Ordinance 11-1979 ORDINANCE NO. 11 -1979 AN ORDINANCE OF THE CITY OF LONGWOOD,. FLORIDA,. TRANSMITTING AND ADOPTING AN ADMINISTRATIVE AMENDMENT TO THE COMPREHENSIVE PLAN FOR THE PURPOSE. OF UPDATING THE FIVE -YEAR CAPITAL IMPROVEMENTS PROGRAM; PROVIDING FOR CONFLICT AND SEVERABLLITY AND PROVIDING FOR AN EFFECTIVE DATE, WHEREAS, Section 163.3177, Florida Statutes requires that local governments adopt an annual update to the five -year schedule of capital improvements as part of the Capital Improvements Element of the Comprehensive Plan; and WHEREAS, the Five -Year Capital Improvements Program ( "CIP ") serves as a companion to the Comprehensive Plan and the Capital Improvements Element ( "CIE ") of the Comprehensive Plan, by linking capital expenditures with the adopted public policy; and WHEREAS, the City of Longwood has adopted a five year capital project plan as a part of the 2011 -2012 Fiscal Year Budget; and WHEREAS, the City of Longwood has held a public hearing subject to Section 163.3184, Florida Statutes; NOW, THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1 : This ordinance is adopted in conformity with and pursuant to Chapter 163, Florida. Statutes.. SECTION 2 : The Capital Improvements Element of the City of Longwood Comprehensive; Plan is hereby amended to .include the five year schedule of capital improvements, set forth in ORDINANCE 11 -1979 Page 1 of 3 Exhibit A, attached hereto and made a part hereof. SECTION 3 : The Longwood City Commission hereby authorizes the appropriate City officials to submit this Ordinance to the State Department of Economic Opportunity and to any other governmental agency having jurisdiction with regard to the approval of same in accordance with and pursuant to Chapter 163, Florida Statutes. SECTION 4 : The provisions of this Ordinance are declared to be separable and if an.y section, paragraph, sentence or word of this Ordinance or the application thereto any person or circumstance is held invalid, that invalidity shall not affect other sections or words or applications of this Ordinance. If any part of this Ordinance is found to be preempted or otherwise superseded, the remainder shall nevertheless be given full force and effect to the extent permitted by the severance of such preempted or superseded part. SECTION 5 : This Ordinance shall take effect immediately upon its adoption.
