A RESOLUTION OF THE CITY COMMISSION OF
LONGWOOD, FLORIDA RELATING TO THE
CONSTRUCTION AND MAINTENANCE OF THE
SHADOW HILL LOCAL IMPROVEMENTS; CREATING
THE SHADOW HILL CAPITAL AND MAINTENANCE
ASSESSMENT AREA; IMPOSING SPECIAL
ASSESSMENTS AND ESTABLISHING THE MAXIMUM
ANNUAL AMOUNT FOR EACH TAX PARCEL;
APPROVING THE ASSES SMENT ROLL; PROVIDING FOR
COLLECTION OF THE ASSESSMENTS; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Longwood, Florida (the "City
Commission") enacted Ordinance No. 01-1574 on June 18, 2001, as amended and
supplemented by Ordinance No. 04-1701, enacted by the City Commission on July 19, 2004
(collectively, the "Ordinance") to provide for the imposition of special assessments to fund
(1) the construction of Local Improvements to benefit real property located in proposed
special assessment areas, and (2) the cost of maintaining such Local Improvements; and
WHET-EAS, on August 6, 2012, the City Commission adopted Resolution No. 12-
1315 (the "Initial Assessment Resolution"), proposing the creation of the Shadow Hill
Capital and Maintenance Assessment Area and describing the method of assessing the
Capital Cost and the Maintenance Cost of the Shadow Hill. Local Improvements (as defined
therein) against the real property that will be specially benefited thereby, and directing
preparation of the tentative Capital Assessment Roll, tentative Maintenance Assessment Roll
and the provision of the notices required by the Ordinance; and
WHEREAS, pursuant to the provisions of the Ordinance, the City Commission is
required to confirm or repeal the Initial Assessment Resolution, with such amendments as the
City Commission deems appropriate, after hearing comments and receiving objections of all
interested parties; and
WHEREAS, the Assessment Roll has heretofore been filed at City Hall, as required
by the Initial Assessment Resolution; and
WHEREAS, as required by the terms of the Ordinance, notice of a public hearing has
been. published and mailed to each real property owner proposed to be assessed notifying
such real property owner of the opportunity to be heard; the proof of publication and an
affidavit of mailing are attached hereto as APPENDICES B and C respectively; and
WHEREAS, a public hearing has been duly held on September 4, 2012 and was duly
continued until September 17, 2012 in order to ensure adequate notice of the public hearing
pursuant to the Uniform Assessment Collection Act; and
WHEREAS, comments and objections of all interested persons were heard and
considered on September 4, 2012, and will be heard and considered on September 17, 2012,
as required by the terms of the Ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE, CITY OF 1LONGWOOD, FLORIDA, AS FOLLOWS:
SECTION I, AUTHORITY. This Resolution is adopted pursuant to the
Ordinance, Chapter 166, Florida Statutes, and other applicable provisions of law.

SECTION 2. DEFINITIONS. This Resolution is the Final Assessment
Resolution as defined in the Initial Assessment Resolution. All capitalized terms in this
Resolution shall have the meanings defined in the Ordinance and the Initial Assessment
Resolution.
SECTION 3. CREATION OF THE ASSESSMENT AREA. The Shadow
Hill Capital and Maintenance Assessment Area is hereby created to include the Tax Parcels
described in APPENDIX A hereto. The Shadow Hill Capital and Maintenance Assessment
Area. is created for the purpose of enhancing the use and enjoyment of real property located
therein by funding the Project Cost and Maintenance of the Shadow Hill Local
Improvements.
SECTION 4. CONFIRMATION OF INITIAL ASSESSMENT
RESOLUTION. The Initial Assessment Resolution is hereby confirmed.
SECTION 5. APPROVAL OF CAPITAL ASSESSMENT ROLL AND
MAINTENANCE ASSESSMENT ROLL. The Capital Assessment Roll and Maintenance
Assessment Roll, copies of which are attached hereto in APPENDIX A, are hereby approved.
SECTION 6. CAPITAL AND MAINTENANCE ASSESSMENTS. _
(A) The Tax Parcels described in the Capital Assessment Roll are hereby found to
be specially benefited by the construction of the Shadow Hill Local Improvements in the
amount of the maximum annual Capital Assessment set forth in the Capital Assessment Roll.
The methodology for computing annual Capital Assessments described in the Initial
Assessment Resolution is hereby approved. Annual Capital Assessments computed in the

