14-2035 Approving a Multi-Year Water Meter and Related Hardware and Software Agreement with Sunstate Meter & Supply, Inc.ORDINANCE NO. 14-2035 AN ORDINANCE OF THE CITY OF LONGWOOD, FLORIDA, APPROVING A MULTI -YEAR WATER. METER AND RELATED HARDWARE AND SOFTWARE AGREEMENT WITH SUNSTATE METER & SUPPLY, INC., PROVIDING FOR CONFLICTS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City of Longwood desire3 utilizing water meters and related hardware/software provided by Sunstate Meter & Supply, Inc. for the City Utility Division; and WHEREAS, the provision of these products/materials as outlined is in the public; interest to provide quality product and service; and WHEREAS, the WATER METER AND RELATED HARDWARE AND SOFTWARE AGREEMENT with Sunstate Meter & Supply, Inc. attached hereto (herein sometimes referred to as the "agreement") streamlines the City of Longwood's Utility Division annual requirements processes; and WHEREAS, the City of Longwood desires to utilize this agreement to provide water meters and related hardware/software on an as needed, when needed basis; and WHEREAS, the Finance Department and Ut lity Division has identified the specific needs of the City of Longwood by utilizing product and cost comparisons; and WHEREAS, the City of Longwood Utility Division through Sunstate Meter & Supply, Inc. will provide cost effectiveness, product/material quality, and improved performance and efficiency for the City of Longwood, Florida; and WHEREAS, the City of Longwood has procured the agreement approved herein by piggybacking upon the City of Port Saint Lucie and Sunstate Meter & Supply, Inc. Contract No. 20130109 dated April 16, 2014 as awarded through a prior issued solicitation and Single Source Distributor: and WHEREAS, the City Commission hereby exercises the exemptions to formal procurement set forth in Section 62-36(b) and (c), Longwood City Code in approving the WATER METER AND RELATED HARDWARE AND SOFTWARE AGREEMENT between the Sunstate Meter & Supply, Inc. and the City of Longwood; and WHEREAS, the Charter for the City of Longwood, Florida provides that contracts that extend beyond the current fiscal year must be approved by Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LONGWOOD, FLORIDA: Section 1. Recitals. The above recitals are truE� and correct and constitute the City Commission's findings. Page 1 of 2 Section 2. Approval. The City Commission hereby approves the WATER METER AND RELATED HARDWARE AND SOFTWARE AGREEMENT between the Sunstate Meter & Supply, Inc. and the City of Longwood, a copy of which is attached hereto. The City Administrator is hereby authorized to execute and deliver such agreement on behalf of the City. Section 3. Conflicts. If any Ordinance or part thereof is in conflict herewith, this Ordinance shall control to the extent of the conflict. Section 4. Severability. The provisions of this Ordinance are declared to be separable and if any section, paragraph, sentence or work of this Ordinance or the application thereto any person or circumstances is held invalid, that invalidity shall not affect other sections or words or applications of this Ordinance. If any part of this Ordinance is found to be preempted or otherwise superseded, the remainder shall nevertheless be given full force and effect to the extent permitted by the severance of such preempted or superseded part. Section 5. Effective Date. This Ordinance shall take effect upon its second reading and final adoption by City Commission.
