CALL MEETING TO ORDER: Special Magistrate Amy Goodblatt called the meeting to order at 7:00 p.m. �'•• APPROVAL OF THE MINUTES FROM THE APRIL 24, 2014 HEARING: Special Magistrate Goodblatt approved Minutes of the April 24, 2014 meeting. 3. SPECIAL MAGISTRATE GOODBLATT'S EXPLANATION OF PROCEEDINGS: Special Magistrate Goodblatt explained the hearing process for the attendees 4. Ronald Reagan Blvd. #122/142 Longwood, FL 32750 CEO Howington introduced herself and stated that: the Fire Marshal had reported several code violations were present at this location which involved doing; interior alterations without a permit and that a Stop Work Order had been issued by the Building Official on 1/11/13. CEO Howington stated that based upon the documentation provided by the Fire Marshal, a Notice of Violation citing LDC Art. X, Sec. 10.1.0; F13C, Sec. 105.1, 2010 Edition — Construction Permit; Fire Prevention Code 2010 Edition; & N.F.P.A. 1, Sec. 1.12.7(A) was issued on 4/25/14 and given to Donald Campbell, President/CEO of Feeding Families Everywhere who is the tenant at this location. A copy of the Notice of Violation was also given to Cedric Waters, Tenant Improvement Manger for American Industrial Center, the property owner, on 4/29/14. Compliance was to have been met by 5/5/14. On 5/8/14 CEO Howington contacted the Building DepartmE!nt to see if permits had been issued and was advised that they had not. CEO Howington prepared a Notice of Hearing which was served on Sera Griffin, the executive coordinator for the tenant, Feeding Children Everywhere on 5/9/14 at 11:30 a.m. and also served a copy of the Notice of Hearing on Cedric Water, the tenant improvement manager for American Industrial Center the same day. Both notices were served by CEO Howington. CEO Howington stated that as of this date, no permits have been issued for this work. The Fire Marshal, Lillian Sexton was introduced and gave the Special Magistrate as well as the Respondents, a packet containing documentation including a timeline as to the events that had taken place regarding this case as well as inspection reports and a -mails between the Fire Marshal, the Building Official and the tenant. Fire Marshal Sexton also briefly gave testimony as to what was required to correct the violations stating that plans needed to be submitted for the removal of the fire rated wall between units 122 and 142 which CEH 05/22/14 Page 2 of 4 was done without a permit. The Fire Marshal also stated that due to this renovation and the size of the combined units a fire alarm system is now required. The City submitted a Cost Recovery Form requesting an Administrative Fee of $603.79. The tenant, Donald Campbell, President and CEO of Feeding Families Everywhere gave testimony indicating that this was a non-profit organization that assembles meals for hungry children. Mr. Campbell stated that he uses volunteers to do this. Mr. Campbell also stated that he does want to comply and stated that the original contractor had been terminated for non-performance of the original building permits. Mr. Campbell stated that a new architect and contractor have been hired. The Special Magistrate had several questions for the Code Enforcement Officer, the Fire Marshal as well as the Respondents. Special Magistrate Goodblatt made her findings on the case. It is the order of the Special Magistrate that based upon the evidence, the respondents have violated LDC, Art. X, Section 10.1.0/FBC, Sec. 105.1, 2010 Edition/Fire Prevention Code 2010 Edition & N.F.P.A. 1, Sec. 1.12.7(A) in that interior renovations to units 122 .and 142 were made without a permit after the date set for compliance. Proper service was made on the respondents. In order to come into compliance a permit shall be obtained for all construction work undertaken and all inspections must be completed and approved. Respondents are to submit plans on or before June 10, 2,014 and work must be satisfactorily completed sixty days after the City approves the permit, this includes the inspections. The Respondents are to notify the Code Enforcement Officer when they are in compliance. If Respondents do not comply by submitting plans on or before June 10, 2014 or if the work is not satisfactorily completed sixty days after the City approves the permit and finalizes the inspections, the Respondents shall, jointly and severally, pay a fine of $100.00 per day for each day the violation continues to exist. The Respondents, jointly and severally, are to pay administrative costs of $600.00, only if full compliance is not met. There is no administrative fee if compliance is met.
