AN ORDINANCE OF THE CITY OF LONGWOOD,
FLORIDA, VACATING AND ABANDONING THAT
PORTION OF EXISTING RIGHT -OF -WAY FOR NORTH
OLEANDER STREET (A /K /A OLEANDER AVENUE)
LYING NORTH OF THE NORTHERLY RIGHT -OF -WAY
LINE OF ORANGE AVENUE, PROVIDING FOR
CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, the applicant, Orange Crown Transit Partners, LLC, have petitioned the
City to vacate, close, abandon and discontinue, disclaim and renounce any interest in the real
property described below and depicted in EXHIBIT A; and
WHEREAS, said subject property is located in the City of Longwood, and
WHEREAS, the vacating of the subject property in its entirety to the applicant is within
the public interest and would not conflict with the goals, objectives or policies of the City's
Comprehensive Plan;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF LONGWOOD, FLORIDA, AS FOLLOWS:
SECTION 1: The land depicted in EXHIBIT A is hereby permanently vacated, closed
and abandoned by the City of Longwood and is hereby transferred in its entirety to the applicant
as the sole owner of real property adjacent to said land, subject to the City's reservation of a
perpetual drainage easement over, under and through said land depicted in EXHIBIT A. The
City Administrator shall have the authority to release, in whole or part, the City's perpetual
drainage easement reserved herein by executing and recording a notice of release of drainage
easement in the Seminole County Public Records referencing this Ordinance, in the event that
during the development review and approval process concerning the development of applicant' s
real property, the City Administrator determines to his /her satisfaction that the drainage
easement reserved herein is no longer needed due to drainage issues and concerns being
addressed by alterative means; by way of example, but not limitation, such alternative means of
addressing drainage issues may include the granting of a drainage easement to the City in an
alternate location.
SECTION 2: All Ordinances, or parts of Ordinances herewith, be and the same, are
hereby repealed to the extent of such conflict.
SECTION 3: If any section, paragraph, sentence or word of this Ordinance or the
application thereof to any person or circumstance not held to be invalid, that invalidity shall not
effect other sections or words or applications of this Ordinance.

SECTION 4: This Ordinance shall be in force and take effect immediately upon
adoption.

That portion of existing right of way for Oleander Street lying between the following two parcels
and bounded on the South by the Northerly right of way line of Orange Avenue and on the North
by the Easterly and Westerly extensions of the North lines of said parcels, being more
particularly described as follows:
The North 339.9 feet of the West 50 feet of the East 1060 feet of the Southwest 1/4 together with
the North 489.9 feet of the Southwest 1/4 East of Oleander Avenue (LESS the East 1060 feet)
lying and being in Section 32, Township 20 South, Range 30 East, Seminole County, Florida
AND
That part of the East 283 feet of the North 489.9 feet of the Southwest 1/4 of Section 32,
Township 20 South, Range 30 East, lying North of Orange Avenue, West of Oleander Avenue
and East of the Railroad right -of -way, Seminole County, Florida.
