Ordinance 13-2021 ORDINANCE NO. 13 -2021
AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA,
APPROVAL OF A MULTI -YEAR EQUIPMENT AND
MAINTENANCE LEASE WITH RICOH USA, INC., PROVIDING
FOR CONFLICTS AND SEVERABILITY AND AN EFFECTIVE
DATE.
Whereas, the City of Longwood desires utilizing a multi -year equipment and maintenance lease for various
printers, black and white copiers, color copiers and scanners. The equipment and maintenance will be
provided by Ricoh USA, Inc. and used by City departments,
Whereas, the Charter for the City of Longwood, Florida provides that contracts that extend beyond the
current fiscal year must be approved by Ordinance,
Whereas, the acquisition of equipment and services provided by Ricoh USA, Inc. is in the public interest to
provide quality service;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
LONGWOOD, FLORIDA, AS FOLLOWS:
Section 1: The Ricoh USA, Inc. equipment and maintenance supports the City of Longwood's
business processes,
Section 2: The lease and maintenance pricing is based on a US Communities contract (contract
number 4400003732), and the City of Longwood has been using Ricoh USA Inc. equipment and maintenance
since 2007.
Section 3: The City of Longwood Information Technology Department has provided for the specific
needs of the City of Longwood to provide access to various printers, black and white copiers, color copiers
and scanners with ongoing maintenance during the 48 month term of the lease.
Section 4: The City of Longwood Information Technology Department has the desire to provide
access to various printers, black and white copiers, color copiers and scamigs to City departments,
Section 5: The City of Longwood Information Technology Department through Ricoh USA Inc. has
provided for cost effectiveness; equipment and maintenance; and improved performance for the City of
Longwood, Florida,
Section 6: The City Commission hereby approves the contract with Ricoh USA Inc. attached hereto
and authorizes its execution,
Section 7: If any Ordinance part thereof is in conflict herewith, this Ordinance shall control to the
extent of the conflict.
Section 8: It is an express contingency of the City Commission's approval and the City's execution of
the agreement that the City's payment and performance obligations under the agreement for each and every
fiscal period beyond the fiscal period when the agreement is executed shall be subject to discretionary annual
appropriation by the City Commission of funds therefore. When funds are not appropriated or otherwise
made available to support the continuation of payment and performance in a subsequent fiscal period, the
agreement shall be deemed terminated on the last day of the fiscal period for which appropriations were
made, without further cost, penalty or obligation to the City.
Section 9: The provisions of this Ordinance are declared to be separable and if any section, paragraph,
sentence or word of this Ordinance or the application thereto any person or circumstances is held invalid,
that invalidity shall not affect other sections or words or applications of this Ordinance. If any part of this
Ordinance is found to be preempted or otherwise superseded, the remainder shall nevertheless be given full
force and effect to the extent permitted by the severance of such preempted or superseded part.
Section 10: This Ordinance shall be in force and take effect immediately upon complete execution of
the Contracts.
