1. CALL MEETING TO ORDER:
Special Magistrate Goodblatt called the meeting to order at 7pm.
2. APPROVAL OF THE MINUTES FROM THE APRIL ;28, 2011 HEARING:
Special Magistrate Goodblatt approved the Minutes from the April 28, 2011 Code
Enforcement Hearing.
3. SPECIAL MAGISTRATES'S EXPLANATION OF PROCEEDINGS:
Special Magistrate Goodblatt explained the hearing process for the attendees.
4. SWEARING IN OF ALL WITNESSES:
Special Magistrate Goodblatt swore in all witnesses.
5. ROLL CALL OF SCHEDULED CASES:
Special Magistrate Goodblatt called off the scheduled cases to determine which Respondents
were present.

Code Enforcement Officer Howington introduced herself and presented her case. She gave

estimony that she issued a Notice of Violation for CG, Chap. 86, Sec. 36 --54 Storage of.
Inoperable Vehicle on 04/09/11 to comply by 04/14/11. A reinspection.or , 041 showed
the property not in compliance and it was then scheduled for the Code Enforcement Hearing
due to numerous, previous violations for CC, Chap. 86, Sec. 86 -54 Storage of Inoperable
Vehicle. A Notice of Hearing was issued on 05/09/11 and personal service.was made on the
property manager on 05/11/11. A Notice of Hearing was also mailed to.the property ownE!r'
via certified mail on 05/11/11 and signed for by the property owner on-0,5/16/11. The .City
requested that the Respondent be found guilty of violating CC, Chap. 86, Sec. 86 -54 Storage .
of Inoperable Vehicle and that they be given 5 days upon service of Final Orders to comply or
a $250.00 per day fine be imposed. The City also requests an administrative fine of $350.00
be assessed to be paid within 30 days from date of service of Final Orders.
Marti Gladieux, Property Manager, spoke in reference to this violation and answered
questions from Atty. Goodblatt.
Elliott Grafton, Tenant, also spoke in reference to this violation and answered questions from
Atty. Goodblatt.
Special Magistrate Goodblatt made her findings of fact and found the respondent guilty of
violating CC, Chap. 86, Sec. 86 -54 Storage of Inoperable Vehicle and gave. her 15 days to
come into compliance or a $150.00 per day fine will be imposed_ She also assessed a

Code Enforcement Officer Howington introduced herself and presented, her case. She gave
testimony that this case began in October 2009 due to an overhang structure being
constructed without a permit. A Notice of Violation for LDC, Art. X, Sec; 10.1.0 Building
Permit was issued on 10/14/09 and a building permit was applied for on 12/02/09 howevE.r it
was denied. The Respondents then applied for, and were approved, a variance so the permit
was issued on 04/27/10 however the inspection failed and the permit subsequently expired
on 10/27/10. A new Notice of Violation for LDC, Art. X, Sec, 10.1.0 Building Permit .was
issued on 02/18/11 to comply by 02/28/11. A reinspection on 03/031 showed the property
not in compliance so a Notice of Non - Compliance was issued to comply by 03/07/11. Upon
further review of the case, it was determined that Code Officer I-lowington. issue new Noiiice
of Violation far LDC, Art. X, Sec. 10.1.0 Building Permit as well as �BG, Art. 105, Sec. 105.4
Conditions of a Permit; she did so on 04/15/11 to comply by 07/29/11. Upon inspection o►i
05/02/11, a permit still had not been obtained so a Notice of Non - Compliance was issued - to .
comply by 05/06/11. Upon further inspection on 05/11/11 the property was still not in
compliance and it was then scheduled for the Code Enforcement Hearing. A Notice of

- Hearing was issued on 05/11/11 and personal service was made on the property owner on
05/12/11. The City requested that the Respondents be found guilty.of.violating LDC, Art. X,
Sec. 10.1.0 Building Permit & FBC, Art. 105, Sec. 105.4 Conditions of a Permit and that they
be given 10 days upon service of Final Orders to remove the structure or a. $50.00. per
fine be imposed. 'The City also requests an administrative fine of $350.00 be assessed to be
paid within 30 days from date of service of Final. Orders.
Patricia Keller and Thomas Moscosco,, property owners, then spoke in reference to this case
and answered questions from Atty. Goodblatt.
Bob Pike, building official, also spoke in reference_ to this case and answered questions from
Atty. Goodblatt and Ms. Keller.
Special Magistrate Goodblatt made her findings of fast and found the respondents guilty of
violating LDC, Art. X, Sec. 10. 1.0 Building Permit & FBC, Art. 105, Sec � 105.4 Conditions of a
Permit and gave. them 15 days to remove the structure or a $50.00 per day fine will be
imposed. She also assessed a $150.00 administrative cost to be paid within 60 days from
service of the Final Orders. It was further stated that the City would not require a demolition
permit for the overhang to be removed as long as it was stored properly..

A. Code Enforcement Officer Winters has requested the 06/23/11 Code Enforcement
Hearing be cancelled or rescheduled as both code officers will be out of town in training.
It was determined the meeting would be cancelled and the next scheduled meeting would
be 07/28/11.
11. ADJOURNMENT:
Special Magistrate Goodblatt adjourned the meeting at 8pm.