manner described in the Initial Assessment Resolution are hereby levied and imposed on all
Tax Parcels described in the Capital Assessment Roll. Tax Parcels located in the Shadow
Hill Capital and Maintenance Assessment Area shall have a maximum annual Capital
Assessment rate of $22.00 per Platted Lot, commencing with the tax bill mailed in October or
November 2012. The resulting Initial Prepayment. Amount is $220.00 per Platted Lot.
(B) The Tax Parcels described in the Maintenance Assessment Roll are hereby
found to be specially benefited by the Maintenance of the Shadow Dill Local Improvements
in the amount of the maximum annual Maintenance Assessment set forth in the Maintenance
Assessment Roll. The methodology for computing annual Maintenance Assessments
described in the Initial Assessment Resolution is hereby approved. Annual Maintenance
Assessments computed in the manner described in the Initial Assessment Resolution are
hereby levied and imposed on all Tax Parcels described in the Maintenance Assessment Roll.
Tax Parcels located in the Shadow Hill Capital and Maintenance Assessment Area shall have
a maximum annual Maintenance Assessment rate of $105.04 per Platted Lot, commencing
with the tax bill mailed in October or November 2012.
(C) Upon adoption of this Resolution and the Annual Assessment Resolution for
each subsequent Fiscal Year:
(1) The annual Assessments shall constitute a lien. against assessed real
property equal in rank- and dignity with the liens of all state, county, district or
municipal taxes and other non -ad valorem assessments. Except as otherwise provided
by law, such lien shall be superior in dignity to all other liens, titles and claims, until

the ad valorem tax bill for such year is otherwise paid in full pursuant to the Uniform
Assessment Collection Act. The lien shall be deemed perfected upon adoption by the
City Commission of the Annual Assessment Resolution and shall attach to the real
property included on the Capital Assessment Roll and Maintenance Assessment Roll
as of the prior January 1, the lien date for ad valorem taxes.
(2) As to any Tax Parcel that is to be acquired by a public entity through
condemnation, negotiated sale or otherwise prior to the adoption of the next Annual
Assessment Resolution, the Assessments shall constitute a lien against assessed real
property equal in rank and dignity with the liens of all state, county, district or
municipal taxes and other non -ad valorem assessments. Except as otherwise provided
by law, such lien shall be superior in dignity to all other Liens, titles and claims, until
paid. The lien shall be deemed perfected upon adoption by the City Commission of
the Annual Assessment Resolution and shall attach to the real property included on
the Capital Assessment Roll and Maintenance Assessment Roll upon adoption of the
Annual Assessment Resolution.

SECTION 7. COLLECTION OF ASSESSMENTS. The Assessments shall
be collected pursuant to the Uniform Assessment Collection Act. Upon adoption of the
Annual Assessment Resolution for each Fiscal Year, the Assessment Coordinator shall cause
the certification and delivery of the Capital Assessment Roll and the Maintenance
Assessment Roll to the Tax Collector by September 15, in the manner prescribed by the
Uniform Assessment Collection Act. The Capital Assessment Roll and the Maintenance
Assessment Roll, as delivered to the Tax Collector, shall be accompanied by a Certificate to
Non -Ad Valorem Assessments in substantially the form attached hereto as APPENDIX E.
SECTION 8. EFFECT OF FINAL ASSESSMENT RESOLUTION. The
adoption of this Resolution shall be the final adjudication of the issues presented herein and
in the Initial Assessment Resolution (including, but not limited to, the method by which the
Capital Assessments and the Maintenance Assessments will be computed, the Capital
Assessment Roll and the Maintenance Assessment Roll, the maximum annual Capital
Assessment and the maximum annual Maintenance Assessment and the levy and lien of the
Capital Assessments and the Maintenance Assessments) unless proper steps are initiated in a
court of competent jurisdiction to secure relief within 20 days from the date of City
Commission action on this Resolution.
SECTION 9. ASSESSMENT NOTICE. The Assessment Coordinator is
hereby directed to record a notice of the Assessments in the Official Records Book in. the
office of the Seminole County Cleric of Courts. Such notice shall be in substantially the form
attached as APPENDIX D hereto. The preliminary, Capital Assessment Roll and the
on
Maintenance Assessment Roll and each annual Capital Assessment Roll and the Maintenance
Assessment Roll shall be retained by the Assessment Coordinator and shall be available for
public inspection.
SECTION 10. CONFLICTS. All resolutions or parts thereof in conflict
herewith are hereby repealed to the extent of such. conflict.
SECTION 11. EFFECTIVE DATE. This Resolution shall take effect
immediately upon its adoption.

