CALL MEETING TO ORDER: Special Magistrate Goodblatt called the meeting to order at 7pm. 2. APPROVAL OF THE MINUTES FROM THE JANUARY 27, 2011 HEARING: Special Magistrate Goodblatt approved the Minutes from the January 27, 2011 Code Enforcement Hearing. 3. SPECIAL MAGISTRATES'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees. • 4. SWEARING IN OF ALL WITNESSES: Special Magistrate Goodblatt swore in all witnesses. 5. ROLL CALL OF SCHEDULED CASES: Special Magistrate Goodblatt called off the scheduled cases to determine which Respondents were present. 6. PUBLIC HEARINGS: C. CEH 11 -04 -808 LDC, Art. X, Sec. 10.1.0 Building Permit Continued KELLER, Patricia and MOSCOSO, Thomas 575 Preston Road Longwood, FL 32750 CEB 04- 28 -11 -1 F. CEH 11 -04 -811 LDC, Art. VI, Sec. 6.2.2(D) Sign Requirments Withdrawn WESTLAKE PROPERTY GROUP INC / Verizon Wireless, Adam Vest 268 W. SR 434 Longwood, FL 32750 G. CEH 11 -04 -812 LDC, Art. VI, Sec. 6.2.2(D) Sign Requirements TOWNSHIP PLAZA ASSOC. LTD / Metro PCS, Mohammad Moswade 1018 W. SR 434 Longwood, FL 32750 Code Enforcement Officer Howington introduced herself and presented her case. She gave testimony that a Notice of Violation for LDC, Art. VI, Sec. 6.2.2(D) Sign Requirements was issued on 02/23/11 to comply immediately due to the number of previous violations for this code. A reinspection later in the day found violation had been corrected however on 03/05/11, Code Enforcement Officer Winters observed another temporary sign violation and it was then scheduled for the Code Enforcement Hearing. A Notice of Hearing was issued on 03/31/11 and served via personal service on the tenant on 04/02/11. A Notice of Hearing was also mailed via Certified Mail to the property owner on 04/01/11 and was signed for on 04/08/11. The City requested that the Respondents be found guilty of violating LDC, Art. VI, Sec. 6.2.2(D) Sign Requirements and that an administrative fine of $300.00 be assessed to be paid within 30 days from date of service of Final Orders; no fine requested as the property is currently in compliance. Code Officer Howington answered questions posed by Special Magistrate Goodblatt. Barry Revels, representative for the property owner, and Mohammad Maswady, tenant, then spoke in reference to this violation and answered questions from Special Magistrate Goodblatt. Special Magistrate Goodblatt made her findings of fact and found the respondents guilty of violating LDC, Art. VI, Sec. 6.2.2(D) Sign Requirements and ordered a $300.00 administrative cost to be paid, jointly and severely, within 30 days from service of the Final Orders. E. CEH 11 -04 -810 LDC, Art. VI, Sec. 6.6.1(A) (1) Sign Requirements CAMPBELL, Beverly Trustee FBO / Precious Fine Jewelers, Nishant Bajaria 185 S. CR 427 Longwood, FL 32750 Code Enforcement Officer Howington introduced herself and presented her case. She gave testimony that a Notice of Violation for LDC, Art. VI, Sec. 6.6.1(A)(1); LDC, Art. VI, Sec. 6.2.2(D); LDC, Art. VI, Sec. 6.1.4; and CC, Chap. 78, Sec. 78 -1 Sign Requirements & Maintenance, was issued on 02/18/11 to comply immediately due to the number of previous violations for this code. A reinspection on 03/26/11 showed the property still not in compliance and it was then scheduled for the Code Enforcement Hearing. A Notice of Hearing was issued on 03/31/11 and served via personal service on the property owner on 04/05/11 and on the tenant on 04/06/11. The City requested that the Respondents be found guilty of violating LDC, Art. VI, Sec. 6.6.1(A)(1); LDC, Art. VI, Sec. 6.2.2(D); LDC, Art. VI, CEB 04- 28 -11 -2 • Sec. 6.1.4; and CC, Chap. 78, Sec. 78 -1 Sign Requirements & Maintenance, and that an administrative fine of $300.00 be assessed to be paid within 30 days from date of service of Final Orders; no fine requested as the property is currently in compliance. Code Officer Howington answered questions posed by Special Magistrate Goodblatt and tenant Nishant Bajaria. Beverly Campbell, respondent property owner, and Nishant Bajaria, tenant, then spoke in reference to this violation. Special Magistrate Goodblatt made her findings of fact and found the respondents, jointly and severely, guilty of violating LDC, Art. VI, Sec. 6.6.1(A)(1) and CC, Chap. 78, Sec. 78 -1 Sign Requirements & Maintenance and assessed a $200.00 administrative cost to be paid within 30 days from service of the Final Orders. A. CEH 11 -04 -806 LDC, Art. X, Sec. 10.1.0 Building Permit FAIRLAND DEVELOPMENT & INVESTMENT CORP, INC 131 Glendale Drive Longwood, FL 32750 Code Enforcement Officer Howington introduced herself and presented her case. She gave testimony that she received an email on 02/17/11 stating that a Stop Work Order was issued for work without a permit however a permit had never been applied for. Therefore she issued a Notice of Violation for LDC, Art. X, Sec. 10.1.0 Building Permit on 02/18/11 to comply/ by 02/25/11. A reinspection on 03/06/11 showed the property still not in compliance so a Notice of Non - Compliance was issued to comply by 03/10/11. Upon further inspection on 03/26/11, the property was still not in compliance and it was then scheduled for the Code Enforcement Hearing. A Notice of Hearing was issued on 03/31/11 and mailed certified to property owner however it was never claimed therefore Officer Howington mailed a copy First Class and posted the property and City Hall on 04/15/11. The City requested that the