1. CALL MEETING TO ORDER:
Special Magistrate Goodblatt called the meeting to order at 7:00 p.m.
2. APPROVAL OF THE MINUTES FROM THE MAY 26, 2011 HEARING:
Special Magistrate Goodblatt made a correction to the May 26, 2011 minutes.
On the second page, case B (CEH 11 -05 -813) the administrative cost of $200.00
needed to be changed to $300.00 and was paid. With Special Magistrate
Goodblatt's approval, the recording secretary's name was also changed from
Collina Gast to Brittany Kidd. Special Magistrate Goodblatt then signed and
approved the Minutes from the May 26, 2011 Code Enforcement Hearing.
3. SPECIAL MAGISTRATES' EXPLANATION OF PROCEEDINGS:
Special Magistrate Goodblatt explained the hearing process for the attendees.
4. SWEARING IN OF ALL WITNESSES:
Special Magistrate Goodblatt swore in all witnesses.

6. PUBLIC HEARINGS:
A. CEH 11 -08 -815 CC, Chap. 86, 86 -82 Commercial Vehicle Parking
CC, Chap. 86, 86 -83 Boats, Trailers and Recreational
Vehicle (RV) Parking

Code Enforcement Officer Howington introduced herself and presented her case.
She gave testimony that she issued a Notice of Violation for CC, Chap. 86, 86 -82
Commercial Vehicle Parking and CC, Chap. 86, 86 -83 Boats, Trailers and
Recreational Vehicle (RV) Parking on 05/01/11 to comply by 05/02/11. Multiple
re- inspections on 05/24/11, 06/14/11, 07/17/11, 07/18/11, 07/22/11 and
08/03/11 showed that compliance was not met. A Notice of Hearing was served
on Michelle Kelson on 09/12/11 by Code Officer Howington. An Affidavit of
Service was completed and placed in the file. The City requested that the
Respondent be found guilty of violating CC, Chap. 86, 86 -82 Commercial Vehicle
Parking and CC, Chap. 86, 86 -83 Boats, Trailers and Recreational Vehicle (RV)
Parking and be brought into compliance within 5 days. The City is also requesting
that if the violations are not brought into compliance, a fine be issued of $100.00
per day for each day until the violations come into compliance, to include an
administrative fee of $350.00 to be paid within 30 days from the date of the
receipt of Final Orders. If the Respondent is found guilty, the City would like for
them to be advised that if they choose to violate again, they will be citied as
repeat violators.
Mark Campbell, Property Owner, spoke in reference to these violations and
answered questions from Attorney Goodblatt. Mr. Campbell also asked for a
continuance.
Special Magistrate Goodblatt granted a one month continuance to Mr. Campbell
and advised him to bring in any witnesses or evidence to support his position.
The City is to consult with legal counsel as to whether the words on the truck
constitute a Public Service Announcement, and if so, does a PSA exempt the
truck from CC 86 -82?

CEH 11 -05 -814 (820 West State Road 434) is withdrawn /complied.

Special Magistrate Goodblatt advised the November Code Enforcement Hearing
will be held on November 17, 2011 due to the observance of the Thanksgiving
holiday.

Special Magistrate Goodblatt adjourned the meeting at 7:30 p.m.
