Prince, Member Robin Thorn, Member 1. CALL TO ORDER Chair Noyes called the meeting to order at 6:57 p.m. 2. ADDITIONS AND DELETIONS None 3. APPROVAL OF THE MINUTES FOR A. Regular Meeting August 1, 2012. Vice-Chair Putz moved to approve the August 1, 2012 minutes as submitted. Seconded by Chair .Noyes and carried by a unanimous roll call and vote. 4. PUBLIC COMMENT None. Chair Noyes moved to close Public Comment. Vice -Chair PLltz seconded the motion. LPA Meeting — October 10, 2012 1 5. PUBLIC HEARING A. LDCA 02 -12 Longwood Development Code Amendment. Ordinance 12 -1998 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING THE LONGWOOD DEVELOPMENT CODE ARTICLE I GENERAL PROVISIONS, ARTICLE II LAND USE AND OVERLAY DISTRICTS, ARTICLE V SUPPLEMENTAL STANDARDS, )ESTABLISHING REQUIREMENTS FOR PAIN MANAGEMENT CLINICS, AND PROVIDING FOR CONFLICTS, CODIFICATION, SEVERABILITY AND EFFECTIVE DATE. Sheryl Bower stated that about a year ago the City of Longwood put a moratorium on pain clinics because they wanted to develop some regulations as to where they could be located. We have developed that code language for the board to review. Basically the code identifies areas where the City would accept pain management clinics which would be in the Industrial district and under certain conditions. The Code prohibits what is commonly known as Pill Mills. This is something the police have asked us to do. Vine -Chair Putz requested staff to hit the highlights and stated there was a pain clinic around Milwee and 434 that had closed and then re- opened. How did that re -open. Sheryl Bower stated it re- opened during the moratorium and that perhaps they had a Business Tax Receipt that had not yet expired. Therefore the Business Tax Receipt didn't trigger any kind of review or the building hadn't been vacated long enough to be considered abandoned. Vice -Chair Putz asked if existing pain clinics can stay even if they are dispensing pills. Sheryl Bower stated i.f they meet the definition of "Pill Mill" then they would be considered illegal. Vice -Chair Putz connnented this one, then, must have been legal. Chair Noyes stated so what you are establishing is if -an existing business is operating under a legal pain management clinic then that's one thing, but if it :falls under the definition of pill mill, then that's a totally different thing. Sheryl Bower answered yes, if they are existing, or grandfathered in, on the effective date of this regulation. New ones would be subject to these new regulations. LPA Meeting — October 10, 2012 2 Vice: -Chair Putz asked for confirmation that pain management clinics are not allowed to dispense medication from the premises. They have to write a prescription and send them to the pharmacy.. Chair Names stated that is the way the law is written. They cam be a combination doctor visit and pharmacy visit. Sheryl Bower answered yes. They can be either a pharmacy or they can be a doctor's office. Chair Noyes commented but not a one stop shop. Vice -Chair Putz stated she tivill make a motion for the City Commission to approve LDCA 02 -12 Amendment Code Ordinance 12 -1998 as submitted Seconded by Member Fiore and carried by a unanimous roll call and vote. G. DISCUSSION AND SCHEDULE FOR FU'T'URE AGENDA ITEMS Discussion ensued regarding potential fixture items. Next Regularly Scheduled Meeting: November 14, 2012. 7.
