Ordinance 13-2009 ORDINANCE NO. 13 -2009 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, AMENDING ORDINANCE NO. 1019, SAID ORDINANCE BEING THE COM= PREHENSIVE PLAN FOR THE CITY OF LONGWOOD, FLORIDA; BY ADOPTING A SMALL SCALE COMPREHENSIVE PLAN AMENDMENT (SPA 02 -13) CHANGING THE LAND USE DESIGNATION ON THE COMPREHENSIVE PLAN FUTURE LAND USE MAP FROM COUNTY MIXED DEVELOPMENT (MXD) TO CITY INFILL AND MIXED -USE (IMU) AND AMENDING THE LONGWOOD DESIGN GUIDEBOOK DISTRICTS MAP TO ASSIGN THE EAST END PLANNING DISTRICT FOR THE PROPERTY WITH TAX PARCEL ID #05- 21 -30- 523- 0000 -OOAA; PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, on July 20, 1992, the City of Longwood adopted its Comprehensive Plan (Ordinance No. 1019) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and Chapter 9J -5 Florida Administrative Code; and WHEREAS, Section 163.3174 (4) (a), Florida Statutes requires the Land Planning Agency (LPA) to make recommendations to the governing body regarding amendments to the Comprehensive Plan; and WHEREAS, the LPA held a public hearing on August 14, 2013 to consider the Small Scale Plan Amendment request; and recommended the proposed Small Scale Plan Amendment (SPA 02 -13) be approved by the City Commission; and WHEREAS, the City Commission held a publ. c hearing on October 7, 2013 pursuant to the requirements of Section 163.3187, Florida Statutes; and WHEREAS, the Small Scale Plan Amendment adopted by this Ordinance is internally consistent with the City of Longwood Comprehensive Plan and its goals, policies and objectives. Ordinance 13 -2009 - Page 1 of 5 BE IT SO ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA, AS FOLLOWS: SECTION 1: Future Land Use Map Amendment The Future Land Use Map of the Comprehensive Plan of the City of Longwood is hereby amended to change the future land use designation of the properly described as: 1990 S. US Hwy 17 -92 Seminole County Tax Parcel ID #: 05 -21 -30 -523- 0000 -OOAA as depicted in EXHIBIT A attached hereto and incorporated herein by this reference, from County MIXED DEVELOPMENT (MXD) TO City INFILL AND MIXED USE (IMU). SECTION 2 : Planning District The Longwood Planning District Map of the Longwood Design Guidebook is hereby amended to assign the EAST END PLANNING DISTRICT to the property described as: 1990 S. US Hwy 17 -92 Seminole County Tax Parcel ID #: 05 -21 -30 -523- 0000 -OOAA as depicted in EXHIBIT B, attached hereto incorporated herein by this reference. SECTION 3: Severability If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this Ordinance. SECTION 4: Conflicts If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. SECTION 5 : Effective Date Pursuant to the requirements of Section 163.3187(5)(c), Florida Statutes, this Ordinance shall not take effect until thirty -one (3 1) days after adoption, unless a challenge has been filed within thirty (30) days from adoption. If timely challenged, this Ordinance shall not become effective until it is found in compliance as provided in Section 163.3187(5)(c), Florida Statutes.
