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Section 2, Chapter 30, Elections, Section 30 -12, Early Voting, of the Longwood City Code shall be amended to read as follows: Insert Delete The City hereby exercises its right pursuant to § 101.657(1)(e), Fla. Stat., to exempt itself from the statutory early voting provisions of F.S. 101.657, and shall specially contract with the Seminole County Supervisor of Elections to conduct early voting for the City at the Office of the Supervisor of Elections. In addition to the regular voting date, the following are early voting days: City of Longwood Ordinance No. 11- 1960 Page 1 of 2 Friday, G-et -eh 30 November 4 from 10:00 a.m. until 6:00 p.m. Saturday, Octo -h-er- 31 November 5 from 12:00 p.m. until 4:00 p.m. Sunday, Nev€m e- � 4 November 6 from 12:00 p.m. until 4:00 p.m. This provision shall only apply to the election of November 2909 2011 unless readopted by the City Commission. Section 3. Conflicts. To the extent that this ordinance may conflict with any existing ordinance or part thereof, this ordinance shall control to the extent that such conflict exists. Section 4. Severability. If any provisions of this ordinance or the application thereof to any person or circumstances are held invalid, the invalidity shall not affect other provisions or applications of the ordinance which can be given effect without invalid provision or application, and to this end, the provisions of this ordinance are declared severable. Section 5. Codification. Section 2 of this Ordinance shall be codified and made a part of the Longwood Code of Ordinances, and the Sections and subsections of this Ordinance may be renumbered or relettered to accomplish such intention (e.g. the word "Ordinance" may be changed to "Section ", "Article ", or other appropriate word). Section 6. Effective Date. This ordinance shall take effect immediately upon its adoption by the City Commission of the City of Longwood, Florida.