Respondent be found guilty of violating LDC, Art. X, Sec. 10.1.0 Building Permit and that they be given 5 days upon service of Final Orders to comply or a $100.00 per day fine be imposed. The City also requests an administrative fine of $300.00 be assessed to be paid within 30 days from date of service of Final Orders. Bob Pike, building inspector for the City of Longwood, spoke in reference to this case and answered questions from Special Magistrate Goodblatt. No respondent present at the hearing. Special Magistrate Goodblatt made her findings of fact and found the respondent guilty of violating LDC, Art. X, Sec. 10.1.0 Building Permit and gave them 30 days to come into compliance or a $10.00 per day fine will be imposed. She also assessed a $100.00 administrative cost to be paid within 30 days from service of the Final Orders. At 7:58pm, Special Magistrate Goodblatt recessed for 3 minutes. B. CEH 11 -04 -807 LDC, Art. VI, Sec. 6.3.3 Sign Requirements IPK INC. 905 Longwood Hills Road CEB 04- 28 -11 -3 Longwood, FL 32750 Code Enforcement Officer Howington introduced herself and presented her case. She gave testimony that she issued a Notice of Violation for LDC, Art. VI, Sec. 6.3.3 Sign Requirements on 02/07/11 to comply immediately due to the number of previous violations of this code. A reinspection on 03/07/11 showed the property still not in compliance and it was then scheduled for the Code Enforcement Hearing. A Notice of Hearing was issued on 03/31/11 and mailed certified to property owner and claimed on 04/06/11. The City requested that the Respondent be found guilty of violating LDC, Art. VI, Sec. 6.3.3 Sign Requirements and that an administrative fine of $300.00 be assessed to be paid within 30 days from date of service of Final Orders; no fine requested as the property is currently in compliance. Dave Mickelsen, registered agent / owner of IPK Inc., spoke in reference to this case and answered questions from Special Magistrate Goodblatt. Special Magistrate Goodblatt made her findings of fact and found the respondent guilty of violating LDC, Art. VI, Sec. 6.3.3 Sign Requirements and assessed a $75.00 administrative cost to be paid within 45 days from service of the Final Orders. D. CEH 11 -04 -809 CC, Chap. 38, Sec. 38 -121 Trash, Debris & Junk RAMNARINE, Bickram 300 E. Orange Avenue Longwood, FL 32750 Code Enforcement Officer Winters introduced herself and presented her case. She gave testimony that she issued a Notice of Violation for CC, Chap. 38, Sec. 38 -121 Trash, Debris & Junk on 02/24/11 to comply by 03/03/11. A reinspection on 03/09/11 showed the property not in compliance so a Notice of Non - Compliance was issued to comply by 03/14/11. Upon further inspection on 03/14/11 the property was still not in compliance and it was then scheduled for the Code Enforcement Hearing. A Notice of Hearing was issued on 03/29/11 and personal service was made on the property owner on 04/05/11. The City requested that the Respondent be found guilty of violating CC, Chap. 38, Sec. 38 -121 Trash, Debris & Junk and that they be given 10 days upon service of Final Orders to comply or a $150.00 per day fine be imposed. The City also requests an administrative fine of $350.00 be assessed to be paid within 30 days from date of service of Final Orders. No respondent present at the hearing. Special Magistrate Goodblatt made her findings of fact and found the respondent guilty of violating CC, Chap. 38, Sec. 38 -121 Trash, Debris & Junk and gave him 15 days to come into compliance or a $150.00 per day fine will be imposed. She also assessed a $250.00 administrative cost to be paid within 30 days from service of the Final Orders. 7. REPORTS -CASE UPDATES: None 8. UNFINISHED BUSINESS: None. CEB 04- 28 -11 -4 9. OLD BUSINESS: None. 10. NEW BUSINESS: A. Elisa Gwilliam (broker for 900 Wildmere Ave, #05 -03 -447) requested to come before the Special Magistrate to ask for a reduction in fines and administrative costs which total $21,000.00 for Trash & Debris and $35,700.00 for High Grass & Weeds. She stated the property is currently owned by Aqua Loan Servicing Company and that an offer is pending. After answering questions from Special Magistrate Goodblatt, Ms. Gwilliam requested the fines be reduced to $3,000.00 to be paid within 30 days; the City offered no objection. Special Magistrate Goodblatt ruled to reduce the fines to $3,000.00 and stated the fines would revert to their full amount if payment is not made within 30 days of tonight's hearing. B. Don Wall (listing agent for 1515 Oriole St, #08 -04 -710) requested to come before the Special Magistrate to ask for a reduction in fines and administrative costs which total $71,785.00 for 3 separate High Grass & Weeds violation. He apologized for not honoring the previous reduction agreement and stated the property is due to close as soon as this matter has been settled. After answering questions from Special Magistrate Goodblatt, Mr. Wall requested the fines be reduced to $3,000.00 and that a check could be overnighted as soon as the Order to Reduce is received; the City offered no objection. Special Magistrate Goodblatt ruled to reduce the fines to $3,000.00 and stated the fines would revert to their full amount if payment is not made within 14 days of date of service of Order to Reduce. She also ruled that_a 3rd request to reduce would not be entertained if the 14 day payment deadline was not met. 11.