On September 4, 2012, the City Commission of the City of Longwood, Florida,
adopted Resolution No. 12-1319, which imposed special assessments against real property
located within the Shadow Hill Capital and Maintenance Assessment Area, which includes
the real property described in Appendix A of Resolution No. 12-1319, to finance the
construction and maintenance of certain local improvements. Attached as Exhibit A to this
notice is a list of the affected tax parcel numbers and real property owners (as shown on the
Seminole County ad valorem tax assessment roll as of the effective date of Resolution No.
12-1319) and the number of platted lots attributable to each tax parcel, if applicable. Annual
assessments will be collected on the ad valorem tax bill, as authorized by Section 197.3632,
Florida Statutes, commencing with the ad valorem tax bill to be mailed in October or
November 2012. The method of computing the annual capital and maintenance assessment
for any parcel of real property to which the Property Appraiser has assigned a distinct ad
valorem property tax identification number is set forth in Resolution No. 12-1315. The
capital assessment roll and maintenance assessment roll, which identify the number of platted
lots attributable to each parcel of real property are on file at the City of Longwood, Florida
City Hall and are open to public inspection. Resolution No. 12-1319 establishes a maximum
annual capital assessment rate of $22.00 per platted lot and maximum annual maintenance
assessment rate of $105.04 for all tax parcels.
This notice is recorded to provide constructive notice of the annual capital and
maintenance assessments to purchasers of real property located within the Shadow Hill
Capital and Maintenance Assessment Area. Neither Resolution No. 12-1315,ResolutionNo.
12-1319 nor this notice will create a lien upon the real property described above. The City
Commission will adopt an aimual assessment resolution for each fiscal year. Upon adoption
of each annual assessment resolution, capital assessments and maintenance assessments shall
constitute a lien against assessed real property equal in rank and dignity with the liens of all
state, county, district or municipal taxes and other non -ad valorem assessments. The lien
shall be deemed perfected upon adoption of each annual assessment resolution and shall
attach. to the real property included on the assessment roll as of the prior January 1, the lien
date for ad valorem taxes. This notice does not and shall not be construed to require that.

NEIGHBORHOOD IMPROVEMENT ASSESSMENT PROGRAM
SHADOW HIILIL SUBDIVISION
PETITION BY PROPERTY OWNERS
This petition is a request to the City Commission of the City of Longwood by the owners of property
located in the Shadow Hill Subdivision located in Plat Book 17 Pages 61, 62 & 63 respectively of the
Public Records of Seminole County, Florida to implement a Subdivision Beautification Program using
the Subdivision Beautification Assessment Program.
In order for the project to be considered 60% of the responding property owners must be in favor of the
subdivision beautification assessment program. If the project is approved by the City Commission, the
property owners will pay ALL costs associated with this project.
Each property owner will be assessed for a portion of the costs allocated on a per parcel basis. There are
1.75 assessable parcels of property in this area. The estimated total capital cost per parcel will be
approximately $22.00 for each assessable parcel of property and is payable up to ten (10) years on your
yearly property tax bill. A parcel is defined as a platted lot, not tax ID parcel. The estimated cost
includes the estimated financing fees, interest and pro-rata share of the borrowing costs if you choose to
pay for the assessment costs on your tax bill over the full term, up to 10 years. Interest rates are adjusted
annually to reflect the City's realized interest earnings rate. The most recent interest rate was
approximately 0.257%.
The Subdivision Beautification Assessment Program consists of a Capital component and a Maintenance
component. The Capital component will be up to a ten (10) year assessment program., subject to interest,
fees and borrowing costs unless the Capital component of the assessment is paid in full during the
allowable pre -payment period, in which case it will be subject for a 10% discount for pre -payment. The
pre -payment period commences after the final public hearing is held.
The Maintenance component of the assessment will be approximately $98.00 per year, however the
Maintenance component annual assessment amount may require adjustment from time to time, no more
frequently than annually, due to cost factors. Property owners will be advised of date and time of Public
Hearing for such adjustment.
Annual payments will include i-nterest accrued from the date of the Public Hearing and the annual
installments will reflect the assessment payment including interest, financing fees and a portion of the
borrowing costs and will appear on the tax bill beginning November of each year after the project is
approved. The assessments (on your tax bill) are subject to discounts if paid early and penalties

if the payments are delinquent. This particular assessment, if approved, will not appear on the tax bill
until at least November 2012. However, the project can be completed prior to the first installment
appearing on the tax bill.
Additionally, each property owner will be notified of the Public Hearing date and time by regular mail
after project design is completed. If the project is approved, each property owner will be notified by
certified mail of the due date of the assessment amount and when to pay in order to take advantage of the
pre -payment period. The annual payment amount for the capital component will remain the same
throughout the ten years of repayment of the assessments.
THIS PETITION MUST BE RETURNED WITHIN THIRTY (30) DAYS FROM TIIE DATE OF THE
MAILING IN ORDER TO BE INCLUDED IN THE TABULATION FOR RESPONSES FOR OR
AGAINST THE PROPOSED PROJECT.
THE INITIALLY PROPOSED CAPITAL IMPROVEMENTS INCLUDE UPGRADING AND
LANDSCAPING OF THE MAIN ENTRANCE AT EE WILLIAMSON ROAD AND SUNSET DRIVE.
UPGRADING AND LANDSCAPING OF THE TWO ISLANDS ON SUNSET DRIVE.
