A RESOLUTION OF THE CITY OF LONGWOOD, FLORIDA,
DESIGNATING THE SHADED AREAS ON THE MAP EXHIBIT A AS
THE LONGWOOD ECONOMIC ENHANCEMENT PROGRAM (LEEP)
AREAS AND DESIGNATING THE LONGWOOD ECONOMIC
ENHANCEMENT PROGRAM (LEEP) AREA AS A BROWNFIELD AREA
FOR THE PURPOSE OF ECONOMIC DEVELOPMENT AND
ENVIRONMENTAL REMEDIATION AND REHABILITATION.
WHEREAS, the State of Florida has provided in Ch. 97-277, Laws of Florida, codified
as Sections 376.77-376.85, as amended, Florida Statutes, for the designation by resolution of
certain areas as Brownfield Areas, and for the corresponding provision, of environmental
remediation, rehabilitation and economic development for such area; and
WHEREAS, the Longwood City Commission has reviewed the requirements for
Brownfield Area designation, as specified in Florida Statutes Sections' 376.80(2)(a) and
376.80(2)(b), and has determined that the proposed areas qualify for designation as Brownfield
Areas because the following requirements of Florida Statutes Sections 376.80(2)(a) and
376.80(2)(b) have been met:
1. The Brownfield Areas depicted in Exhibit A are determined to warrant economic
development and have a reasonable potential for such activities through rehabilitation and job
creation.
2. The Brownfield Areas depicted in Exhibit A represent a reasonably focused
approach and is not overly large in geographic coverage.
3. The rehabilitation and economic development of the Brownfield Areas depicted in
Exhibit A are deemed to have sufficient private sector interest in rehabilitating the area.
4. The area contains sites or parts of sites that may be suitable for limited
recreational open space, cultural, or historical preservation purposes and;
WHEREAS, the City of Longwood wishes to notify the Florida Department of
Environmental Protection of its decision to designate certain Brownfield areas for remediation,
rehabilitation, and economic development for the purposes set forth in Sections 376.77 - 376.85,
as amended, Florida Statutes; and

WHEREAS, public hearings have been held on June 20, 2011 and July 18, 2011, in
accordance with the procedures set forth in Section 166.041, Florida Statutes, and proper notice
has been provided in the Orlando Sentinel on June 9, 2011 and July 7, 201 1,in accordance with
Sections 376.80(1), 376.80(2)(a), and 166.041(3)(c)2, Florida Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF LONGWOOD, FLORIDA, that:
Section I: The recitals and findings set forth in the Preamble to this Resolution are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section II: The areas described on Exhibit "A," attached hereto and incorporated herein by
reference, is hereby designated as Brownfield Areas for environmental remediation,
rehabilitation and economic development for the purposes as set forth in Sections 376.77-376.85,
Florida Statutes, under the following terms and conditions:
a. The designation of the Brownfield Areas by this resolution shalljnot render the City
of Longwood liable for costs of site remediation, rehabilitation and economic
development or source removal, as those terms are defined in Sections 376.79(17)
and (18), Florida Statutes, or for any other costs and expenses that may arise or be
incurred in the rehabilitation, development, and redevelopment of such Areas.
b. Nothing contained in this Resolution shall be deemed to prohibit, limit or amend
the authority and power of the City of Longwood, otherwise legally available, to
designate any other property or properties as a Brownfield site ;or Brownfield area
or to modify, amend or withdraw the designation as set out herein.
C. The Brownfield Area designation depicted on Exhibit A, attached hereto and
incorporated herein, shall be referred to as the "Longwood Economic Enhancement
Program" (LEEP) for the purposes of administering economic development aspects
of the Brownfield program.
d. After adoption of this Resolution, property owners may request inclusion into or to
opt out of the LEEP by submitting an application and any additional required
information for the annual LEEP amendment cycle to, the Community

Development Services Director by July 1 of each year. There .is no charge for
applications processed during the annual amendment cycle.
e. Property owners requesting inclusion into or to opt out of the LEEP outside the
annual LEEP amendment cycle described in Section II(d) shall be responsible for
the expense associated with this process including but not limited to an application
fee of $200.00 plus the cost of the notification and advertisement of the required
public hearings.
Section III: The Mayor of the City of Longwood is hereby authorized to make, execute, and
deliver to the State of Florida Department of Environmental Protection, pursuant to Section
376.80, Florida Statutes, of the City 'of Longwood's decision to designate Brownfield Areas for
remediation, rehabilitation and economic development for the purposes set forth in Sections
376.77-376.85, as amended, Florida Statutes.
Section IV: This resolution shall become effective immediately upon adoption.
